    I just received the email that my interview has been scheduled. Since I don't have a timeline for my N-400 due to active F2A case with my husband, I'm posting my dates here:
     
    Priority Date: 01/18/2020
    Biometrics: 02/04/2020
    Interview scheduled: 03/08/2021
    Date: TBD (probably sometime in April?)

    you should be fine - from what I read it's fine to bring proof of relationship to the interview if you apply under 3 year rule.
    I uploaded 3 years of tax transcripts, but it doesn't seem to be a requirement until the interview.

    It sounds as though he's committing UPL (unauthorized practice of law).
    Because it involves immigration, it may even be a Federal crime.
    He absolutely needs to be reported, along with your findings, to every possible agency.
    Start with his local police department, if you know where he is, or the State Police.
    Even if you yourself aren't 100% sure about him, the investigating agencies will get to the bottom of it.

    I highly recommend going full-effort and getting "wet" signatures on these documents. We were successful getting our ITIN and refund, but that doesn't make me an expert 😜
     
    Perhaps look into ITIN Acceptance Agents near your overseas spouse?

    The beneficiary (if abroad) does not have to sign it. It’s clearly stated in instructions.

    You cannot assume that NVC employees know of the situation. You can do a time table of the events, add a link to a credible news source to each (Reuters, AP, CNN...), explain the distance to your spouses home, and the impact that it had. You cannot expect an expedite to happen based on your word only. Covid is rampage everywhere and Iraq still on the lower end of infections per 100k, so I wouldn't use that. But the attacks for sure, with dates, links to news reports, and distance/impact on your spouse. Expedites are more likely to be granted if the petitioner suffers, so expand on the impact it has on you. If you are on any anti-anxiety meds and have a doctor that can attest to your declining situation based on the fear of losing your spouse, he should write a letter that you also attach in support of your hardship. The situation in Iraq is real, but it's on you to provide the proof and impact it has on you.

    Thank you for your responses, but these were not my questions.
    A permanent resident can very well sponsor their spouse, the first step is the I-130 just like for citizen sponsors, and the category is F2A as opposed to CR1/IR1 for citizens.
    Also as VAWA approved PR you can file under 3 year rule, so that comment is not quite accurate either. The questions I posted are a bit more complex than that.

    Yup, that is correct.
     
    Just a note about the 90 day early filing period for the few cases that had fast DCF, then 2 dates matter:
    "we had to hold off on filing for the N-400 because, though our 90-day window had opened, we had not been married 3 years yet. We filed N-400 the day after our wedding anniversary.

    The way that the 3 year rule works is 3 years from whichever is last of the following:
    1. You became an LPR (resident since date)
    2. Date of marriage
    3. Date of when spouse became a US Citizen
     
    In vast majority of cases point 1 is the last one. In this particular case point 3 would be the last one. Point 2 would be the last one if for example you got the green card via work and shortly thereafter married a USC.

    This was my response to your comment that they become eligible under 3 year rule or 5 year rule based on the date when they become a permanent resident. Which for spouses being interviewed at a consulate abroad is POE. My question was if petitioner has to be USC at the time when beneficiary becomes an LPR, to qualify under 3 year rule.

    Well, I don't even have an interview scheduled yet. Radio silence since Biometrics and I filed in Jan 2020.

    Yes yes, all done since February 2020. Since then it says "we are actively reviewing your case"... Lotta bang for my buck I'm getting, that's over 370 days of "active" review

    What do you mean waiting for result? They said they cannot make a decision if you are eligible for Citizenship? Have you gotten a Senator to inquire on your behalf why this is taking so long?
     
    I personally would wait with marriage until you naturalize. Simply because you would potentially trigger another delay if you had your interview as single but show up to oath as married. But I'm not 100% sure about that. Maybe make a new post in the N-400 section to get more attention and others can advise
