March 2021 LIN filer.  We finally received our ROC approval after 18 months of waiting.

My husband's N400 interview was scheduled for Sep 6, 2022, but the interview was cancelled, due to the A-file not having arrived at the local office in time for the interview.  We were informed that when they re-scheduled the N400 interview, we would have a combo interview at that time.  The N400 interview was then re-scheduled for Oct 21, 2022.

We received the ROC approval out of the blue on Sep 21, 2022.  Not sure if the impending N400 interview instigated the approval of the ROC, or if it was just a happy coincidence, but we'll take it!

LIN Filer here on AOS in July 2021.
No word still about our I-751.
But last July 2022 we qualified to apply for naturalization and promptly filed an N-400 with local office at Seattle, WA.
Today roughly 61 days since lodging the N-400 online, we received in postal mail of N-400 interview scheduled on November 2022.
So if you are eligible for N-400 and your I-751 is still stuck, go for the N-400.

Any recommendations from the thread to prepare for potentially a dual interview for I-751 and N-400 will be gratefully appreciated.

    Cheers,

Best chance for asap is for him to go to her country.   The process to immigrate to the US is not fast, and it’s made longer by your deportation.

Yes.  Again, please read the Guides, THEN return with any unanswered questions.

Nothing we're saying is in contradiction. His chart is showing you the average time from I-129F submission to K-1 interview. My "baseline" was in reference to the time it takes the I-129F to be adjudicated alone, which according to USCIS (and verified by many members here, if you look through the Progress threads) is 13.5 months. So, to recap: CrazyCat's chart says 520 days from start to finish, I posit roughly 400 from start to USCIS approval.

Following USCIS approval, your petition will spend roughly 2 months at NVC (60 days) before being forwarded to the Embassy, which may-or-may-not have a significant backlog. Already we're at 460 days; 2 more months (60 days) doesn't sound unreasonable at all, particularly for certain Embassies (like Warsaw) which was already booking January appointments back in June.

If I could give any advice, it would be to definitely spend some time looking through the forums here to get a feel of the time you're looking at overall; we're all here to help and give honest updates. For myself, I went into the process thinking it would take only 9-12 months because that's what I read on an outdated, random, pre-COVID website. When I actually got on VisaJourney and saw the charts, I refused to believe them at first, but lo and behold they were far more accurate than anything else.

You can't rush the process unless you have a valid expedite, so as others have said, focus on sending good, quality evidence that will make the Adjudicator's job easy when it's your turn.

There is no correlation between the amount of evidence you submit and the I-129F's processing speed. Arguably, a mountain of evidence could even slow the adjudicator down - especially if lots appear redundant/frivolous.

Quality evidence is what prevents a Request for Evidence (RFE) that tacks an extra two months onto the process. But there is no way to speed up adjudication from the baseline 13.5 months without an expedite.

Edit: And I also agree with @powerpuff (who helped me with my first K1 questions way-back-when) that call/text logs are among the weakest evidence.

I751 just approved on 9/7 with no RFE and no interview (Filed 3/1/21). Received notification of n400 interview a few weeks ago which is scheduled for late Sept.

It is normal in most states for the driver's license to expire when the greencard expires, if it is less than the usual validity period. For instance, my husband's first driver's license was valid for 2 years, and then he renewed with the extension letter to get another 2 years. So the DMV fixing his license to reflect that strikes me as normal if they didn't issue it correctly to begin with (assuming that's what "limited" means).

HOWEVER, as others have said, DMV workers are notorious for not understanding nuance to less common situations, such as conditional residency. I agree with others that you need to try a different office and/or ask for a supervisor (but I recommend a different office, personally).

Unrelated to your situation but a perfect example of a DMV worker asking for something that is not required:

Back in 2013, I divorced my first husband and moved states so had to obtain a new license. Went to the DMV and first time they said I was missing a document to prove my address, even though what I had was sufficient according to the DMV website. Even though I'd waited over an hour, I didn't fight it and went back again with the correct document, and was told (after waiting almost TWO hours) that I had to have my divorce decree. They didn't say that the first time, and I didn't have it with me because absolutely nowhere I looked did it say I needed a divorce decree. I went back and forth with this worker and a supervisor and they both insisted I needed it but never explained why. After that experience, I went to a different office that was a little further away and was in and out with a new license within 30 minutes - no divorce decree required.

Turns out, you need the divorce decree if you changed your name, which I never did! Not once did that first office mention that it was needed due to name changes, nor did they even ask me if I'd ever changed my name.

Very likely your spouse will get a different response from a different DMV worker.

Ask for a supervisor.  Permanent residents have the same rights, whether they have 2-year or 10-year GC.  If the DMV supervisor is also clueless, go to a different DMV office.  If that doesn't work, contact your congressperson or senator to ask for assistance.

He's already a legal permanent resident so what's the issue again?
If he's conditional residency card has expired, he can use that plus his extension letter to prove his LPR status.

Catseal reacted to bakphx1 in Passport applications taken at oath ceremony
This isn’t a question as much as a possible tip.  In Phoenix, at the oath ceremony, they have passport staff present to take completed applications.  We had an appointment at an office 45 minutes away the same afternoon, so we hightailed it to the nearest CVS to get pictures and money orders.  We had a completed application at home but filled out a new one there.

If you’re interested in getting a passport ASAP, find out if your city has the same.  Since Covid, no acceptance facility accepts walk-ins and appointments can be a month out.  The person also said they hand carry them to processing which saves 10 days of total turnaround.  If you go with the completed form, pics and money orders, you can spend five minutes and be done. The downside being you leave your certificate with them.

I have news for him:  Immigration should be high on the priority list.  If you have a 2 year green card, planning will make the Removal of Conditions process smoother.  Then, there is the process for naturalization to plan for.  It's a long journey.

If you have a SSN, you can get a phone line.  If you have a SSN and a immigrant visa in your passport, you can get a bank account.  I suggest your spouse get off his rear end and do his share as a spouse and help you!!!!!!!

Husband can call in to one of his credit cards , add you as authorized user and you get instant credit existence. Within a couple of months you will get credit offers in your name only.

Pre paid T-Mobile is an excellent choice to have your own line .

Good luck with job search, you will have no problem with your I-551 stamp as proof of LPR existence.

I filed in Seattle and am still waiting for an interview, but I moved states since,  hence it is not my local office anymore at this point - either way, I have never heard that, where did you read that? I can't imagine why it would, I always thought if anything filing for N400 leads potentially sooner to an approval/ combo interview since they do work on the N400 more, at least that was my impression from visajourney. I hope very much this is not true.

Legally, you are fine. There is no way that he has any power over your immigration status at this point.

The timing of the breakup (very shortly after entering the US) is a little unfortunate. But only that.

Still wanting to move to the US, even though you are not with your spouse anymore, is a little bit of a mystery to me. I know you explained why you still want to move, but in essence the ‘reason’ you wanted to move to the US is now not applicable anymore. I visited my husband many times during the process, and also met people, but I don’t think I would continue moving to the US if our marriage was over, because the reason for the move would no longer apply.

Why waste any more time on her? She already wasted several years of your life, don't volunteer to give her more of your time by trying to do some revenge thing. If you somehow could get her deported, would it really change anything? Cut your losses, cut contact with her and move on with your life ASAP.
