Guys, i am new in this forum.
I suffered  physical, emotional and psychological abuse fron my US citizen wife.

The abuse started November 2017, we met in October 2016,married April 2017. Because of the love i have for her hoping that things will change and her constant threath of calling immigration on me, i could not speak out.

She filled for me, in December 2017 and that was the begining of unending abuse. I have my work permit July 2018, but she eventually abandoned me mid-august and interview for adjustment of status fixed for Monday September 17, is now in jeopardy.

My attorney advised that I file  VAWA i360, to put i485 in abeyance,so as to save my work permit from being cancelled.

So,he quickly filled i360 and after write to USCIS field office that will adjudicate my i485, with a copy of i360 and UPS mail tracker of i360 sent to Vermont, for them to hold my i485 in abeyance, he put it in the letter that he will send the receipt number of i360 to the field office as soon as it is received.

He said he has to do this quiclky so that the interview will not be considered as abandoned and my work permit cancelled.

What is your comment has my attorney did the right thing so far?

    Thank you.

Your lawyer sounds like he knows what he is doing and like he cares about your case. Stick with him/her!

What your lawyer is suggesting is your best option when it comes to immigration if your spouse is not willing to show up to the interview and is abusive.

My recommendation is to file for a restraining order and a divorce as well.

Let us know if you have any questions about the VAWA process but I suggest just reading through this thread and the older VAWA threads to get familiar with it all.

If you need help with how to file for divorce in California, I can help you.

    Hello everyone.

I haven't posted in a while. I recieves my interview date for September 28th. This process has taught me how to be patient. 😓 I am so happy, but a bit nervous. Can someone who has already been to their interview tell me what you brought along with you? I got a check list but there is not a topic for  Vawa. Apart from the topic which states ‘DOCUMENTS REQUIRES FOR ALL INTERVIEWS’ is there any thing else that I need to take with me.

    thanks for your response.

They are not allowed to ask you about the abuse during the interview. They will just verify your personal information and ask you the yes/no questions from form I-485. Bring your divorce certificate and medical if not previously submitted. Make sure the date of your medical is not older than 9/28/17 (one year), otherwise you will need to do a new one before the interview.

He claims he did. I will reach out to them.  Is it the 1800-375-5283 number? And do I ask to talk to any officer or just anyone should be able to help me find the status? Thank you again!

As a VAWA filer, you are not able to get information over the phone for safety reasons. In order to get information you can either write a letter to the VAWA Unit at VSC or make an InfoPass appointment at your local office.

Hi iwillsurvive I need help about my divorce pls any advice will help Thanks

Divorce laws differ from state to state. If you have an easy case (no children or property together), you can easily do it on your own. It’s just a lot of paperwork but nothing unmanageable.

If you have children or property that needs to be divided, I suggest you hire an attorney. Many domestic violence agencies work with pro bono attorneys that will help you file for divorce for free.

Please  I need in starting my VAWA case, my wife is a USC , but my Lawyer want me to file i360 first and wait till approver before doing the i765 and i485, I guess he's doing that because of his retainer,  but I told to do something for my best interest.  PLEASE VJ can I file the 3 forms together and my EAD can fall under c9 instead of c31 and I can have pending i485. I just need to work. Please advice. Thanks

Yes you can file all forms together. You don’t need to wait for I-360 to be approved to file I-485. Just know that if you filed both and your I-360 gets denied, you will be put in removal proceedings.

I suggest you find a new attorney if your current attorney gives you bad advice.

Thank uou so much about your help .

i already let My country someone’s help me get police clearance report

I will be go to get in Houston Texas clearance report

do you know what is “Good moral character”,

i saw many people need submit this .i have not submit this USCIS

To prove that you are a person of good moral character, you need to submit police clearance from all places you lived in for 6 or more months 3 years prior to filing I-360. You have to prove that you are a good person basically and not a criminal.

Hello guys I need your help,my lawyer file i765 under c31 category and later we resend another i766 with category c9 because I have work pending the approval.

its was rejected and sent because saying we have to pay the fee for the form.

mind you the fee was waived when we first filed i360,i485 and i765 .

i need to work and I don’t have enough to pay for this fee.pls advice.

    Thanks

Did you submit a new fee waiver or at least a copy of your previous I-765 fee waiver when submitting the second I-765 under C9? Your attorney should have known to do that. How else are they supposed to know that you have been granted a fee waiver already?

Hello Sandra, how are you?hope you are doing great! Please I need your help!My Vawa was approved on July 31st 2018 so I applied for work permit on August 28th 2018 till now I haven’t heard from them!So I was supposed to adjust status and I was told my priority date is not current which August 2016 so I wish to know if they use August 2016 as my priority will they schedule my interview soon?,do you know when it will be current?thanks a lot for reading!God bless you!

Did you apply for EAD under category c31 (based on approved VAWA)?

If yes, it has only been two weeks since you applied. You need to be a little bit more patient than that unfortunately. They probably haven’t even started writing your receipt notice yet.

So after I wrote that I just get another email from uscis that they are still reviewing my case, the last time I got this email is 10 days ago? I hope someone is looking at my case, praying for the best

I get them about every 2 weeks even on my approved forms (previous I-765/I-360). They are messy with online updates and sending those emails. What matters is the date in the email when they last took action because that is the date someone last touched your case. So if that date changed from last time to this time, then someone looked at it. If it’s the same date, then unfortunately the update email doesn’t mean anything.

    Hey  Guys

My Lawyer sent EAD Renewal to NBC not Vermont, I got the receipt already and also a letter that they will used my Old fingerprint to process.... I am so Upset (-__-)  right now.  She said my i485 still pending and i have not yet have my initial interview to put my i485 on hold. even thought I already have i360 receipt and prima facie letter,

My field office is NYC and is taking 12-16 months just to get an AOS interview, i Filed i485 on 10/5/17 no interview notice yet. I file i360 on 06/4/18 Receipt on 7/5/18

Does NBC rerouted to Vermont or do I need to file a new EAD renewal to VERMONT please advise me. ??

It depends. Sometimes they send it back to you and sometimes they transfer it. It seems like they will transfer your I-765 to Vermont if they already made the comment to use your old fingerprints. It will unfortunately just take longer because of the transfer. Even after your VAWA approval, you always have to file I-765 and I-131 with Vermont.

I am new on this forum and looking for advice:

    PD: Dec 17,2017

    NOA: I-485, I-765, I-360 1/8/18

    RFE: Good moral character 2/2/18

    Bio: 2/6/18

    Response to RFE: 3/5/18

    Prima Facie received: 3/25/18

No EAD!!!!! Please advice what I can do to request one. I did a request by phone and was sent a letter from uscis that because of the nature of the case they are unable to respond to online or phone inquiries.

My lawyer and I sent them a letter in May and one in August and nothing yet.

I also went to an infopass in August and nothing!!!!

What category did you put on your I-765?

If category C9, you should receive your EAD 3-5 months after submitting I-765. If category c31, you will only receive your EAD after VAWA approval.

You can’t get any info over the phone as a VAWA petitioner.

Hello everyone! I filed i-485 and i-360 concurrently in October 2016. Vawa was approved in July 2018. And in August 2018 my I-485 was transferred to my local office. My question is - what's the i-485 case inquiry date? August 2018 when the case was transferred to my local office? Or October 2016 when it was originally filed?

I'm curious to estimate my i-485 interview.

Sandra advised that it is the VAWA approval date/the date your local office receives your I-485. So when processing times say X-Y months, use “X”/the first number.

    Good morning guys!!!!

How long it takes in Vermont to get approved?

    thank you !!!

Always check the USCIS processing times website for the latest information on processing. It gets updated once a month.

    https://egov.uscis.gov/processing-times/

Currently it is taking 16.5 months for USCIS to view an I-360 petition and send out an approval letter or RFE. They are working on cases that were filed around May 2017.

Ohh noo so i finally bought my ticket for next month and now i was told.that green card holders have been getting denied entry, how true is this? Does anybody have more info?

It has always been up to the immigration officer at the border whether residents and visitors are let in or not. The only guaranteed entry into the US is for citizens. That being said, it is very rare that residents are denied entry. Most likely this can be due to having traveled outside of the country for 6+ months, having a criminal record or being from a country under the travel ban. It is not very likely that a permanent resident that is just going on vacation for a few weeks is getting denied. No need to panic. Just always make sure you have all your documents on you that prove your resident status and ties to this country.

My lawyer filled my VAWA, I485, I765, I131 together, I765 And renew EAD on C31 for the both. But i reveived my 1st EAD C9 (my VAWA wasn't approved), the 2nd EAD C31 with appoved vawa.

USCIS is too messy, i still don't undersatand their working to all applications differently.

Thank you for your time to us.

If you have a pending I-485, I recommend filing all I-765 renewals under C9, so that you can work while your VAWA is pending.

It is my understanding that remarriage has no impact. What does impact it is if your abuser was a USC or LPR.

N-400 filing at 3yrs is for 360 approved based on USC. You have to wait until 5yrs if approved based on LPR. (if the LPR has since become a USC oddly their citizenship allows you to file for citizenship as abused USC spouse. You can apply as soon as they are a USC for 3yrs OR you can file 5yrs from the date you became an LPR.

I do not know why there is conflicting information online about remarriage and the n-400 if you were VAWA. Some can just be people repeating outdated info I guess. And then theres people who never heard of VAWA but will make absolute statements to you cant naturalize at 3yrs if you divorced. Its always best to check with a reputable immigration attny like Sandra because things change fast in immigration. She will probably post an answer to you- whatever she says is correct :)

Great, that’s what I thought too. I wasn’t able to find any official information that stated anything about remarrying. Thank you!

  17. 16 minutes ago, Damara said:

I have read in this forum that in order to qualify for filing N-400 after 3 years, you cannot remarry in that time. However neither of the above posted memorandums mention that you can’t get married and not qualify to file after 3 years. Do you know if you can remarry and still file N-400 after 3 years?
