KimchiLumpia got a reaction from aisha1109 in My K1 Visa Advice For New Members
Like many first time Visa Journey members, my fiance (now wife) were extremely stressed and overwhelmed with the K1 Visa application process.  We considered hiring a lawyer or using one of the many online immigration services.

Through a lot of research here on Visa Journey, we grew confident we could complete this process ourselves.

My wife and I started her K1 Visa process application in November 2016, had her K1 Visa approved in April 2017 and were married in July 2017.  She received her SS#, AED/AP all with no problems.  We are currently waiting for her AOS interview.

We could not have gotten this far in the process without the help of VJ and many of the members here.  Doing it ourselves have given us a new understanding and appreciation of the immigration process.

I’ve gotten a number of messages and questions about the K1 Visa process.  I wanted to share my advice to help others navigate the K1 Visa process and how to get the most of the VJ website:

Update your timeline and profile.  It helps the VJ community give more specific information if we know which country your foreign fiance is from. Once you input your country, look for the "Portals" tab.  The "Portals" section will have a wealth of information regarding your country's consulate, timetables, embassy reviews, and more. Here is a link to many abbreviations you will come across on this website and during the immigration process:
http://www.visajourney.com/content/us-immigration-abbreviations I recommend viewing VJ on a laptop or regular computer.  The information on VJ is jumbled on cell phones and does not show user's signatures after they have posted.  In my signature, like many others, I've posted a detailed timeframe of my VJ experience.  When you view VJ on a regular computer, it looks much different than on your cell phone. When replying to posts, keep it informative and good natured.  Disagreements are natural on any message board.  However, moderators will delete posts that are offensive or do not contribute positively. Some of the information on VJ is old and may not be currently applicable.  The guides are a tremendous help, but, double check with the government websites to get the latest forms, instructions, information and fees.  And ask VJ members from your foreign fiance's country their input as well.   You must have patience.  The immigration process is not quick.  You will have ups and downs, worrying, and will envy seeing other VJ members receive their petition approvals while you continue to wait.  While waiting, continue to collect evidence supporting your relationship. Keep in mind that applications from high fraud countries typically take longer to process vs. low fraud countries.  In our fast paced, gotta have it now world - having patience is truly a virtue in the visa process. Never plan your wedding, buy airline tickets, or reserve a reception hall until the visa is in-hand.  RFE's, incorrectly paid fees, incorrectly completed applications and the such will set things back even further.  Only cement your plans when the Visa is in-hand. Contribute!  There are a lot of lurkers on VJ.  But, this community is only as good as the contributions given by its members.  A great quote I once heard, "When we teach, we learn twice".  So ask questions, give advice, get acquainted, and welcome!
The K1 Visa process is time consuming and very stressful.  You will go through many ups and downs waiting for your petition to process.  Have faith, and know that many VJ members have gone through the same experience - and are here to help!

Good luck on your Visa Journey!

My Canadian wife and I have not gone through your exact situation.

However, I'd recommend going to a FedEx Business center in your area - as they take passport photos and are relatively cheap.

I'd print out the requirements for Canadian passport photos, and ask FedEx if they can take photos according to these requirements:
     https://www.aadnc-aandc.gc.ca/eng/1333474227679/1333474298675

As long as the photo meets these requirements, and the FedEx Business center completes the required information on the back of the photo - I see no reason it should not be accepted.

    Good luck!

There's no requirement to be 18+ to file an I-129F. However, they will require that you are 'free to marry", which may or may not allow marriage before age 18 where you live. Usually this is permitted with parental consent, or if they are emancipated.
The beneficiary's country's requirements to marry are not considered, as they are not marrying in that country.

That said, it seems unwise to pursue any immigration process that young. And the age raises its own concerns in terms of eligibility for the actual visa (but not the petition).

    Re: Philippines
This is where it gets a bit more complicated. Both USCIS and the embassy do not require any form of approval based on age. They will issue the visa regardless of any letter. Parental approval (or even knowledge) is not required, although the lack of knowledge or approval may make the CO question the legitimacy of the relationship. However, Filipinos cannot leave to the US on a K-1 or immigrant visa without the CFO sticker, and that's where they will request it (as CFO is part of the PH government, not the US).

My fiance was married twice before and it was no problem. Just make sure to have several copies of your divorce decree as you will need copies for the application, for the interview, and at the AOS stage as well. Copies may also be needed for changing your name on things like passport, etc, though marriage certificate is usually enough at that point... just always good to have that divorce decree handy just in case!

    Everything above as well.

USCIS want to verify you have met with-in the past two years.  Quality evidence of this includes: airline tickets, passport stamps matching airline ticket dates, boarding passes, bus tickets, hotel receipts, etc.

If you are to add photos, I suggest adding photos of your visits with familiar landmarks in the background.
My wife and I only submitted 4 photos of us together with landmarks of our cities in the background: Seattle Space Needle and Vancouver BC Science World and Whistler Ski Resort.  We did add copies of her bus boarding passes when she would come to visit as well.  We had zero RFE's and approved K1 Visa with no problems.

Think like a USCIS agent.  Considering tons of immigration fraud cases out there - if you were a USCIS agent and presented with the evidence you submitted - would you believe the relationship is legit, and that you have met in-person within 2 years?

    Quality > Quantity

For the OP and anyone else reading this, filing for a K1 Visa, an eventual AOS and ROC is a process in patience.

The process with make you furious, frustrated, angry, and in disbelief.  Everyone before you has felt the same way in the process.  Just hang in there.

Some pointers for others starting this process:
Never plan your wedding, buy airline tickets, or reserve a reception hall until the visa is in-hand.  RFE's, incorrectly paid fees, incorrectly completed applications and the such will set things back even further.  Only cement your plans when the Visa is in-hand. Don't 100% put faith in the time-line here on VJ.   It is just a guide. Realize, high immigration fraud countries take longer to process vs. low immigration fraud countries. Make sure to find your country's portal page on VJ, and learn all you can from VJ members from your specific country. Make sure to view VJ on computer vs. cell phone.  There are features on VJ that you can see on a computer you can't see on cell phones. Get familiar with VJ website.  There is a lot of information on here that many people don't even know about: reviews of your country's consulate, member's K1 Visa interview experience, and a lot more. Interesting....

My wife (Canadian citizen) and I drove up to Vancouver over the weekend to use her AP/EAD combo card for the first time to visit her family.  It had been about 6 months since she came to the US on K1 Visa.

We came prepared with all her NOAs regarding her AOS that is being processed, her completed biometrics appointment, a copy of our marriage certificate, and all pertinent paperwork regarding our marriage and AOS.

We drove back this past Sunday via the Blaine truck crossing.   We handed the border agent my US passport, my wife's Canadian passport with K1 Visa in it, and her AP/EAD combo card.  The officer asked about 3-4 questions: how long we stayed, who we visited, what my wife's status was in the US.  The border agent was stern, yet, very friendly.

After a 3-4 minutes, he welcomed us back to the US and we were on our way.  No secondary inspection.  No request for additional papers or information.

With that being said, we will still bring our additional NOAs and adjustment of status paperwork when visiting Canada again.  I think its all up to the discretion of the border agent.  You could get a laid back agent, or an agent that is more stringent.

Now my question - Can your AP card be used to return to the US from a country other than your spouse's country of origin?  For example - my wife came to the US on K1 Visa from Canada.  Can we take a vacation to say Mexico, and use her AP to return to the US?  Or can the AP only be used to return to the US from the foreign spouse's country of origin?  In our case Canada.

I did more research about the question of specific contributions.  And this question was intended for those sponsoring immigrants with short-term stays (student Visa holders) an opportunity discuss specifics details of their support: lodging, food, spending stipend, etc.

By all accounts, this question regarding specific contributions does not apply to K-1 Visas.

With that being said, I personally do not like to leave sections in forms un-checked or un-marked.  It may look like one has forgot or missed that section.

As stated by another poster, I like the idea of checking "Yes" to the question, then having an explanation regarding the "Yes" answer vs. leaving the boxes unchecked.  COs are human and make mistakes.  A CO may review a file and deem an unchecked or unmarked section as incomplete.

Recently, another VJer answered "Yes" and put "N/A K1 Visa Applicant" on the new forms and had no problems:

This is what I plan to do as well.

    To answer the OP:

If you follow VJ's example I-134 form dated 2011 - Question #11 regarding contributions yes/no boxes are left "unchecked" and in the explanation section, you are to write "N/A (K1 Visa Process For Permanent Residence)":
    http://www.visajourney.com/examples/Form-I-134.pdf

In the new revised I-134 form dated 2018 - Question #38 now regards contributions.  If we are to follow VJ's example, you would still leave the yes/no boxes "unchecked".  But now, your explanation is submitted in Part 7 on page 8 of the new form.

    You will do this:
    3.a. "Page 4"
    3.b. "Part Number 3"
    3.c. "Item Number 38"
3.d. "N/A (K1 Visa Process For Permanent Residence)"

You're basically giving the same information as in the old I-134 form, but, in a different location:

    Hope this helps everyone!

Yes we did file for the EAD/AP combo card but haven't received those yet. Still doing the waiting game.
In the US no. If you came on a K1 then more than likely it'll change to card has been mailed. But if you have an interview it'll tell you it has been scheduled. Or immigration processing times are a joke and are not enforced.

You don't schedule the interview yourself for AOS, USCIS is the one who decides when you will be interviewed. At least that's how I understand it. Also, not everyone is required to undergo the interview, so you might not even have one. Again, it all depends on what USCIS tells you to do. So really, it's just all waiting for word from USCIS from here on out! Nothing we can do
