I wouldn't reschedule an interview..They're hard to come by. Infact, 20 days is lucky

Since it’s a day before ur trip I would recommend just going, I heard way to many horror stories were people rescheduled and it ended up not being properly updated n they end up getting denied. I would keep the interview and reschedule the oath ceremony if it’s not gonna be on same day.
  3. Thanks
Najee & Maan reacted to Kai G. Llewellyn in Why does the US hate AOS from tourist visas?
    It's simple really...

It's far easier for the US government to deny an immigrant visa case whereby the applicant is in their home country and doesn't need to be deported vs. a failed adjustment of status case whereby the applicant could just fall off the radar, or have to be put through removal proceedings.

Do I agree with this stance? Not really, Canada on the other hand is perfectly fine with tourists planning to submit an inland application for permanent residence when they enter the country. Though they will refuse to issue a temporary residence visa (if you require one) if they think you're planning to do that. If you're already in possession of a TRV or visa-exempt, then it's no big deal.

Could be worse though, the UK doesn't allow you to apply for PR at all (ILR) until you've resided like 5 years in the country, even if you're a spouse. You get a visa granting a stay of 2 years 9 months, then you renew it for a further period, then only after that can you get ILR, and if you were admitted for no more than 6 months you must apply from abroad.

At the end of the day really, different countries, different requirements and the joys of being an immigrant is if the government tells you to jump, you say 'how high?'

So... I received my interview notice today!!!
My interview will take place exactly 6 months after I filed my case. (04/11/2022 - 10/11/2022).
I just want to thank all of you who post updates about your case, why? Because when I filed and I saw that my "estimated time* until case decision was approx. 18 months", I started to make travel plans, but out of the blue I found this community and it made me cancel all my plans as I noticed the cases were speeding up!
    This is my thankful post

Random fact, if I pass the test and become a US citizen that day, it would be 3 years, 3 months and 7 days since I came to the US.

    1.  Your wife can not be deported for working under the table.  Illegal work is ignored for the spouse of a USC.

    2.  BS on having any attorney on retainer.

    3.  I wouldn't give this lady any personal information; especially SSN.  The chances for identity fraud and opening financial accounts are high.

    4.  Let it go.  No one has clean hands.  Your wife was working illegally.  This lady took advantage of that.  Just let it go and ignore her.  Is $1500 worth more BS?

OK.  Unless he has some very solid proof, she has nothing to worry about.  This sounds scorned spouse talking.

The uncle has no control over her immigration status......That is a typical idle threat with no teeth.  He is years too late try that stuff.  He would be admitting that he committed fraud, imo.

Najee & Maan reacted to aaron2020 in Postmark date when filing I-751? Mail out 1-2 days before 90 days?
Paper filings are easy to time.

The problem will be electronic filings.  There was a poster who e-filed (something I forgot) when he was eligible and the computer system stamped it a few hours earlier.  He speculated it was because of time zone differences.  His e-filing was ultimately rejected.

Yes, the day they receive it is what matters. But as noted, no reason to tempt fate to save a day or 2 in a 1-2 year process.

Najee & Maan reacted to Elethiomel in Postmark date when filing I-751? Mail out 1-2 days before 90 days?
I sent it the day before my window, it arrived the day after the window opened and my actual receipt date ended up being a couple of days later. I ended up panicking because people told me the postmark was what determined "filing date".

I did some research in the Code of Federal Regulations and it seems like posting date doesn't matter for this purpose, it is actual date of receipt. "The date of filing is not the date of mailing, but the actual receipt of receipt at the designated
filing location. 8 C.F.R. 103.2(a)(7)(i)." was from a USCIS Decision I found on the topic.

Now, that said, I had a massive anxiety it would be rejected because I mailed it early so why subject yourself to that? If I could do it again I would just mail it the day the window opened, or a couple of days later if you want to play it safe.

There's no reason to send it early, even if it's just one day. Wait until the window is actually open, it's not like they will process the case any faster just because you sent it two days prior.

    Oh that's frustating.

While I know its irritating and scary - just move on - and do everything again with the dates from today, etc. - so that its obvious you are within the time frame.

I also recommend that since your GC expires on 2/26 - send it via overnight FedEx/UPS and do not rely on USPS as there are still delays and that's not good for your case.

Good Luck! - it will work out
