It honestly depends. I-485 is first transferred to the National Benefits Center. Some people get an online update for case transfer for this. Yours seems to be one. Sandra always says they typically take 30-45 days to work on it before transferring it to the local office. It can take longer though. USCIS is messy when it comes to online updates, so not everyone gets an update when the case gets transferred from NBC to the local office. I’ve never gotten that update but I got an update that my interview was scheduled, so I think they skipped that update. Don’t rely too much on online updates but more on actual notices you receive in the mail. Now it is up to how fast your local office is until you get scheduled for an interview.

Quick question/clarification: Previously If a vawa applicant timely responded to an rfe with no further rfe's can the applicant still be denied?
As from henceforth the new rule is that if your i-360 isn't cleared with all full evidence that ticks an instant denial with no rfe's.
If USCIS receives a response to an RFE within the deadline and the evidence provided is sufficient, the petition will be approved. If the evidence is insufficient (even if it was submitted on time), they will either ask for a 2nd RFE or send a Notice of Intent to Deny (NOID).
The new rule is ONLY for I-360 receipt dates AFTER the new rule kicks in.

I don’t recommend not submitting it. You will need it in order to get approved as you have to prove that you are a person of good moral character. You will get an RFE otherwise, which will delay the process. I would want to send everything because receiving an RFE after over a year of waiting is always nerve wrecking. But it is up to you. I had to get police clearance from 4 different countries and one of them was supposed to be a very complicated and lengthy process but it ended up only taking a few weeks, so online estimates are not always correct either.

If you wanna find out if your previous I-485 is still pending, just take the notice you got back then with the case number on it to an InfoPass appointment at your local office. They will be able to tell you if it is pending or not.

Receipt notices can take 4-6 weeks. You are still in the normal time frame to not have received anything.
As @Damara said on the previous page, they are very backed up on EAD submissions.

Did you apply under category C9 or C31?
Is this your first EAD or a renewal?
Biometrics are typically about a month or so after filing. Just stay patient. You will receive the notice soon.
EAD approval should be 3-5 months after receipt date (08/30 in your case), so I would think you will get your EAD by the end of the year.

Yes you can always file them together. Just know that if you only file I-360 and it gets denied, you will not be put in removal proceedings.
If your I-360 gets denied and you have a pending I-485, you will be put in removal proceedings.
Talk to your attorney and explain you would like to file I-485 and I-765 category c9. Ask if there is a reason he didn’t file them concurrently. Your attorney knows your case best, so see if there is a reason. If not, then file I-485 and I-765.

Yes, it is. You can find everything on form I-693. Part 7: Civil surgeon worksheet has all the testing.

•Tuberculosis (TB), Active—Only a Class A TB diagnosis renders an applicant inadmissible to the United States. Under current Centers for Disease Control and Prevention (CDC)guidelines, Class A TB means TB that is clinically active and communicable.

All I could think of doing is request a change of address on USPS so they can re-route my mail from my old address to the new one.
You can make an InfoPass apointment at your local office to verify that they changed your address in the system.

From looking at shared stories in this forum, I am expecting my 360 approval probably somewhere in april or may 2019.
And if my case gets approved,

1. As a VAWA filer, ALL forms and renewals that you file have to go to the Vermont Service Center. Your attorney has no idea what he is doing, he seems to not have experience with VAWA. Your attorney should have filed I-765 and I-131 renewal with the VSC. The office he sent it to will probably transfer your renewal forms to VSC eventually but that can delay the process.
2. Again, as a VAWA filer only Vermont is responsible for you. You attorney has no idea what he is doing. But it is true that different forms have different processing times, so it can be that receipt notices come in at different times. If they don’t issue a combo card, they will send you an EAD that says “not valid for re-entry” and then you will receive your AP as a piece of paper.
3. USCIS will never send an update about adress changes. If you want to verify that they changed it, make an InfoPass appointment at your local office and and ask them if they can see the changed address in the system.
For the forms you filed, it usually takes up to 4-6 weeks to receive receipt notices.
4. Keep checking the official processing times page as processing times can change every month. I have seen them go from 9 months to 16.5 months over the last 1-2 years. Currently it is 16.5 months. https://egov.uscis.gov/processing-times/
After your I-360 approval, your I-485 will be transferred to your local office. Your local office will then send you an interview letter according to their processing times. Every local office has different processing times but you can look them up at the website above. Depending on where you live, this can be anywhere from 4-18 months after VAWA approval. Even once your I-485 is with the local office, you will still renew I-765 and I-131 with Vermont.
I suggest you read through this forum to get more familiar with the VAWA process as it seems like your attorney is misinforming you and is making many mistakes.

If you have an attorney, don’t do anything behind their back. End their representation first and then file forms on your own. Don’t file forms on your own while you are still under their representation.

Thank you! I won’t know until my attorney receives the interview notice. Seems like it’s always 2-4 weeks after they send the notice though, so should be some time in October. I will keep everyone updated!

They are currently working on May/June 2017, so you should hear soon hopefully. There are still people from January/February 2017 though that haven’t heard yet.
Did your attorney explain why he wanted to wait to file I-485? Does he not believe your case is strong?

I just received the update in my DHS account that my interview was scheduled!!
I can’t believe it! Such great news! It’s been almost exactly 21 months since I filed for VAWA. I am so happy! I have my medical appointment scheduled for next week, good that I did that!

If you are a spouse of a USC, you do not need a priority date for a visa number to become available.

Divorce law varies by state. From my experience, every superior court has a self help center that will provide you with the right documents to fill out and they may even have legal assistants there that will not give you legal advice but check that you filled everything in correctly. I suggest you check with your closest superior court.

It seems like your attorney didn’t explain the VAWA process well to you at all. I suggest you read through this and previous VAWA threads. There is a lot of experience on this forum.

You don’t have to be but they obviously want to see that you are making moves to get away from your abuser, so it is advised to have at least filed for divorce and be able to prove that. USCIS knows that the divorce process can be complicated and long, so if it is not finalized, that’s okay but I would highly suggest to prove to them that you no longer involved with your abuser.
Also from a personal point of view, I think you should get a divorce as soon as possible so that your abuser has no legal ties to you and so that if your abuser gets into debt on purpose, you don’t have to pay for it.

You don’t have to be married to file I-765 under category C9. Not sure where you got this information from but it is incorrect. The only condition for C9 is that you have a valid pending I-485.
There is no interview for I-360. You will hear from USCIS about I-360 after around 16.5 months after your I-360 receipt date. You will either get an approval letter or a request for further evidence if they still have questions. After your VAWA is approved, your I-485 will go to your local office. Every local office has different processing times. Most take anywhere between 6-12 months. You can look this up on the USCIS website. You will receive an interview notice for I-485 from your local office. Then you have the interview and get your Green Card.

If you have a valid pending I-485, you can renew your EAD in category C9. You will need to send this to VSC. Criminal charges have nothing to do with EAD approval. You might need a waiver in order to get your I-485 approved though.

The dates @aquila is talking about are the dates when your petition is considered to be outside normal processing times.
So they are still working on a few cases from back then, that’s why the range says 16.5-20.5 months. But under normal circumstances they should be working on cased 16.5 months back.
