@Sandra, You said he lost the chance but he can file Vawa. I don't understand.
He lost the change to file I-360 category widower but he still has the chance to file I-360 category VAWA.
I-360 has many categories. It would have been a much shorter and easier process for him to file as a widower. But he would have had to file within 2 years of the spouses death. If she died on 02 October 2016, he would have had to file by 02 October 2018, which was 2 days ago. This was a mistake on his part.

I need help. I Recently got a job offer to resume on the 8Th of October however I havent received my EAD which I renewed about 3 months ago. Please what can I do as I don't want to lose this job.
You can send the job offer along with a letter asking to expedite the EAD to Vermont. There is no guarantee that they will expedite it but you can try. Current processing times are 3-5 months, so you are withing regular processing times.
Do not start the job without having your EAD!

Hi Tortmaster..i want to know why same date filers get approved at different times..for example I'm a march 2017 filer still waiting..while some may jun are approved and some march too...i thought all vawa petition were processed in same location which is the VSC? Or does our address/state have anything to do with it? I wanna know how this works pls...anyone everyone pls feel free to put me at ease😘😘😘😊😊😊😊 thank you all
It is because every immigration officer works at a different speed and has different cases of different difficulties in front of them.
One officer could be working on 5 cases that are all easy approvals and one officer could be working on 5 cases that all need an RFE carefully typed up and take longer to go through. Also every VAWA case has a different amount of pages and evidence submitted, so that all plays into it too.

Hi Everyone!!
I need some advice @sandranj
My vawa was approved on Sept 9th 2018. On August 2nd I had sent a letter to change my address form AR11 signed by me. The letter was delivered but I never received a conformation. What should I do? I want to make sure USCIS has updated my address in both I-360 and I-485. The other thing is I want to remove my lawyer for the I-360 he has been so unprofessional and my vawa got approved because god is good. He has no idea about vawa process. I don't know how that would work since I-360 has been approved already. What can I do?
Thank you!!
USCIS does not send a confirmation for an address change. You can find out if they changed your address by making an Infopass appointment at your local office.
You can send a certified letter to your attorney letting him know you are ending his representation and then also send this to USCIS.

Hello everyone,
I appreciate in advance if someone can get me out of the following doubt:
When an RFE response is sent to USCIS, does USCIS send a document via physical mail notifying that USCIS received the response to the RFE or simply USCIS updates on the Web system claiming that it received the RFE response without sending a physical notification?
Thanks in advance for your comments! You will not get a physical notice in the mail when your response to an RFE is received. Sometimes USCIS updates the online account but not always.

How did USCIS know the person got married? Just curious ...
Did they disclose this after filing or through a background check or something?
Marriage/Divorce are public records, so they are easily accessible.
Also you have to swear to tell the truth under oath, so if someone lies about marriage status during the interview, it will come out and then the GC will be taken away because it was not obtained rightfully. The person will then be placed in removal proceedings.

Hello Everyone, I need Help Pls:
{1} I sent i-360, i-485, i-765 and USCIS received on 08/15/2018, 09/01/2018 and 09/24/2018.
On September 24, 2018. I received an RFE of Good Moral Character for i-360, in that letter USCIS did not specify the maximum date to respond to said RFE.
{2} I received my biometrics appointment for AOS not for Work Authorization { 10/05/2018 }.
{3} When I sent my VAWA PETITION, I have sent Police Clearance, My Former Boss in Ghana wrote Good Moral Character Letter and Family friend here in US wrote Good Moral Character Letter.
MY QUESTIONS: {A} Can I do another Police Clearance. Can I send My Former Boss Good Moral Character Letter and Family friend Good Moral Character Letter ?
{B} Can USCIS use the biometrics for Work Authorization or I will do another later ? Thanks in Advance
A. You need to submit police clearance otherwise your case will get denied.
You need police clearance from all US states and all countries you have lived in for 6 months or more 3 years prior to filing I-360.
Since you filed I-360 on 8/15/2018, you need police clearance from all places starting 8/15/2015.
B. You only do biometrics once. They will use them for your EAD. Biometrics at USCIS are good for 15 months. If you renew your EAD after it has been 15 months, they will have you redo them, but if you are within the 15 months when you apply for EAD renewal, they will most likely use your first biometrics.

I'm not a Vawa applicant, just send Form I-90 correcting an error on my residency card.
What can I do if I send my original card to USCIS and they now say that I sent them a copy of that card? Please look for the correct part of the forum then. This thread is only for VAWA applicants/questions around VAWA.

Good evening i want to ### anyone that has made an inquiry about why your case is taking longer than the normal processing time and got a referral number?? How do you check that number or what can i do to see what is happening i recently made an info pass but when i got there the USCIS agent was very rude and basically told me we are busy and i have to wait and didn't want to check or see what is happening. Can someone please advise or help me i have filed my I-360 in late 2015 and im still pending? I wanna say thank you to anyone that can help me in advance. ❤️❤️❤️
You can make an account here to check your status, but USCIS is not very good at online updates, just know that.
You will need your receipt notice to see your case number. Each form has a different case number. Did you only file I-360 or also I-485, I-765 and I-131?
https://egov.uscis.gov/casestatus/
USCIS is currently adjudicating cases from May/June 2017, so something definitely went wrong with yours.
1. Check I-360, VSC, there will be a link for being out of processing times. Enter your information there.
https://egov.uscis.gov/processing-times/
2. Write a letter to the VAWA Unit at VSC to inquire about your case. Include a copy of your receipt notice.
3. Contact your congressman to inquire on your behalf. You can Google who your responsible congressman is and they typically have a contact form on their website for any government agency inquiries.
4. Contact the USCIS ombudsman.

Hey I’m in vawa case since January 2018
im outside of Usa bc before I start with this cases I travel with my advance parole to my country and my wife stop our process then in the airport the officer don’t let me in and Deportation from US back to my country now I waiting to my vawa approval
my question is I need to get divorce from my wife and I don’t have any way to contact with her she didn’t answer to her phone she disappeared
can I back to Usa with vawa recipe in the immigration in the airport them let me in to finish my process and to get divorce bc for divorce one of us me or my wife need to be personal in the state to get divorce and my wife is not an a option???
please help!
If you have been denied entry into the US, you will need a waiver in order to qualify for immigration.
You will have to wait for your I-360 to be approved until you can do anything else.
You cannot file I-485/Adjustment of Status because you are not in the US, so you have no base to adjust status from.
I highly suggest getting an immigration attorney for your case.
You should be able to file for divorce from your wife in your home country (or wherever you live right now). It will take longer but it is possible. You should consult with your local court. If you are not in contact with your wife, you will most likely need to prove that you don’t know her whereabouts and that you have tried everything in your power to find her. But again, every country has different laws, so it is best to consult with your local family law court.

Hello Sandra hw are you? Now I m very stress, I sent my I360 June 2017 I m still waiting.now what about the i486 they gonna denied it if I send it now?
You sent your I-360 in June 2017, the new rule only applies to forms filed after September 11th, 2018.
Just make sure you submit all the documents needed when filing I-485 and you will not have a problem. The new memorandum simply states that they are not obliged to ask for additional evidence anymore. But if you send everything they need, then they will not need to ask for additional evidence.

Hi @iwillsurvive! So my lawyer told me that she already received the receipt notices and she didn’t even inform me until I asked her about it this morning. My receipt notice says that the received date is September 11 and the notice date is Septmeber 20. Does that mean the new policy memo will affect my case?
The policy went into effect on 9/11, so since your receipt date is 9/11, the policy will apply to you. But that just means that they now have the right not to ask for an RFE but they still can if they want to.

Good morning, i just received a phone call from my lawyer and he is telling me that he called to find out more info about my vawa and they told him that they are looking for divorce decree, we are not divorced and the lawyer is telling me that i should start the process to get divorced, will this in someway affect my vawa !?
Thanks
Your lawyer is lying. Nobody can simply call about VAWA cases. Information is not given out over the phone to anyone because USCIS has no way to prove that the person on the phone is really the petitioner or the petitioner’s lawyer. For all they know it could be the abuser calling. They will only give information in person during an InfoPass appointment or via mail to the mailing address you provided.
You do not need to be divorced to get approved for VAWA. You should file for divorce before I-485 because USCIS might question that you are really leaving your abuser.

Please @sandranj and @iwillsurvive I need ur help urgently I just received my biometrics appointment and my country’s passport expired and I don’t have any other identification since I don’t have any other means to go get a new one will they accept my expired passport?thankss
You can most likely get an expedited passport. Just call your consulate and see what they can do.
Do you have any other valid ID’s from your home country? Driver’s license, ID card, etc?

I was reading about a new regulation of verification of credit history and credit score for those applying for the Green Card. Based on what I read, USCIS will consider your financial status before delivering the Green Card.
I understand that the new "Public Load" rules will not affect Vawa applicants so I would like to know if Vawa applicants are exempt from this new regulation or if, on the contrary, this measure would affect the petitioners of the I- 485 through Vawa (I-360).
On the other hand, I was thinking about checking my credit history at CreditKarma, but given our immigration status I would like to know if doing so would not bring any negative consequences, so I thank you in advance for your opinion before doing so.
Thanks for your comments!!USCIS will not check your credit score. Where did you read this? On an official .gov website?
It is normal for immigrants who have not been here for long to have no credit history/score at all, so that wouldn’t make any sense.
But yes, you can go to Credit Karma or other websites to check your score. These are privately owned websites that have nothing to do with the government. You seem very scared, you don’t need to be at all. You have a pending immigration petition, so you are allowed to be here.

Hi everyone! Hi @sandranj! I'm a new member. I have been reading previous threads and discussions here and it was a big help for me understanding VAWA (although I have my lawyer also). My VAWA application was sent on September 7, 2018 without my psychological evaluation and my certificate of good conduct because we were in a hurry to make it before the the new policy memorandum took effect. I have already worked on those two missing documents and they'll be ready in a week. Now, my concern is, it's been two weeks andI haven't received any receipt notices. Do you think they got it before September 11 or am I just waiting for a denial letter? Any response would be appreciated. Thank you!
It typically takes 4-6 weeks to receive the receipt notice. You can however follow the post office’s tracking number you received when you sent the forms to see when they received it. That will be your receipt date.

So what’s the correct information?that as a Vawa green card holder you can’t married until after you become citizens?so you will have to wait until three years later??thats not fair
You can get married whenever you want to after I-360 approval. It will not have any effects on citizenship. You can file for citizenship after 3 years (instead of 5).

You can still married but you will have to wait for five years instead of three!
This is incorrect. @Damara discussed this probably 30 pages back or so in this forum. The official USCIS memorandums do not state this.

Hey guys,
This week has been exactly 12 months since I filed VAWA... I already had a pending i-485 from ex USC husband and did as @sandranj adviced to find out if AOS was still pending or denied through infopass.
How long do they usually take to request RFEs?
Wishing you strength to you all!
VAWA processing times can be found here:
https://egov.uscis.gov/processing-times/
It currently takes 16.5-20.5 months for them to open your case file and adjudicate it, meaning they will either approve or ask for an RFE if they believe there is not enough evidence.
Considering that you filed 12 months ago, you will have to wait another 4.5 months at least before you hear anything.

Oh wow I didn’t know that I can’t marry before I get the citizenship, I guess we just need to wait!:)
This is incorrect information. We discussed this earlier in this thread. You can marry and still apply 90 days before the 3 year mark of you having had your GC. The only condition is that you got your GC through an approved VAWA petition and that your ex spouse was a US citizen.
VAWA, Part 11
in Effects of Major Family Changes on Immigration Benefits

You cannot change your address via InfoPass as a VAWA filer. You have to do it by mail. But what you should do after changing it by mail is make an InfoPass appointment and ask the officer what address he sees in the system for your case number. If he sees the new address, then everything is fine. He will not know anything about change of address though, he can only see the address associated with you in the system at that point in time. You need to then see if it’s the old one or the new one.
