I have heard a lot of people are getting blue slips because of improper tax filings. 

 

My husband is out of the country. Last year my accountant filed for us as married filing joint. Should I do the same this year?

I have never seen a case where the person received a 221g for improper tax filing status........That is an IRS matter, not an immigration matter....

What constitutes an improper tax filing?  

 

The only significant improper tax filing  is a failure to file at all

The only options that apply here are married filing separate or marred filing joint. The natural thing would be to go with a lower tax burden option.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

People that make the correct amount of income but have many dependents that disqualifies them as sponsors.

 

My question is that last year my accountant filed for me married filing joint. My husband has never been to the us. Should I file the same way this year? I am worried that if I file married filing separate this year and they ask for both years they will question why I did them differently

I have never seen a case where the person received a 221g for improper tax filing status........That is an IRS matter, not an immigration matter....

That is not an immigration matter.....you should file using the best strategy for your case.

Why would you file differently than prior?  MFJ typically results in the least amount of tax liability

Depends on whether your husband has foreign income.  

Obviously, your husband has a SSN or ITIN since you filed joint last year..........

Nothing was wrong filing jointly so long as he qualified for it (i.e. he needed an SSN or ITIN). And without those, the IRS would not have accepted it anyway.

You can file jointly or separately this year as well. It's not an immigration matter. That's a personal tax decision, presumably whichever one has the lower tax obligation.

Joint taxes are not evidence of a bona fide marriage any more than separate taxes. Just so long as your claimed to be married, I wouldn't expect any issues related to this.

221G Blue Form: A 221g Blue form simply means that they are asking for extra Supporting Documents that is required by the US Embassy to take a decision on your Visa Issuance.

 

doesn't have to be about taxes 

 

and not sure why you wouldn't do the same as an accountant did last year 

BTW  April 17 is the day they need to be mailed in which should have been extended at least a month for the long government shutdown

April 17 is the extended deadline for residents of Maine and Massachusetts only. Everyone else's are due today, April 15.

Shutdown had zero affect on the tax filing season
