mudman64 reacted to Crazy Cat in K1 Visa... to file or not?
The queue is getting longer every day......but have you considered the CR-1?
Every couple has their own priorities, and each couple must decide which visa is better for their situation.
K-1
Slightly faster arrival in the US
More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)
Spouse can not work until she/he receives EAD (approx 5-6 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A denied K-1 is sent back to USCIS to expire
CR-1
Slightly slower arrival in the US
Less expensive than K-1
No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
Intent to deny can be rebutted and reviewed.

Unfortunately, fiancés do not have the same “status” as the lawful spouses.
Might be easier to just marry already, honestly.

mudman64 reacted to Greenbaum in JULY 2020 I-129F K-1 FILERS
Welcome to the July thread. Use the guides from the blue ribbon to insure you have everything needed for your submission of the I-129f, Petition for Alien Fiancé(e). Go to the blue ribbon above, select "guides" then "immigration guides" scroll and select the K-1. Looks like this Guides if you are engaged: K1 Fiancé Visa Guide.
Also,
We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine their Embassy. The country that should be used is the country where the interview will take place.
So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Once you finish that then return and you will see a flag in your profile. Select it and see what wonderful information will open up for you.
Thanks

mudman64 reacted to Crazy Cat in To Lawyer or Not to Lawyer
Why would you need an attorney? The guides here are pretty good. We used an attorney for my wife's CR-1, and it delayed our case by 3 months (due to a mistake by the attorney's office).

You didn't ask for this, but have you considered the real differences between a K-1 and CR-1?

mudman64 reacted to Sinead91 in Anybody given up on getting a K1 Visa and just got married?
While I understand this sentiment, immigration attorneys are not employed by USCIS. It is their interpretation of the laws. Any lawyer I have spoken to in the past has given different information. One said red. One said blue. One said yellow. One said 3. One said you can’t visit while you have a k1 in process. They don’t have access to extra information, they see the same EO that we do...only perhaps they deal with different people and have different statistics.
it is not written anywhere that you cannot void your k1 and do an AOS (once it was not your intention at CPD) Yes, CR1 would be the best option but alas, here we all are. others who were in the same situation as OP and myself have said that they voided their k1 and did this process without any problems, it was not even questioned at their interviews.
just my two cents on the topic. Some people feel safer using a lawyer and giving someone 6,000$ to transfer their information to paper, some people prefer to do it themselves....

Also I-130A and I-864
@VisaDonnie, you fill out I-130 and I-864. Reina fills out I-130A, I-485, I-944, I-765, and I-131.
In general, send the following four packets in the same envelope:
I-130 with I-130A and copy of marriage certificate, filing fees, etc.; I-485 with I-864 and supporting documents, I-944 and supporting documents, electronic I-94 copy, filing fees, etc.; I-765 with electronic I-94 copy, etc.; and I-131 with electronic I-94 copy, etc. You'll separate each packet with rubber bands or fasteners: https://www.uscis.gov/forms/forms-information/form-filing-tips
On the I-130 packet, I-130 payment method (check, money order, or Form G-1450) must be the very first item of this packet.
On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.
Also, note that USCIS has a credit card payment option. So if you have a credit card with a good rewards program I recommend paying with credit card. https://www.uscis.gov/forms/pay-a-credit-card In that scenario, it'll be 2 Form G-1450.
On the G-1450 for I-130 packet put your name in the first row. G-1450 must be the very first page of this packet. On the G-1450 for I-485 packet put Reina's name in the first row. G-1450 must be the very first page of this packet. -
mudman64 reacted to Crazy Cat in Anybody given up on getting a K1 Visa and just got married?
Step one is to legally marry. Step 2 is to file the I-130. The spousal visa process was taking 12-18 months pre-covid...... You cannot file the I-130 until after legal marriage.

mudman64 reacted to Scandi in I-129F: Proof of intent to marry
No ring, engagement ceremony etc needed. All USCIS wants is a letter of intent to marry, one from each of you. Signed and dated. They don't care about rings etc.

mudman64 reacted to SalishSea in I-129F PETITION FOR ALIEN FINANCE 2nd one
Should be fine. It is long enough that you won't be subject to a multiple filer waiver. Just make sure you don't file until after the divorce is final.

mudman64 reacted to MeghanK in Almost done with 129F, just some OCD questions? Help
You HAVE TO include two letters of intent, a separate one for each of you. It's one of the main requirements of the I-129f. OP make sure you have these if you do not yet. They don't need to be full of a bunch of details though, wedding plans and such, they can simply say "I intend to marry [beneficiary/petitioner name] within 90 days of entry to the U.S." There are plenty of sample letters to grab throughout VJ if needed.

mudman64 reacted to Greenbaum in Short relationship and now pregnant!
First this is a pretty simple process to get a K-1 visa so it's unnecessary to have a lawyer. But if you feel more comfortable then it is after all your choice. Lots of good folks here to help you.
Second, on any visits start compiling your pictures, receipts etc. for the interview. Since you met you said you have some items and that she is going to visit in March you'll have even more so I really don't see that as an issue.

Before you file any documents to USCIS you must translate anything that is not in english to them.
-
mudman64 reacted to FaithProfessoR in Spanish documents translation
Hi. I filed for a K1 visa not sure if you are filing for that or the CR1 my fiancee country is Ecuador obviously her country is all spanish. I have petition her on November got approved in March with no problem using this service:
https://www.translateday.com/
They have the seal of USCIS on their page meaning that they know what there doing for immigration. They certified the translation however it has a cost normally the respond in 2-3 days.
If you can translate I think there no problem with USCIS, however In my case I wanted to give the impression that I invested on this process to get a swift approval also looks profesional.
I hope this help

I see you everywhere Mr Missileman, you are quite popular and always giving straight forward answers..👍🏼

mudman64 reacted to inneedofmyhb in Spanish documents translation
Yes, you definitely need all the official documents translated. If you don’t they will reject your case for incompleteness. They will keep your money and you make you start all over again. Not worth it. They also have to be certified translated, I.e., a certified statement will be attached to the actual English translated documents. I use The Spanish Group. They are online and do everything electronically. It was the most convenient and they translate for immigration documents all the time. I’ve listed their website below.
