    Dear @sandranj

Please guide me on my case. I’m in the process of preparing VAWA. I left my abusive husband and now living with my sister. I didn’t report him to police when he abused me but when I left him, he’s spreading false accusations against me to all the family. He went on different houses of his relatives and spreads false statements which harmed my reputation. Can I file an restraining order against him?

    Thank you 🙏

Yes, if you have evidence then you can file a restraining order. There will be a hearing in court, so just be prepared that you will have to see him there.

Thank you so much am not sure what to tell you in particular,  when you just told me I had a strong case I believed I met someone online who understood my predicament,  when all hope was gone you brought hope in me. God comes through people like you to uplift His people.

I had one I 485 form pending but later they gave me denial, my question is should I file a new one? And my medicals have expired do i get one to send along with the new I 485 forms?

What’s your local office and their current I-485 processing times? If they are close to 12 months, I would wait to re-do the medical until you get your interview notice just so that it doesn’t expire again if it takes more than one year to have your interview scheduled. You can bring the medical to the interview.

Thanks for the information, however, please allow me to better understand:

She could not cancel before the appointment time came, she canceled the interview after the interview time had passed.

    Thanks iwillsurvive for your help!

As a common courtesy, when you know you can’t attend an Infopass appointment, you should always cancel the  appointment beforehand, so that the time slot is freed up/shows up on the InfoPass page again and someone else is able to schedule an appointment during that time. We all know that it is difficult to schedule an appointment, so you should really tell your friend to be more mindful of this going forward.

What happens is that the time of the appointment has already passed, that is, he could not attend at the time of his appointment.
I want to know if this would cause any problems for not having attended or canceled the appointment.

    Thank you!!

No, it’s just an appoinment he made, that will not affect anything. I do believe though that it is selfish not to cancel the appointment when there are so many immigrants in dire need of an appointment.

    Hi all,

Someone please help me with the following question:
What happens if someone can not attend an appointment they had at Infopass?
Is that a person I know could not cancel his appointment he had in Infopass.
    Thanks for your comments…

    https://my.uscis.gov/appointment

There is an option to View Your Appointment. You can cancel the appointment there and free up the timeslot for someone in need of an appointment.

Please make sure to look at USCIS pages in depth before asking here. It is very easy to find this option on the website.

Do I have to approve to USCIS that I have Emergency and reasons for traveling when I submit 131 or just I can apply for it without problems ? Thanks.

You can just apply for it. It doesn’t have to be an emergency. You can find all the information, including the filing fees here:

    https://www.uscis.gov/i-131

If you qualify for a fee waiver, submit I-912 along with it.

Just found out my i485 got transferred to a different office can anyone explain anything about this step and what happens after??? Please please thank u

Vermont transfers your I-485 to th National Benefits Center who then looks over the forms to make sure everything is filled in and then they transfer it to your local office who then adjudicates it and schedules your interview.

Thank you so much, but it’s asking me for the passport number and I don’t have the original passport that I entered the US with it was burned in a house fire and I came here in 2000. I don’t mind applying for replacement I 94 but how do I get one without knowing my original passport number? Thank you for your help!

Did you never write down your passport number anywhere else or give it to your bank for identification or something like that or scanned it and have it in an old email? You can probably even contact your embassy and find out through them the old number.

After I-130,I-485 and {Renewal  I-765 } denied in May, My Attorney filed VAWA petition for me including; I-360, I-485 and EAD cat C31. When i told him that i can apply under cat C09, He sent form

I-765 to Chicago USCIS Office with renewal and no filling fee. Today, i got rejection notice because of Filling fee and Valid G-28 form was not received.

    My questions are

{1} Can i request for fee waiver form I-912 because i did for I-360, I-485.

{2} Do i need to send back to Chicago or Vermont Center

{3} How can he get valid G-28

    Thanks in advance.

You can either send along a copy of the fee waiver from the first time or just fill out another one and send it with form I-765. You always have to file form G-28 when you have an attorney sending your forms. Your attorney should know about this. This form can be printed from the USCIS website just like every other form. Since you are a VAWA filer, all your correspondence goes through Vermont. Chicago does not deal with VAWA petitioners, so if your attorney is sending stuff there, he has no idea what he is doing.

Thank you so much for your reply. Do I need my I 94 and my passport with my original visa when I file for motion to terminate proceedings?

We had a fire at my uncles house back in 2010 and my passport that had my visa and I 94 was burned. I have a valid passport now but no I 94. I just want to know so that I can start gathering everything I need so when the time comes, I will be prepared. Thank you again for your response

You can get your I-94 travel history here:

    Hello everyone!
I tell you that I received my Prima Facie.
Before my ex-husband withdrew I-130, I was able to obtain a social security number, work permit, and New Jersey state driver's license.
Now I'm thinking about getting my driver's license from the state of Florida and then registering my car, but I have the following questions which I appreciate. Please help me clarify:
    1. After obtaining a driver's license, can I register a vehicle in DMV using my old social security number? Please remember that this social security number was obtained before my ex-husband withdrew I-130 and USCIS denied my I-485.
    2. As we all know, the Facie Premium does not grant a legal migratory benefit; Having said that, I would like to know if it would affect my immigration status in case I unfortunately received some transit ticket.
    3. I have heard that DMV initially grants a cardboard license and then sends the original plastic card, please confirm.
    4. Do I have to tell DMV that I had a driver's license from another state?
    5. Do I have to take all the exams again?
I thank you in advance if someone can please help me with these concerns!

    1. There is no such thing as an old social security number. You are given one SSN for life. You will use the one you got for everything your entire life, so yes you can use it for vehicle registration.

    2. I don’t understand what you mean with transit ticket.

    3. You get a temporary piece of paper until they are able to verify your immigration status and print your actual card. You can use this to drive but not for identification purposes.

    4. Depends on your state’s application form. DMV’s have different forms/rules in every state. Just look at the driver license application form online.

    5. Again, every state has different rules. Most likely they will make you take the test if your old driver’s license expired a long time ago and you are applying for a new license. If you are applying for a renewal license they might not make you pay the fees but you have to be able to show them the info of your old license.

As this is not VAWA related, I suggest you ask this in a thread in this forum about your state. They might help you better.

Sandra can you see my previous posts and tell me if my I-360 has been approved please?

got a text saying my application has been updated and email saying that 'they ordered my new card" what card? And also in the website says “New card is being produced. But not update saying that my application has been approved can you please help with that

Most likely yes. You will receive an approval notice in the mail and that’s when you know you are approved.

Do I need to file my I-485 now?

You can file your I-485 at any time. Processing times are long, so I suggest you file sooner than later.

You will need to file I-864W along with it. You may file I-765 category C9 if you want to work and don’t already have a work permit and I-131 if you want to travel.

If you can prove that you can’t pay the filing fee, then you can fill out the fee waiver I-912.

    Hello everyone,

I applied for EAD at the end of May

    receipt date june/6

biometrics done at the beginning of July

     should I inquire or wait?

    i360 filed- August 2017

    prima facia- September 2017

    EAD+AOS- June 2018

is there any new approvals from July/August 2017 filers?

You can check processing times here for I-765: https://egov.uscis.gov/processing-times/

It says it currently takes 3-5 months (this is counted from receipt date). It says you are outside of the regular processing times and can inquire if your receipt date is May 12th or earlier. If your receipt date is after May 12th, you are considered within normal processing times and cannot inquire.

Hey @iwillsurvive I asked a question earlier about the I-864W.

    I think it got overlooked.

Could you please advice me if you have the answer please please please.

Do all VAWA recipients qualify for the I-864w (Request for Exemption for Intending Immigrant's Affidavit of Support)

My vawa will be based as a battered parent of a USA citizen son.

Yes, as a VAWA filer you don’t need a sponsor since you are a self petitioner

  16. 15 hours ago, Ylx said:

That is interesting.... No he doesn't know nothing! Oh I will have to ask her then what exactly does my lawyer file.. I'm more worry now

Well the purpose of the affidavit of support (I-864) is for the immigrant’s sponsor to fill out to vouch for sponsoring the immigrant financially for 10 years in case the immigrant has financial issues.

Since VAWA petitioners are self-petitioning, they are exempt from having to have a sponsor, this is what form I-864W is for as it waives the need for a sponsor

Hi folks! Hope you guys are having a good and blessing day.Im a vawa applicant. Married with a USC. Last wednesday My pro bono lawyer file i864,but not i864W.. What should I do? Will my application be denied for this mistake?

How did your attorney file I-864 with your husband’s information and signature when  you are filing VAWA, which your husband isn’t supposed to know?

    seems weird to me
