May2018
To prove that you are a person of good moral character, you need police clearance from all places you lived for 6+ months starting May 2015.
I suggest you start getting the ones you didn’t submit as every country has a different process that takes a different amount of time.
I had to gather it from 4 different countries, so I know how lengthy this can be.

This is really getting me scared.
Have been in the US for 2 years and I only submitted police clearance from the US and not from my home country .
my question is that should I get one ASAP and should I sent it to Vermont if RFE is issued or not .
Thanks for your help @all @iwillsurvive@sandraj
When you submit VAWA, in the instructions it states that you need to submit police clearance from 3 years prior to filing I-360 for every place (country or US state) you have lived in for 6 months or more.
What date is your I-360 receipt date?

can i ask why " no good moral character" from your country? would not you try to go court there and dismiss your case and get good moral character ?
I think you misunderstood. I believe it means that she did not submit police clearance from her country, not that she submitted a document stating she was not a person of good moral character. She has no case in her home country, she just did not request/submit police clearance from there initially.

I dont get it iwillsurvive i thought we count from the date the I 485 reach the local office
Yes technically you do but a lot of the time there is no online update for that and you might not know exactly the day that it gets to your local office. That’s why it’s easier to count from your VAWA approval date but it is obviously just an approximate way to measure the time.

Thank you so much, I will try to do the same. Do you know approximately how long they are processing i-485 for vawa?
There is no special I-485 for VAWA processing. It’s just I-485 processing. This is different for every local office. Look at your local office’s processing times.
For example, if it says 9-12 months, use the first number in the time range, here 9 months, and count from VAWA approval date. This will give you a rough estimate of when to expect an interview.

Hi
How long is taking the EAD and AP renewal?
You can find all processing times here: https://egov.uscis.gov/processing-times/
Renewal takes the same time as first time application.

thank you @iwillsurvive. I would have to update medical asap before the interview because it has been 2 years since we last had it when we filed for I-360.
You need to do it asap. As you know, it takes about a week to get results back from the lab.

Hi Everyone! After 8 months of approved I-360 (March 2018), my kids and I finally received a letter for AOS interview!!! Thank God! 😀 I'm excited and nervous at the same time... nervous because I don't know much of what to expect in the interview. As I have read, is it really just formality with questions asked based on the I-485 application? how should I prepare for the interview? I hope you could give me an advise on the preparation because I have decided to just attend the interview with my two minor kids and opted out the offered services of a lawyer due to budget concerns. The interview is just a week away and I have been doing my research and prepare myself for the interview. I would gladly appreciate your input and advise. I would post on an update as well after we go through the interview and share our experience. Good luck to all of us and thanks in advance. 😊
- Make sure to have an updated medical for you and your children (less than 1 year ago).
- Go through the I-485 form that was filed and make a sheet of all changes that have occured since filing (I.e. updated addresses, employment history, marital status, etc.).
- Answer the IO’s questions briefly, don’t say things you aren’t being asked. Stay short and precise in your answers.
- Tell the truth as you are under oath.
- Bring originals for all copies that you submitted to USCIS (I.e. marriage certificate, divorce decree, your birth certificate, etc.)
- Bring a valid ID (passport or driver’s license, birth certificate for kids I assume)
- I suggest to bring all original notices and documents that USCIS has ever sent to you.
The IO will go through form I-485 with you and also ask the yes/no questions. Respond truthfully always but be short. Don’t interrupt the IO. If you would like to hand them a document or say something, ask for permission.

Do you know how long after I got Work Permit (10/29/2018) to get the Approval Notification Letter in the mail?
and how long until I get my I-485 interview? I never received Prima Face or any kind of document stating it...
I am processing my I-131 Travel Document, no idea how long does it take and if I can really use it if I don't have the I-485 yet neither the approval letter for I-360
my lawyer made me feel confuse about it...Am I really approved?...Confuse.
My Timeline
May 25 2017 All Applications in I-360, I-485 and I-765
Sept 7 2018 RFE for I-360
Sept 27 RFE Received
Oct 29 2018 Card In Production
Oct 31 2018 Card Mailed to Me
Nov 5 2018 Card Delivered (in my hands)
1. Your I-360 is approved. There is no set timeline how long it takes to receive the approval notice. I would inquire if you haven’t gotten it 4 weeks after receiving the card.
2. I-131 processing times can be found here: https://egov.uscis.gov/processing-times/ You can use I-131 until you receive your Green Card but always know that it is up to the immigration officer at the border if he lets you in.
3. When you get your I-485 interview depends on the processing times of your local office. Every local office has different processing times. You can check I-485 and select your local office at the link I posted above to get processing times. It will say something like 9-16 months, use the first number in the time range (9 in my example here). Count from your I-360 approval date (which is likely November 2018).

11,5 - 29 months
Yes that means 11,5 months and some difficult cases with RFE’s are longer, that’s not you. You need to look at the first number of the time range.

I can't believe my eyes - uscis updated processing time. For i-485 it was increased from 23 months to 29 months in Miami. My Vawa was approved in July 2018. That means I have to wait for 3 years more for an interview 😞
Not sure where you’re reading this but current I-485 processing times for Miami are 11.5 months.

Hi, my receipt date is Nov 2, 2017. I had a RFE and I respond Apr/2018 for bonafide and good conduct.
When should I expect news? Approval or another RFE?
Thank you
Sounds like this would have been an initial RFE.
USCIS is currently working on June/July 2017. They are taking at least 16 months to adjudicate your petition, so you won’t hear until at least March 2019.
16 minutes ago, Hanna Bui said:On USCIS processing timline, you would get their response after 60 days you sent RFE but until you didn't get anything. You can make infopass or send a letter to ask their response for your REF.
This was an initial RFE, which is different. Regular processing times still apply. The 60 day rule is for RFE’s that are issued when they adjudicate the petition, not when they initally look over it.

Hello sandranj, I have very serious question. Few days back my husband threatened me again that he gonna call ICE and bring ICE agent by next court hearing date for on going divorce process if I wouldn't sign the divorce papers per his demands. Is it possible that he can bring ICE with him and get me arrested in court as I am currently out of status with my visa ? He keeps threatening me of deportation by texts and emails repeatedly. I already have submitted VAWA petition a month back, can I use this new evidence as continuous threats with my possible RFE in future ? Thanks in advance.
Don’t worry, ICE does not have the time to accompany anyone for a non-criminal alien who has a pending petition with USCIS. He is just trying to scare you and have control over you even after you broke up. It’s the same cycle of abuse. You need to block his number so he can’t contact you anymore. Do not communicate with him. Cut him out.
1 hour ago, MGJ_NY said:Hi everyone! So I received an RFE for bonafide marriage and good conduct. I was actually waiting an RFE for the abuse because we didn’t send my psychological evaluation yet. So if my lawyer sends all the evidence needed for the bonafide marriage, can she just inlcude the psychological evaluation or just wait for another RFE for the abuse? She wants to wait until they send another RFE. But isn’t better if we just send it all together so they won’t have to send another RFE and probably delay my case? Any thoughts pls? @iwillsurvive @sandranj
I suggest you only reply with what you are being asked.

Hello, Please can i use Prima Facie Determination to renew my Driver license ? Thanks in advance
It depends on the state you are in. Please ask questions that are not related to VAWA in a different part of this forum.

Did you submit I-693 together with I485? I never sent I693 before then local office sent me Courtesy letter to require this medical record.
Thanks for your support to all. Best of luck.
No I never sent I-693 because I knew the wait would be more than a year. I only brought it to the interview.

My approval is august and my local office is Miami pls when do you think my interview could be Thanks.
https://egov.uscis.gov/processing-times/
you can check here. Miami is currently taking 13 months. If your I-360 got approved in August 2018, you should expect the interview to be in September 2019 but you can always get lucky and get an interview earlier. Just prepare for the longer time and hope for a shorter time.
My local office said 12 months but I had my interview after 5 months. No idea why it happened to fast.

what was the abuse like, if abuse is very clear they may not call you for intw. Approximately in how many days did you receive your first EAD after biometrics?
Please don’t give out false information. The I-485 interview has nothing to do with the abuse/VAWA. They aren’t even allowed to ask about the abuse. It is just a standard interview that goes over the questions on the I-485 form. It is not dependent on the evidence submitted for I-360.
As Sandra stated previously. In her 20 years of filing VAWA petitions she has only ever seen 4 people not get an interview out of the thousands of people she has helped.

Thank you so much for response!
Do you know how I can get a psychological evaluation? I started seeing a counselor just recently when I started feeling that I can't deal with everything by myself.
Also do you know if my i20 is going to be cancelled when they deny my i485?
thank you again for all the information, I feel that I found here much more than when I went to ask a lawyer
Ask your counseler if they know how to write a psychological evaluation. Typically domestic violence counselors or psychologists trained in domestic violence counseling are your best bet. You will need to attend at least 5-7 sessions and your evaluation needs to be in-depth explaining the abuse you suffered, your diagnosis (anxiety, depression, PTSD, ...) and therapy plan.

Thank you. I have another question, to show that we lived together, I only have a lease with both names on it, but the problem is that besides the lease, all the other documents I have to prove bona fide marriage have a different address than the lease(bank account, tax return, property under both names, car insurance) these documents have her dad's address which is where she lived before we got married. We were planning to live there for a while(at her dad's), and when we moved to the place we have the lease from, we never updated the addresses on those documents. Can this be a problem?
Whenever there is a discrepancy, just explain why in your affidavit, just like you explained it to us right here.
Immigration officers are human beings too, they are understanding if you just explain it to them.

Saint Albans, Vermont Service Center, I got my WP but not a notification of approval letter yet....I thought once you get the WP it means an approval of the I360.
Vermont Service Center is not a local office. Saint Albans is your local office.
Yes you are approved but you will still receive an official approval notice for your I-360. Then you will receive an update on your I-485 that it is transferred. Let’s just assume that happens this month. The St Albans local office currently takes 10 months to adjudicate I-485, you should expect an interview around September 2019.

I am claiming my GC in Jesus name and i declare that i dont have to go for a interview
Why do you not want an interview?
Processing times are the same whether you have an interview or not. The interview really is not a big deal.

So i recieved an update that my vawa has been approved..
Timeline
I filed my I-360, 1-484 I-765 in may 2017.
Receive my receipt notice in June 2017
Did my Biometrics in JULY 2017
Got my Prima Facie in December 2017, June 2018.
Also got my EAD Aug 2017, and July 2018
Card production Oct 23 2018. Recieved EAD C31 Oct 30.
Recieved update Nov 2 2018 my Vawa has approved.
I didn't recieved any RFE.
Is it a possibility that they can send my GC without me going for a interview?
The chances of that are very slim. The majority of people have to go to an interview. There are very few random cases where there is no interview. But the interview is no big deal. It’s just going over the I-485 form again. It’s just a formality in most cases.

Depending on how fast the IO is that initially looks over your petition, it should be around 4 weeks. Mine took 6 weeks. You can’t track this since you don’t have your case numbers yet. Just be patient. This is one of the shorter waits.
If your mail tracking number says delivered, you are all good.
