He means separate DS-160s  for interview (non-immigrant visa - K1 for mother, K2 for child). You only do one I-129f and list the child where asked about.

The point of withdrawing is having clean immigration history. Two I-130s can confuse USCIS.
There's no expedite for petitioners' mistakes.

Without information in profile, original message or other threads it's hard to guess where you're from. With exception for Canada / EU, most visitors require visa so I made an assumption.

Overstay is an overstay, as @SalishSea says. Overstay AND lack of ties is pretty hard to overcome but you can try.

4 months in between visits is way too short also, even if overstay and lack of ties wasn't a factor. I give it 95% chance of denial if you try coming now.

They're not going to issue you a visa with such a clear intention of not returning to your home country.

He is probably referring to a visa common in parts of Europe and former colonies also referred to as a "gap year" visa. The US has no equivalent.

The length of the program does not control when a student visa is required.  A course that Iasts only a few weeks can require a student visa. It all depends on the couse structure and the outcome upon successful completion of it.  More importantly, I'm sure your school has clear procedures/requirements for foreign student admittance-- if it has I-120 issuing authority granted by DHS, which it must if it has foreign students.  Those procedures should be clearly communicated to him and followed, regardless of what he or anyone else tells you or asks you to do.

milimelo reacted to yuna628 in DOJ Probing Covid Test Fraud Including Kits Sent to Dead People
There's a couple reasons why I'm sharing this story. You see, I've been down the rabbit hole these past few weeks, when a relative received a mysterious package they didn't order in the mail. Inside were very expired, very tampered looking COVID test kits. I was very alarmed, so me and a few tech buddies got together and did some digging as to just who these scumbags were. Turns out the feds have been working cases like this for a while now.

It's not always immediately noticeable to an individual that has Medicare if they have been/their plan has been charged for fraudulent devices. I immediately set to work tracing back months of Medicare billing to see if I could find the fraudulent charges. Not so, because a lot of EOBs and lists of charges are usually running several months behind. A call over to the OIG and federal Medicare fraud investigators, and they could see the charges from back in May, the exact timeframe when many of these packages started showing up over the US. They immediately flagged and created a case file, and unfortunately my relative's info has been compromised (the government is still investigating where and cannot comment yet) and they will have to issue them new cards/numbers. If you have any elderly relatives, or are a recipient of Medicare yourself be on the lookout for any unusual charges and or packages coming to your house. There are extensive news articles online addressing these instances from different states. I must stress in some cases many of these scams are using phishing or phone calls into tricking individuals into giving them their info - but this is a somewhat new tactic, the recipient of the fraudulent goods is unaware of anything coming to their home and never requested it.

That's pretty much all you need. You can also bring a copy of baby's birth certificate if you need any extra evidence of relationship.

Nothing for the joint sponsor as baby is not added to their household size.

Find a deferred inspection site of CBP and go there. https://www.cbp.gov/contact/ports/deferred-inspection-sites

Nothing to worry about, your stamped visa is good for one year as a temporary green card. Did you pay USCIS for issuance of your green card?

I imagine you'd also have to do FBAR every year.

May want to consult with one of big 4 tax firms - they have international tax reporting clients and should be able to guide you better than a HR Block person or even a CPA who only do simple or limited complexity taxes (federal, state taxes). Better to do it now than in the thick of tax season.

Yes, if they have the same GC approval date (this was K1 visa so AOS filing and then interview with USCIS), they're fine.

You'll likely have to petition children via individual I-130s (just like your husband) and then once they come on immigrant visas they'll become USC. Husband will get the LPR status.

What Family (who is one of the kinder VJ members, in fact) is saying is that the consulate will not spoon-feed you the requirements to overcome this inadmissibility.   Why?  Well, because honestly that is not their job.

If he really does want to immigrate to the U.S., it is  100% your husband’s responsibility to figure out his next step by contacting the clinic where he had the medical exam.

Neither the clinic nor the United States consulate will be proactive about it- it’s entirely up to the applicant.

I'm sure it’s frustrating for you to be trying to do this on his behalf, but really he needs to step up and take an active role in this, since it is entirely down to his choices.

You need to try and understand what I have now repeated over and over . ..IF you want to bring him here.

He HAS to establish and schedule his REQUIRED 4 drug tests ..every 3 months . The testing MUUST be done through the SAME panel physician. ..or one of their partner labs .

I know you tried calling them
..but you can’t stop trying .  Contact your congressman and have them reach out to CDC  or licensing authority .

Your finance CAN also go there in person and get his drug tests scheduled BY or THROUGH them as well as get a COPY of his 2 failed medical exams.

These are the things that CAN be done and if you give up …then you will waste another year …

I don’t think I am getting through to you but am puzzled as to why not .. someone please try and simplify this for OP :
    1. INSIST and do what it takes to communicate w medical clinic

    2. Make sure he tests ( ONLY where clinic tells him ) every 3 months

"Looks like we are to do nothing....."?  Seriously?  Looks like you and your fiance have a great deal of work to do for the next year.  If I were him, I would immediately start an accredited drug rehab program with periodic drug counseling & certified testing over the next entire year.   You are going to need a lot of strong documentation.  Otherwise, he might not get another chance.
Good luck.  I hope he can overcome this.

Depending how old you are, you might have luck calling the Health Unit to see if they have your childhood records. They would have them from when you were in school.

I wouldn't just go get revaccinated. Over vaccination is a real thing. Get the titers test.
