But you’ve already been given advice on what to do? Namely, pause everything at the NVC stage and don’t get MIL a visa yet.
Given the child would be at least 7 years away (very rough guess) from a visa, a re-entry permit isn’t going to help and your MIL may well end up losing her green card if she gets it sooner. So just hold off until she is actually in a position to petition the child.

And if you are wondering if the baby can be petitioned for immigration, that no. Not until the baby is officially adopted by MIL. Even then, the baby/child cannot travel with your MIL. Your MIL will have to enter the US with her IR5 visa and "activate" her I-551. Then she can petition the baby via I-130. This will take 1-2 years. Your MIL will need to maintain her permanent resident status throughout the process.

That's true, and much easier for you to overcome all your case issues .

Affidavits tend to be very poor types of evidence as people can write anything they want. If you have all the solid proof of your paternity, you should be fine.
Good Luck!

Gen_X reacted to Nashmusah in Proving Residence for CRBA
Not necessarily for the both parents to attend for interviews, your wife is enough, but you have to present the following:
The original birth certificate must be presented to the Consular Officer on the day of the interview. Proof of the parent(s) U.S. citizenship. A copy of the U.S. passport and the naturalization certificate or certificate of citizenship must be uploaded in the e-CRBA application.

Gen_X reacted to Pleasework89 in Pending CRBA
There is nothing you can do. You already emailed the embassy for a status update. When I applied for my daughter's CRBA (consular report for birth abroad) they emailed me when to pick it up. I am sorry it is taking so long. Your child's CRBA and us passport IS taking too long. It should take about 4 weeks.

Gen_X reacted to Boiler in Proof of residing in USA for CRBA
In my case I have a non remote job for a Government entity for more than 5 years so I would ask HR for a letter confirming that.
Possibly also a sworn statement from the manager of the local brewery.

What you need to be proving is physical presence.

Gen_X got a reaction from WonderingRobort in Brother recently married after filing I-130
I am a US Citizen. I filed an I-130 for my brother about 2 years ago. At the time of filing he was single. However, he just got married last month.
Do I need to notify USCIS of this developement? Perhaps file some kind of addendum notifying them that he is married now. Or do I simply wait for his petition to start processing and then provide proof of marriage etc ?
Any assistance in this matter will be greatly appreciated.

Gen_X got a reaction from VALU in Difficulty with USCIS InfoPass appointments ? Read on
Hello,
My spouse came here last month and we came across an issue where we needed to go to the a USCIS field office and speak with an immigration officer directly. The nearest USCIS office is in Chicago. The way to do that is go to the USCIS website and schedule an appointment. Given that this is the only field office serving Chicago (3rd most populous city in the USA) getting an appointment is extremely difficult. I kept getting a message that no appointments were available and to try back later. This was extremely frustrating as you get the exact same message every single time.
So, here is what I did. I contacted the office of my congressman and they went to work on immediately. However, I happened to be up at 1:30am and out of the blue I decided to see if any info pass appointments were available. Lo and behold !!! They have not one but literally 10 available slots. I have the luxury of choosing a time that was convenient for me ! How about that ?
It appears they update the available time slots at or around midnight. Though I don't know the US time zone. I am in Central. Also the earliest date you get will always be 14 days out.
I hope this helps someone.

Gen_X reacted to pushbrk in Will be married 2 years when entering US - applied as CRI
You didn't apply as anything but the spouse of a US citizen. Nowhere did you indicate CR1 on any paperwork. It's just a spouse visa process for spouse of US citizen. THe correct visa will be issued, no matter what you had in your mind when you filed the petition or applied for the visa. Even if the visa would be issued before your two-year anniversary, entering the US AFTER the two-year anniversary would result in IR-1 status.

Gen_X reacted to geowrian in Will be married 2 years when entering US - applied as CRI
If you are married for 2 or more years at the time of entry into the US on an immigrant visa, you will get the 10 year green card (no ROC required).
Not sure what you mean by 3 and 5 years...? LPR status is granted right away and the green card will arrive shortly afterwards. After 3 years of entering the US on the immigrant visa - if still married to the USC petitioner - you can qualify for naturalization. Otherwise, you need to wait 5 years.

Gen_X reacted to cordoba2015 in Will be married 2 years when entering US - applied as CRI
We went through POE 3 months ago and got the 2 year green card in the mail a few weeks after that. When the 2 year green card is about to expire we'll remove conditions. The 3 or 5 years sounds like the years until someone is eligible for citizenship. We have a few years to go until we do that.

Gen_X got a reaction from Keith & Arileidi in Other evidence of a bonifide marriage
I am going out on a limb here, but do have any money transfers (Western Union, Moneygram etc). How about greeting cards or presents mailed to each other. If so, you should only need the empty envelopes, given they clearly show the sender/recipient and the post marks by the postal/courier services. How about flowers you may have sent each other? A receipt from the flower shop/website showing purchaser/recipient names and addresses can help. Emails are also great way of showing proof of marriage.
These may look feeble or far fetched ideas, but we used them successfully. My advice is simple.. the more solid your documents that establish a relationship, the more likely you won't be asked many interview questions as well as a speedy processing of the visa.
Of all countries, my spouse is from Pakistan. Her interview was quick. In 15 mins she answered about 12 questions. However they were very simple and closely related to each other.
And was rold she w get her visa in 15 days but then n reality it waz ready in 2 days!
I wish you all the best!

Gen_X got a reaction from Kadupul in NVC Processing Complete - Interview Date Update
Hello all.
I just spoke to the NVC to get an update on my RFE. They had quoted that it would take 11 weeks to process the RFE. At this rate, my 11th week would have ended on August 11, 2017. However the processing of my RFE just got completed a few days ago on July 14, 2017
So, it looks like they are processing a bit sooner than they are quoting. I recommend everyone who has been quoted an 11 week wait time to call the NVC and get an update. Their phone number is (603) 334-0700
Once the NVC has completed processing, the next step is to get scheduled for an interview date. NVC receives a list of available time slots from the US Embassy/Consulate every month. And based on that is when you can expect to get an interview date. The NVC is not able to advise how soon an interview date will become availalble.
Good luck to everyone !
