  1. Hey y'all,

     

    So I'm asking for a friend that needs advice (yes, I know, I know. I'll get her in here eventually.)

     

    Her AOS NOA1 is 10/17 and she doesn't recall if she had to pay a fee or not for her EAD/AP. I'm guessing probably not if it was mailed before Oct 2nd but not processed until the 17th?

     

    She now needs to renew her EAD while her AOS is pending and the exemption states its for applicants who "filed for adjustment of status on or after July 30, 2007 and before October 2, 2020" and paid the appropriate fee.

     

    So, our question is: to pay the fee or not to pay the fee?

    Her medical will be in the sealed package, yes. However, make sure to get copies of the vaccination form DS-3025 (given outside the package; don't open the sealed package) and send one along with your I-485 (and bring one to the interview). They usually don't ask for medicals here if you file within the year since your medical, but some people have been asked for it recently at the interview. I wouldn't bother getting another medical here unless you get an RFE for one or you are asked for one at the interview.

     

    Also, make sure that her doctor check marked "K visa applicant voluntarily completed vaccination requirements" on her DS-3025. If it isn't, you may run a higher risk for an RFE or a transcription of the vaccinations onto an I-693 form.

    The number stays the same but you have to go back after you get your green card so they can remove the wording "with DHS approval"

    In the USA, business will think Michael is my middle name.

    My car registration and phone bill and bank account and taxes have my correct name though.

     

    Should I have listed these names? The reason I didn't is that the question is "Other Names You Have Used Since Birth...".

     

    I myself never used any other names, others are using weird names to address me.

    Idk if this is in terms to your passport showing your father's name, but if that's the case you don't have to use it. You can simply use "John Smith" and it's recognized this way, at least for the USCIS and the social security office from our experience. However if you want to adopt "Michael" as your middle name, you can do so now since you are able to get a legal name change through citizenship.

    I guess emailing both would be the best bet. Yes, NVC is the one that schedules and probably the one you have to talk to, but I think it also depends on the availability of the embassy. There's people that have waited months for an interview for F type visas, so maybe if they are both aware of the situation something can be done. Just my two cents. Good luck!

    I don't know if they will expedite it, but it's worth a shot to email the embassy and request it. They won't take phone calls however they usually respond to emails at BeirutIV@state.gov.

    funny thing is i dont expect we will ever get an EAD since we just got scheduled for interview status today, so i am actually a bit apprehensive since it seems to be going VERY fast. we filed in Sept

    Retroactively thinking, it could just have been his character and I took it as him being too aloof. We got our approval and card in production statuses within the same day, so don't lose hope! It should all go well :)

     

    As far as bonafides, all he wanted a copy of was the lease agreement. We did take a lot of proof but he only asked for bills so we showed him the light bill (in my name) and the internet bill (in his). After those, he just asked if we had a lease and we said yes and that's all he took. You might not have the EAD, no, but that's awesome because you should have the green card soon! My friend applied in July and she's having her interview in San Antonio today, two days after mine and there's a whole month of difference from when we applied (May 29th). It looks like the San Antonio office is speeding up.

    We haven't received my husband's card yet, but our interview was yesterday and the card is already in production as of this morning. The officer had a post-it on our file that read "Needs Medical" and I caught that right away and panicked but he only asked for the DS-3025 since he didn't see it in the file. He made no mention of the I-693.

    If you have informed delivery, there are notification options for when a "package" first hits the system.  I don't think they are enabled by default.  I enabled them last week.  As soon as USPS picked ours up I got an email from informed delivery, with tracking number etc.  A couple of hours later, the old site updated to "USPS picked up" and where the tracking number should be it said UNAVAILABLE.  The new site updated with the same, but with tracking number, the day after we received the cards lol.

    Yeah but usps wont update that until they pick it up and scan it in which usually happens after that status.  Ours didnt even show on Informed Delivery until the next day. 

     

    Our status change did show unavailable on the email notification but when you visit the desktop site it shows you the tracking.

    Theres no written rule about the time limit to file but after their I94 expires they will be out of status until they do. That means they can get a visit from ICE at any point or be detained for being out of status. There's been a few horror stories here already of both of those scenarios so I would suggest to them that they file as soon as possible.

    If already working he would have already provided his EAD and would not need to do so again until its expiry.

    If not working yet he'll just have to wait for his GC so then he can update his SSN and have the DHS authorization statement removed. Once he receives his GC he doesn't even need to provide that to work. His DL and new SSN without the statement will do just fine to satisfy the requirements of an I-9.

    He isnt employed yet, he had two interviews set up today after his AOS interview and we were worried this status was going to drag on but it just changed to case was approved :) so hopefully he gets his green card by this week and we dont have to worry about him not having the EAD anymore.

    we all go through this "review" process, usually it's being transferred to a supervisor to look it over. our IO just told us she has to have her supervisor review it and we'll hear something within a month. 2 weeks later card is being delivered to us. taking the EAD should not alarm you, your green card will replace it anyhow.

    No he didn't specify approval but he did say he needed to update our case tonight with the changes made at the interview (social added, ead added, and address) and if everything we said was truthful he should get his green card in 2-3 weeks. I think what creeped us out is that status change.

  15. Is it normal for them to take the EAD card after the interview? They took my husband's today because "its protocol" and now he has no way to show proof he can work until he gets his green card (which I thought was the point of the EAD card) and our status changed to "Interview Complete and Case Must Be Reviewed" which I've read the AOS version of black home AP so we are a bit stressed.

    They had a power outage so they were running behind today but yes the interview lasted about 10-15 min. It went... okay. Idk why I wasn't impressed but I wasn't. The IO didnt ask for any of the documents. He didnt even go through our pics. He asked how we met etc, if he had met my family and if I met his, then he asked for a pic of our wedding. He took just the 1 pic... didnt look at any of the others. He then asked about his job history and asked if we had any bills to prove bonafides. He took a copy of our lease agreement and that's it... didnt look at anything else. Then he said he has to update the changes in our file tonight and if everything we said was truthful (for some reason came out like a weird choice of words to me) he would have his green card in 2 weeks.

     

    Then an hour later we got a status update to "Interview is Completed and Case Must be Reviewed" 😥 so idk where we stand right now. We are kinda bummed.

     

     

    P.S. he also took his EAD card which REALLY sucks because now he has no way to prove he can work or travel and we dont know how long this "review" takes. Overall, I'm more stressed now than when we went in. 

  17. Those of you that had their green card interview at the San Antonio office:

     

    How long did it take in and out? My husband has his interview on Monday at 10am and a job interview that we'd hate for him to miss at 12pm (he tried scheduling later but management I guess is only available during that time) so we were hoping the AOS interview wasn't anything like the embassy one time-wise that took 3-4 hours.

     

    Any feedback is appreciated!

    120 days before it expires you can request an extension which will last 180 days. I believe you can do that twice so hopefully your green card process should be concluded before then.
