No need to send any pictures to the NVC - make sure your spouse has them at their interview.

You need to send your divorce decree along with you and your brother's financial info and the affidavit of support.

Here is the info from NVC's website regarding the divorce papers:

If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.
Send a photocopy of the petitioner’s marriage termination document(s) to NVC. Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

Hi! Even if you got a case complete by the end of this month, your interview would be scheduled for January. But since you've been only waiting for 4 weeks and it's currently taking around 7-8 weeks for a CC, a more realistic timeline would be: CC in December, interview scheduled at the beginning of January for February.
    Good luck!

No, you wouldn't have to start over. Your marriage certificate is proof of the name change. I changed my name during the NVC stage and everything I had sent in so far was in my maiden name but I had a new passport with my married name for the interview and it wasn't an issue.

Change it now if you can, if you change it after the GC is issued you will have to pay a fee for a new GC with your new name.

I’m thinking you’re not aware of the typical timeline/progress of spousal visas. And as said spouses usually want to, um, be together.

As a beneficiary of an adult child petition before I won DV, I can also tell you there is plenty of time to wrap things up and not have unfinished business. Even longer for siblings. This is why DV, which is the only really “rushed” visa, is usually the only one that people leave again to finish things up. Regardless, it’s clearly logical for a CBP official to be suspicious of a spouse who spends month on ends away from the other spouse just when they are finally able to be together after all the waiting for the visa.

Senator Nelson, D-FL, responded to my letter and said he is looking into my questions. What I asked him to look into:
Why is Nebraska so far behind Why is Nebraska not being held accountable What is Nebraska doing to clear the backlog Why H1-B VISAs have a premium processing option and spouses do not. Why work and student visas have a defined processing timeline and spouses do not. Why USCIS has systematically made the K-3 VISA obsolete, a VISA congress enacted to avoid the situation us Nebraska folks are in. Propose legislation to give U.S. Citizens an expedited process, same has H1-Bs. Hopefully he'll come back with some sort of answers. I doubt it, but you never know.

As someone who has used a lawyer I suggest NOT using one if your case is clear cut. Save your $$$s for a nice vacation with your spouse or whatever else you desire. If you have any questions regarding the process ask away, folks on VJ are always helpful and willing to answer your questions

Assigned overseas? Is your husband military or works for the government?

If your husband is military give this a read. It explains everything about physical presence requirements for military spouses.
    https://www.uscis.gov/policymanual/Print/PolicyManual-Volume12-PartI.html
Basically says that if you have permission to be stationed with your husband, that time spent abroad also counts as time spent in the US.

No, you do not need to show proof of your return flight.

You can stay until December if you wish to, just keep in mind that when you apply for Removal of Conditions/Citizenship you must prove that you haven't been out of the country for more than 6 months/trip.

You do not need to pay anything at the embassy. Once your visa is approved and you have it in hand, you can pay the Immigrant Fee (Green card fee which is $220). You can pay it either before or after you enter the US, but USCIS encourages immigrants to pay it before.

Call them again and request to speak with a supervisor and if you're lucky enough to get a rep who's willing to pass on the message, leave them your phone number (US phone number) and a supervisor will call you back.

Nope they were in AP at the NVC, before getting an interview date. Her case was at the NVC from Feb 2017 until July.

Your case is different because you requested supervisor review after challenging a checklist.

Did you resend that letter using a cover sheet? You might want to call the NVC again and ask if they've received it or not because every time you send it new documents it counts as a new scan date.

Hi there! I'm so sorry your case went into additional processing. May I ask what date did the NVC receive all of your documents? Did you receive any checklists?

I have heard of a case before, a user on Visa Journey whose case went into administrative processing. I'm not sure exactly why, though.

It depends, there isn't a set timeframe for reviewing. For me, it took 8 days. It can take anywhere from a couple of days to a couple of weeks.

Check your visa status on CEAC - when it says "At NVC" you most likely have a CC.

    Good luck!
