I'll just get hounding USCIS for the "promised" 48 month extension ASAP. But his N-400 will be filed tomorrow, no later than Friday so we can start the end of this immigration journey!

So based on the verbiage above from your NOA1 you received on your N-400, it seems that it's not an extension because it's 24 months from the Green Card expire date which is the same 24 months given from Card expiration when we got the NOA1 for his I-751. His GC expired 6/18/21 so 24 months from that date on his GC is 6/18/23.

So it's sounding like I'm gonna need to have USCIS send me another extension which is the 48 month one that others have mentioned.

I just verified that my wife did not receive a new extension letter when we filed her N-400 (Aug 7, 2022). A 24-month extension would have been useless, anyway.  Her Green Card expired in June of 2019.
  5. Thanks

N-400 extension for recent filers is only for 24 months after the green card expiration date.  OP already has this with the I-751 filed and a 24 month extension letter.  Best path forward is to file an N-400 and see if that helps move the I-751 along, and contact USCIS to try to get the "promised" 48-month extension letter for the I-751.  If that doesn't work (and others who have tried have not been successful), then try to set an appointment with USCIS for a local office ADIT stamp in the passport.  I have not seen one VJ post on someone with a pending I-751 who has received the 48-month extension letter yet, they seem to be very slow on following up on their own "policies."  My husband is still waiting for it.

"Filing the Form N-400 provides an automatic extension of your form I-551, Permanent Resident Card (also known as a Green Card). This notice presented along with your expired Permanent Resident Card, is evidence of your lawful permanent resident status for 24 months from the "Card Expires" date indicated on your Permanent Resident card."

He will get another extension letter from the N-400.  It will expire 6/2023.

File N-400.  Pressure USCIS to produce the 48 month extension letter. As it promised.

In case you're interested, here is a transcript of our I-751/N-400 interviews:

We received an email a few days prior notifying me to be there for the combo interview. Appointment was at 1:00 pm Wednesday, December 14th.  We were called in at 1:30 pm.  Officer said, "You have already submitted a lot of evidence".  The officer asked both of us a few questions for the I-751 interview.  "How did you meet"   How many children?  When were you married? Did you pay anyone to fill in the I-751? He wanted to see evidence of marriage dated from I-751 filing date (March 2019) to present.  I gave him bank accounts, credit card accounts, apartment leases, driver's licenses, Car insurance card. He did NOT ask for tax transcripts (I had already uploaded them) or original documents.  He said "You satisfy the I-751 requirements".  He then gave me the option of remaining in the room for the N-400 portion, but wife was comfortable alone.  He escorted me back to the waiting room.  Wife says he asked her a few questions we had answered in the I-751 interview portion, then asked her the 6 easiest questions in the 100 question list.

    Who is President?
    What did MLK do?
Why did colonists come to America?
    Name one branch of Government?
    Name 2 cabinet positions?
    Who makes laws?
About 30 minutes later, he escorted her out to meet me.  She had the form which says "You passed the English and Civics test".
An hour later, her N-400 status had changed to "Oath will be scheduled".  The next day (I think), her I-751 status changed to "Case was approved".
What amazed me was the rate the officers were calling interviewees in that afternoon.  They had 10 or 12 officers continually calling people out of the waiting room.  We were called 30 minutes after our appointment time.

The officer told us "We are here to help her become a citizen.  We are not trying to fail her.    Officer said 2 to 6 weeks for the oath.
When we got home from interview, the N-400 status had changed to "Oath will be scheduled".  Next day, the I-751 status changed to "Case was approved".  On Jan 9, 2023, we received the oath ceremony date.

No, N-400 does not by itself generate any letters related to LPR status. N-400 and I-751 continue to be treated as two completely separate cases until one of them gets to the top of the pile, at that point the remaining case may well get adjudicated together or soon thereafter. Evidence suggests that recent N-400s are prioritized at the moment with plenty of cases getting adjudicated in around 4 months.

If you have urgent travel and have an expired extension letter you will need to pursue that based on the I-751, a pending N-400 will not help.

He will.  It will extend his gc 24 months  from the date of expiration of the gc.

He is owed his 48 month extension letter and I cannot, for the life of me, understand why people are not more aggressive in forcing USCIS to produce it.  If my wife’s extension letter expired without a 10 year gc in hand, I’d be lighting up the phone and chat every day.

Okay, great information! I will probably have him make an appointment with Infopass between now and May to get his extension letter in case he has to travel back home for anything after June 2023.

I assumed that USCIS would send an automatic update extension to his NOA1 for the ROC but stupid me for assuming!

Thank you so much for your help!

Today was my husbands citizenship interview. I went with him just incase they decide to do a combo interview since our I-751 is still pending. They took us both in. They only asked me demographic questions and the rest was for him. He passed but because our green card is still pending, they told us to wait about 2 weeks to approve that(it’s currently in a different system) and then they will send letter for the oath ceremony.

Best of luck to everyone and be ready for combo interview. You just never know!

Hello Everyone...didn't think we make it to this point, but with hard work (marriage counseling), we're still here heading into our 3 year marriage anniversary in July! Love, communication, and compromising does make a marriage work and get better every day! So with that said...I'M BACK!!! Joining the waiting game with you all. Sent my husband's ROC package yesterday via FedEx and it was delivered and signed this morning by F. Brown.

This waiting game will be different and much easier than the K1 and AOS process!!! Good luck to everyone!
