J&E2013 got a reaction from defeedme in Born in the Philippines but now a US citizen
Hi guys, I just have a question but I don’t know if it’s the right forum to ask this. Btw I’m from the Philippines and came into the US thru fiance visa in 2013 and became a US citizen in 2019. My question is since now I’m a US citizen does it mean I’m not a Filipino citizen anymore? I know it sounds stupid to ask this question but it bothers me coz I don’t know if I’m still filipino citizen. Thanks, hope someone can enlighten me..

Thanks guys for all the information and to all of you who replied to my question. I really appreciate it, I know some of us that live far from the embassy have to book a flight just to go to the Philippine embassy. It’s a hassle especially if your working, I just wish you can just do it by mail. But anyway, thanks again to everyone and God Bless us all..

They may not have a dedicated team of investigators out to 'catch" people naturalizing and it may not be that difficult to evade Philippine law on the issue.  But the law is the law and when they make it so easy to do it the right way, there is really not much incentive to risk it.  I could imagine it might come up in a variety of circumstances in the Philippines, such as if you claim exemption from travel tax leaving the Philippines or want to stay more than a month without extending a visa.  There is a good chance if you have kids in the US they might want to claim Filipino Citizenship.  If it's $50 and a visit to the consulate to fully comply with Filipino citizenship law, it is wise to do, whether you might "get caught" otherwise or not.

If you are in PA as your profile states you would file to re-acquire Filipino Citizenship through the Philippine Consulate in New York City.  Costs $50.  Well worth the effort.   https://newyorkpcg.org/pcgny/consular-services/dual-citizenship-ra-9225/

You should also apply for a new Philippine Passport after you re-acquire Filipino Citizenship.  Any previous Philippine Passport is invalidated when you naturalized to the US.

A few year ago the Philippines Government started allowing people like you to re acquire you citizenship, I highly recommend you do this.

You will get screwed in the Philippines if you are a US Citizen and you want to stay past 30 days, dealing with BI and payments. Just recently Philippine was only allowing PI citizens to enter the Philippines for a couple of years.

*** Moved from US Citizenship General Discussion to the Philippine regional sub-forum -- question is about PH citizenship ***

You lost your Philippine citizenship when you took the US oath.  But you can easily re-acquire your PH citizenship by applying through the nearest PH consulate.  After that, you will become a dual PH-US citizen.

J&E2013 got a reaction from SalishSea in Brother is on working visa
Hi guys, I don’t know if I post on the right page but I just wanna ask some help or info. I have a brother, from the Philippines and he was on a working visa here in the US as a bartender in a cruise ship. I know it takes 20-30 years to petition your siblings but is there anyway I can petition him to live here permanently? Since he was in the US already? Thanks

During pandemic, there was accelerating  movement in some immigration categories: priority and final action dates were moving forward several months per  month.

You never know what might change with immigration law or back logs.  Paying the filing fee for an I-130 is a speculative investment.  It would be a shame for example if 30 years reduced to 10 years but only for people with petitions dated after implementation of a new policy

If an F-1 applicant says in the interview he intends to get a green card the CO is expected to deny the visa.  For example:

    https://www.quora.com/Is-it-possible-to-be-accepted-by-Harvard-but-have-your-visa-rejected

“I once refused an F-1 visa for a student who had won admission to Harvard, because I knew for a pure fact that he had no intention of returning to India and was already planning for his future life in the US. But the F-1 is a non-immigrant visa so, sorry but no.”

“go study in college on F1 --- get work - get h1b - get green card”

A green card is granted to immigrants.  That’s immigration intent. More from my link:

”Hi Kathryn, I am genuinely curious about your answer. I am not here to abuse you, because I know you did what you think was right. But can you explain it to me that why a person with ‘legal’ immigration intent is denied visa according to the law? F1 is an education visa, why would laws deny a person to graduate and move to H1?”

    Reply:

”I agree that the regs seems contradictory. Luckily, I did not write them so don’t have to try to make them more compatible/rational”

    —-

I will add that that my recollection is the CO knew there was immigration intent because prior to the interview she was at a social event where the applicant’s father  was bragging about his son’s Harvard scholarship and that his son intended to immigrate to the USA.  It appears that info has since been edited out and I’ve no way to proof my recollection.

millions of people go to study - work and than get green card. lol nothing wrong with it. his brother having a immigrant petition has no effect on him coming to study - work and get green card

    Crewmember is a C-1/D visa
The transit visa portion is the “C-1” part of the nomenclature, and the “D” part is the crewmember visa.

Crewmember (D) visas are nonimmigrant visas for persons working on board commercial sea vessels or international airlines in the United States, providing services required for normal operation and intending to depart the United States on the same vessel or any other vessel within 29 days.”

he can find a job by himself that sponsors him work visa like H1b or L1. once you are here on H1b or L1 he can get his employer to sponsor him for green card. it is shorter by about 10-12 years

You should file I-130 for your brother.  Take it from an old man like me: 30 years passes fast.

Even if your brother had an immigrant visa category that would normally allow him to adjust status, as a crew member he would not be able to do so. Check out  Section A in the "Other Barred Adjustment Applicants" in the USCIS Policy Manual at https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-7.

I know, and it’s sad coz I never seen my dad since I left my country (Philippines) October 2013. Coz I was planning to visit them after I become a citizen which is September 2019 and then the covid started 2020 until I didn’t have a chance to see them. I was planning too to petition both of them one day but sadly my dad passed away. It’s so unfair, and it’s so hard to accept about what’s happening. Especially if you have no other family here in the US except your husband. I miss him so much 😔 and I blame myself for waiting too long before I plan to visit them and now his gone 😢 and I don’t think this pandemic will end anytime soon

I’m not sure, but does being on that field of work have the chance of getting denied? Especially if the application is married based?
