Hi every one !
I need your help with my EAD card under the VAWA case .
My soon to be husband is us citizen . We are
doing divorce now . I received I-797 notice of my VAWA case receipts . And finget print notice .
1. How to apply EAD card by myself ? My attorney summited my case in July . But she chosen the c31 on my I-765, she said I can not choose c9 .
Do I need to write a letter to Vermont center to ask them withdraw I-765 the one my attorney filed ? Or I just send a new I-765 with fees ? Can I have fed waiver on it ?
I need EAD card to work . I have no income .and my children and i don’t have insurance. I need go to work .
2. I have three children are live with me in the USA . Two older children is 14& 10 years old . Youngest is three months old and he is us citizen .
Can I apply I -485, I -765 . For my two big children now ? Do I need to send my receipts with them ? My attorney said need to wait My I-360 approve first then can send my children ‘s applications to the immigration office . If I can send them now , is it okay justdo it by my self not go throw my attorney? I asked her so many times she said I can’t and told me to wait .
3 how divorce paper effect to
VAWA case? It is no fault divorce in my state where I live . My divorce attorney said it would not put my soon to be ex husband abused me in the divorce paper .
4. Do I need take finger print letter with me when I go to do finger print? I don’t have that letter ,my Immigration attorney has it and she did not give
me that letter or even the copy of it yet . I asked her to send me copy of scanned it to email me , but she does not do it yet . My finger print date is 14 th September.
Help me if you know how to do these things on my case please . Thanks very much in advance . Wish all filters are at here got approved. May God bless all
ot you !
1. Did you file I-485? If you did, then your lawyer is wrong and you can him/her send form I-765 category C9 with a letter asking to dismiss the other I-765 under cat. C31. Unless you want to drop your lawyer completely, I do not suggest going behind their back to file things on your own. You pay your lawyer, so they have to do as you ask. If you didn’t file I-485 however, your lawyer did the right thing by filing under cat. 31.
If you need insurance, you can receive Medicaid for you and your children with Prima Facie. If you did not receive Prima Facie, you can send a letter to USCIS requesting it.
2. @sandranj posted this answer on page 45 in this thread. I think a lot of questions can be answered if you read through all the VAWA threads.
“If you didn’t submit the AOS yet then file form l824 for your daughter along with your AOS.
If you submitted your AOS you still can file l824 for your daughter but in both cases USCIS will take action in her case just AFTER your green card is approved.”
3. Divorce doesn’t affect VAWA at all.
4. Yes, you need the appointment letter to take to the biometrics appointment as proof that you got invited to have the biometrics done. Otherwise anybody can just walk in. Just ask your attorney to send you the original. You pay her/him, they work for you, so just be firm.

So does that mean once you've an approved 360, you can be scheduled for 485 interview anytime? Please correct me if misunderstanding the whole process.
Thanks
It means that your local office’s processing times apply to you. You can use your VAWA approval date and count from there. You can find your local office’s processing times here:
https://egov.uscis.gov/processing-times/
Local offices in big cities (esp. along the east and west coast) tend to take close to 12 months currently. Some smaller cities have 6+months for processing times.

Really? I thought it was ib6 🤔 so I must have had that backwards.
https://www.dhs.gov/immigration-statistics/lawful-permanent-residents/ImmigrantCOA
This is the official list. My I-360 says IB1 even though from the list it would seem that if you are adjusting status, it would be IB6. I just assume all I-360’s will be IB1.

Anyone with i360 approved, have received i485 interview date. Seems like i485 is also heavily backlogged.
https://egov.uscis.gov/processing-times/
You can check processing times for your local office here. Every local office has different processing times. Use your VAWA approval date to count from. Seems like most offices take 6-12 months.

Thank you so much. I google found “identogo” can get Thisfingerprint.
So your mean I must be from my country get Jan-2015 to Apr-2016 ( I been america date) police clearance report ,right ?
amd then from America get apr-2016 to Jan-2018 police clearance report ? (Jan-2018 field I-360)
How about oct-2015(I was traveling to new York Boston ,New Jersey about one month )if I need provide this traveling time police clearance report ?
Right now ,Uscis never asking me provide this report , I should be ready for future maybe they request it .
As I said before, you need to submit clearance of places where you LIVED at for SIX MONTHS or more starting 3 years prior to your I-360 filing date.
If you submitted I-360 without police clearance, you will receive an RFE for it. Since you filed in January 2018, you will probably not hear anything until May 2019. It is best to request the police clearances now, so that you can respond to the RFE as fast as possible if you get one.
From what you describe it sounds like you beed police clearance from your home country. If you only lived in one state since you moved to the US, then you only need clearance from that state. If you lived in multiple states for 6 months or more, then you need to request clearance from each of those states.

Hi, how long does it take for USCIS to give decision after they receives the rfe?
On the RFE it should say that they will respond within 60 days.

Hello everyone,I have one question ,help me please ,I was been America on apr-2016,but I didn’t Submit background check report to USCIS, when I filed I-360 on jan-2018, I was just in america 1year 8 month,
1:so if everyone need submit background to USCIS if filed I-360?
2: or only less 3 year in America when submit I-360 must be submit background check report?
3:where can be get this background check report ? from my country or America ?
if from America ,what’s department can be give me this background check report ?
Thank you so much .i am really don’t know where get this report
apr-2016 come america
sep-2016, Married
Jan-2018 sent I-360
mar-2018 sent I-485, I-765
You need to submit police clearance from every place you lived at for 6+ months in the 3 years prior to filing I-360.
If you filed VAWA in January 2018, you need to submit clearance from every place starting January 2015.
Google Live Scan locations + state you live in to see where you can go to get your fingerprints taken electronically. Some police stations do it and then there are many other places that are certified live scan locations. They will then submit your electronic fingerprints to the state department and within a few weeks you will receive a letter that either states that you have not committed any crimes or a list of your crimes.
Every country calls this police clearance process something else. I just googled it. I had to submit it for the US and 3 other countries. All of the processes were different but there will be a website if you google police clearance + your country that will explain what to do.

My VAWA was approved, thank God. My I485 has been transferred to the National Benefits Center, Lee's Summit, MO:
1 I can't find their processing times -- I can find every other center but them. Does anyone know their processing times?
2 Will I be expected to go for an interview there? It is totally in a different State and very far from me.
This is normal procedure. Your I-485 gets transferred to the National Benefits Center after I-360 approval. They check if things are missing for your I-485 and either send you an RFE or transfer your I-485 to your local office. You can see processing times for your local office on the USCIS website. Your interview will be held there.

How frequently do they change form I-693 for the medical? I want to know if I am good to do it now or if they change the form often to where I would need to have the doctor transfer the information onto the new form.

Dear all,
does anybody know? my local office is Fort Myers, and it is showing that their processing time for I-485 is 16-24 months. Does it really take that long? Can’t believe I will have to wait 2 more years after my 360 will get approved.
I would use 16 months as a reference. 24 months is typically when there are complications like background check is taking a long time or there is an RFE.

how do I find the contact information of senator?
Appreciate your help. Thank you 🙏
Just Google your city name + senator and you should find his/her website easily. They have a contact form on their site typically with a drop down for government agency related inquiries.

Basicly it took 3 weeks from my Vawa approval. The wait starts again.
Congratulations! Any update is better than none! What are the processing times at your local office?

HI everyone
i had interview last week & the questions were yes & no from I485 lasted for 10mins at the officer didnt gave me any decsion, will be mailed & they took my I94 card, is it a good sign
Only supervisors are allowed to approve you right then and there. It is normal that they don’t make a decision immediately if the officer was not a supervisor. No need to worry.

current processing times for I-485 in Chicago are 7 months, so you can roughly count 7 months after your I-360 approval.

Has anyone here successfully adjusted their status with an approved VAWA? I just would like to know your timeline so I know what to expect. Thank you
The timeline depends on your local office. If you tell us your local office, we can help you look it up.

hello Sandra, hope you are doing well, i just have a quick question, i got my vawa approved on 2017 and traveled to my country this year, i have been working for a well known person and i have to travel with them, in the last trip they mentioned about applying for global entry, which would make it quicker in the lines and they don’t hVe to wait for me to get checked. i am just wondering if it would be a burden to be a vawa approved, or if this could affect my citizenship, in general i just would like your thoughts on this,if you have time i would really appreciate it
Was your I-485 approved? You can only apply for global entry at a US airport if you are a permanent resident or US citizen.
Once you have your permanent resident card, it does not matter through which I- form you obtained it legally.

Hey guys . Hope you all are well.
I got my VAWA approval but 13 days later I got an online update that “
We are still reviewing your case and there are no updates at this time
We will notify you when your case status changes. We last took action on your case on July 17, 2018.
Is this a normal process? Does this mean my VAWA journey is not over yet?
Your answers are appreciated.
Thank you 🙏
They are bad at online updates. I still get those updates in my DHS account for my EAD that I have had for half a year now and for my VAWA that was approved in May (for which I have th approval letter). No need to worry. They are just messy.

Soo, I just got an RFE for my EAD which was received July 9 ... I was wondering if this could delay the EAD process and is this normal? 😟 Has anyone had the same issue.
It will delay the EAD process because you need to respond and only then they can resume working on your I-765. The faster you respond, the faster they can process it.

Hello. Has anyone that filed VAWA (360/765/131/485) this 2018 received their Advance Parole, AP card? I have an emergency trip (I’m still in status) and would like to know a decent timeline to expect it.
Also, I keep reading about a “combo card”. Should I wait for it to arrive with my EAD over 90 days? What is the current timeline for the AP card? Like, how long did you wait?
Thanks!!
You can request an Emergency AP by simply making an InfoPass appointment. Emergency requirements are here (scroll down quite a bit):
Regular processing times can be found here:
https://egov.uscis.gov/processing-times/
For I-131 at VSC it says 2.5-5 months currently (this changes every month based on their workload).
A combo card is issued when you apply for I-765 and I-131 at the same time and processing times are similar. They will issue separate documents when you file separately or when processing times are very different.

If you have sent form I-485, you are eligible to apply for I-765 under category C9 no matter what you checked on your I-360 petition. Everyone who has a pending I-485 has the privilege to apply for a work permit that authorizes you to work while you wait for your case to get adjudicated. Same with I-131 (Advance Parole/travel authorization).

Usually when you send the docs to them, how fast are they sending any letter or something to let you know that they got the mail and started working on it ?
They are pretty bad with online updates.
When you send your initial petition, you should within 4-6 weeks and get a letter in the mail. They are supposed to answer a response to an RFE within 60 days but sometimes they take longer. They might send an online update that they received your response but they don’t always do that.

If you have a pending I-485 (which it sounds like you do), I recommend applying for I-765 under category C9 because that will allow you to work while waiting for VAWA approval.
If you apply under category C31, it means you have to wait for your VAWA to be approved to receive your work authorization.
If you have a pending I-485, you may also apply for Advance Parole (I-131) which is the travel authorization.

Hello everyone!
The RFE requesting good moral behavior refers to the places where I have lived for at least 6 months during the last 3 years. After thinking hard trying to find out how long it was that I lived in that place, my exact calculations are 5 months and 26 days, less than 6 months.
Question:
1. Do you think I need proof of that place since, although I lived less than the required 6 months because it was quite close to the established time?
I have the background check of the other sites where I lived more than 6 months.
Please help me with your opinion!I would definitely get police clearance from there. My RFE 15 months after having filed I-360 was to send them police clearance from a place that I had lived in for 4 months only. They don’t do math very well
You don’t have a date on your RFE because it is only an initial one and they won’t make a decision on your case until at least 16 months after your I-360 receipt date anyways, so I would request it now and send it.

No service center adjudicates N-400 applications. Just look at the processing times page. The information you were given by the officer is wrong. It is correct that you filed with your local office. It doesn’t matter that you got your GC through VAWA. Vermont is no longer responsible. It is your local office.
