Nouchigang got a reaction from A&H2018 in AOS from I visa -- do I need to file I-765?
    Hello,

It is not a requirement to file I-765 since you are already working on another visa, but it is free while your AOS is pending and once you receive it, it gives you the option to change jobs if needed, so if I were in your shoes I would apply for it just in case, you never know what life may throw at you.
But be aware that it might take a long time (around 5-6 months, maybe more it depends) to get it because you are under a valid visa and already working, so those usually are at the bottom of the pile.

    Good luck

It can take weeks or months for them to schedule the interview after that message, so be ready for a long wait

Thanks! I didn't even consider that it would mean I could change jobs before the AOS... duh. Definitely the best option, then. Thank you so much for the explanation.

I general, it is NOT allowed for them to discriminate on that basis. However, there are certain exceptions for certain types of work or employers...I'm not sure if this applies to certain positions in the financial industry, sorry.

    https://www.uscis.gov/i-9-central/employee-rights-resources/preventing-discrimination
"The Immigration and Nationality Act prohibits employers from discriminating against individuals based on their citizenship or immigration status, or based on their national origin, in the Form I-9, Employment Eligibility Verification, process. "

I am sorry to hear that but at the same time I sort of understand them. While I was interviewing for my current job, the HR asked if I was allowed to work in US and I said yes. Went through the all interview process, got approved and she asked me to send all the paper work. Sent my EAD card and mins later she get back to me asking, do you have a green card, I said not yet. My GC interview is in a week and I should have it by the end of the month, so what you have in your hands is an temporary work permit valid for 1 year and I should be able to handle you my GC in a month max. She was fine with it and less than two weeks later I gave them my GC.

Like Roel said, it is up to each company discretion, cant really say whether this is illegal or not, perhaps the company just doesnt want to have to deal with someone whos having to quit the company 1 year later because of a denied GC...complicated case.

Considering MS business I could see why they would only hire USC or PR......again, dont know exactly why, but being a bank etc could have impacted with that.

Yay my background check went through now that my SSN is corrected. The company I interviewed with called me today to formally offer me a position with their company. I start 3 months of training July 30th.  Its an inbound call centre job. My husband works there and loves it.  I start at 15.75 per hour.

Yeah send it out. Don’t wait. At this point you’re probably better off checking the box on the AOS form to authorize USCIS to get a SSN for you. You can always check back with the SS office for your card. Maybe get your congressman involved and have their office check for you.

On another note, to the people who mentioned it, there is no requirement for a SSN for a foreign resident to get married in any state. Whoever gave you that information is completely wrong.

Definitely send it to remain in legal status.

What happens is when your I-94 is about to expire, they won't issue a SSN anymore. Your SSN might still be in verification, who knows. Send the AOS application, wait on the SSN but don't expect it to be handed out anymore and when your work permit arrives, go back and request your SSN again.

So I  checked the old USIS website and it shows my interview was sheduled on July 2nd ( I’m San Diego office) for those of you who have gotten letters of interview schedule, how long did it take between the message and the notice and how far apart was the interview scheduled, like how much time in advanced?
This is amazing news! But I had a trip planned in August, I did not expect my interview this soon, I’m afraid I’m gonna have to cancel it and sit still for the notice!

    Hello Guys,

So I had my interview yesterday at the USCIS office in Baltimore MD, the appointment was scheduled at 8:30 am. We live about an hour away from Baltimore so just to be safe, because you never know with traffic, we left early and arrived at 7:30 AM. We went to Mcdonalds to eat and kill time and went in and checked in around 8:15 AM.
You have to go thru security like in the airport, but no need to take off your shoes.
The waiting room was pretty full, they do all type of interviews, oath ceremonies etc. After an hour waiting we were called around 9:30AM by a gentleman, he walked us to his office and introduced himself.
He checked our IDs and my fingerprint to verify our identities; then sworn us in. He asked if we had any other documents we wanted to add to the application, so I gave him the list below:
W2 for my husband for 2017 My husband last 2 paystubs our joint 2017 tax return my offer letter and first paycheck since I started working 3 weeks ago Joint apartment lease Car insurance with both our names Renters insurance with both our names Proof that I am on his health and dental Insurance plan copy of my military ID last 2 statements of our joint checking and savings account Copy of our joint Cell Phone plan about 20 pictures from the photo album we brought with various pictures with family, our wedding, honeymoon etc My medical exam After that, he told us the conversation will be recorded and kept our IDs until the end.

He first started talking with my husband and went over the petition (I adjusted from B2), he verified all the info on it, asked for my full name, DOB, my parents' name, if he knew where I worked and lived before living together, how we met, why he chose to be with me and get married to me, if he met my parents, who attended our wedding etc.
It wasn't like an interrogation, he was politely asking questions and verifying along the way, so we felt comfortable and not stressed.
He told us he was satisfied with our relationship and would recommend the petition for approval.

Then, it was my turn and we went over the AOS package, he asked for my husband's full name, DOB,  his parent's name, if I have met his parents and went over all the information written on it and also the Yes/No questions at the end that he tried to condense a bit. I also told him that I was changing to my married name, he made a note on the application and saw that I changed my name on my Drivers license.

After this part, we went over pictures, he even smiled while looking at a few ones, so we were happy about that.

The interview was over at this point and he asked if we had any questions, I told him I would like for my green card to have my married name. He assured me it will be the case.
Finally, he gave us like a receipt that says we completed the interview and the case was being held for review. He reassured us that it was nothing bad but just their procedure. I read on the Baltimore thread that it is just how they are at this particular office, they never tell you if you are approved on the spot and always give you that paper.
He told us to look out for the mail, for either the approval letter or if they require additional document they will be in touch. The whole interview took about 45 min.
We left happy and relieved this was done and went for brunch lol.
I hope we get the green card soon and we can close that chapter for a few years, praying for EADs and interviews for all that are still waiting. And THANK YOU so so much for the valuable information shared, and words of support and encouragement. I will still be around to help to the best of my knowledge.

    God bless

Sorry for the long wait, on top of doing the service request like somebody else already mentioned and contacting the Senator, try to schedule an Infopass appointment at your local field office to let them know your EAD is outside of normal processing times and you really need to start working asap.
    Here is the link: https://my.uscis.gov/appointment
if you cant find anything available during the day try around 12AM-1AM, that is when they open the slots for the next 2 weeks.
