How in the Gods name do you think of hiding something like that? And especially from a person who you love? Are you aware that you will have to have health insurance in the USA? You are aware that you will not be able to work for a significant period of time thus not being able to see a doctor without your partners insurance??? How would you explain to your partner that you need to see a doctor every 3 months? What if he had issues with it?

If you have had sexual intercourse with your bf in a state or country that requires you disclose your HIV status to him, then you have broken the law. You will be required to disclose this crime as part of the end to end process to get a green card. If not the K-1, then surely the I-485.

I believe your U.S. immigration journey is over.

All of which he'll find out about when you move and need to be added to his health insurance anyway.

Telling him now isn't as good as being honest with him from the start….but it's better than telling him after marriage which would be an appalling thing to do.

I've been a nurse for a very long time - there are medications that someone can take who is NOT HIV+ to prevent them from becoming HIV+. If you are sexually intimate with your partner, it's very important that they know and understand this so they can protect their own health. In addition, there are 10 states in the US where it's a crime to NOT let a sexual partner know that you are HIV+. It's no longer the stigma it once was - there are many free clinics in the US and with proper medication, your healthcare and your partners are both protected - but I cannot in good conscience imagine entering into a relationship without your partner knowing. You can do your interview in Norway or any country that you have legal residency in (i.e. you can't just be a tourist in Norway)

California is one of the states where jurors for non federal trials must be U.S. citizens. Jurors for federal trials must be U.S. citizens everywhere.

Every California jury summons I have received has had an option by mail or online to request to be excused from duty, with reason. When the reason is: “I am not a U.S. citizen” I have always had to provide a copy of my green card. Went through that twice in California. IME you will get a summons once every 5 years as they assume you naturalized.

Please post your summons so that you can be walked through the process.

Definitely health insurance/travel insurance.  They're generally bundled together for a trip like this, and fairly cost effective.  I don't think anyone should come on a visit to the US without health insurance.  No matter how young or healthy you are, you never know what accidents might occur.

chrissandra reacted to Loren Y in The Journey Is over.....Finally!
Not as long as some have had, but Yesterday the 6th of April My wife took her Oath here in Las Vegas,NV, and marked the end of dealing with USCIS forever. Seeing the Naturalization Certificate was the most beautiful thing. Everyone here from the beginning November 2017 when I filed the K1, until now I would like to send out a thanks to those that have provided great advice, and allowed me to help others. A couple I married from VJ that also did a K1 just had their Citizenship test, and passed also. Their oath is the 11th of May. Knowing I was part of their journey from Marriage to Naturalization was rewarding also. I hope all the others I have married here from VJ also get to this point. It is so satisfying knowing you made it thru the war, won all the battles, and came out victorious. For anyone else out there, keep fighting, and don't give up. It is possible to make it out... a little rough for wear definitely, and probably with some lifelong scars and things that will haunt you forever, but knowing you came out on top is worth it.

"So, I would be re-entering the US 5 times in a time period of 7 months. Never for more than 90 days. All the while being able to prove to immigration that I am independently financially capable of not needing employment."

I think this is an overly risky plan.  You cannot live in the US without a proper visa. So many visits in a short time is playing with fire, imo.  Each & EVERY entry is at the complete, sole discretion of CBP.  If they even suspect that you are spending too much time in the US, you can be denied entry, and you can lose ESTA forever.  It is risky.

    A little progress.

I contacted the Federal body who regulates the particular field of work I am prohibited from by virtue of being "illegally present" in the US. I asked whether they regard an Alien paroled into the US as "legally in US".

They confirmed that their definition of legally present does NOT include a period of authorised stay pending AOS unless the i-94 is current. However they also confirmed that they consider an Alien paroled into US as legally present until expiry or revocation of such parole.

    Which answers my question, thankfully.

I asked the same question of GA driver services ( DMV ) They said that their defination of a person legally present in US and entitled to GA drivers licence was......

"An Alien whose status has been confirmed by USCIS Save program."

They totally rely on this Save program - not EAD, receipt letters etc. So, I guess it will totally depend on the wording of the reply from Save program -
"Illegally present" ( the reply ICE use for those in authorised stay re AOS )
    "Authorised stay"
"Paroled" ( If I get AP etc )

Hopefully the latter and the phrase "authorised stay" will reassure them !

I asked "If you rely on Save program to verify my status, why do you need to see my EAD and receipt letter for AOS application ? If you do not accept them as proof of status, why even look at them ?

I await a reply and doubt I will get one.

As of this morning - Save program shows the DMV request as still "under review" after 18 business days.

You said you are naturalized USC. So I would assume you have an idea what immigration really is.

You talk about getting visas like it’s a walk in the park.

I’m glad you have a lot of family and friends in India, but you are talking about immigration to the USA.
All new ballgame, all new set of rules. To get a visitor visa your girlfriend must apply, interview at the consulate, show strong ties to India, work, money…and most of all, she needs to provide proof she will come back to India…you have nothing to do with her tourist visa.

immigration - focus more on the required paperwork, marry, file, and hope your case goes smoothly.

to expedite a visa - another firm set of rules and requirements.

there’s no way around the legal process no matter how you ask and unfortunately separation from a significant other is inevitable.

What makes you think that she will easily be approved for all these visas you are going to have her apply for?

The spousal visa application will not give her a visitor visa.

There are no shortcut or loopholes.

In general, people who already have a visitor visa, can visit their spouse or SO. I also did the same.

But your spouse doesn’t have a visitor visa yet, and will most likely have a difficult time getting one approved.

My wife's I-751 had been pending for 40 months when we filed her N-400.  4 months later, both the I-751 and N-400 were approved in our combo interview.

I would file the N400. My wife had her I751 pending for over a year, just filed the N400 on November 19th this year online. All of a sudden....19 days after we filed the N400, I751 was approved without interview, and 5 days later had 10 year green card in hand. I think the N400 Bumped the I751, but it could have just been a coincidence.

Take it with a grain of salt, but I have read on several forums applying N-400 would speed up the I-751. It could be coincidence or its related, but thats how I read it.

There is no requirement to naturalize and no specific date to apply for N-400. You can live entire life as green card holder if you want.

My overstay was not what I would have chosen but circumstances did not give me a choice. Long story.

DL, job, etc you can still get.  Clearance, etc?  Gotta wait.  The OP was asking about a license, not security clearance.

Government jobs have stricter regulations, and that’s just a fact. Some, require citizenship, some GC and all will - always - conduct an extensive background check. There’s no way around that. Immigration is a lengthy process and patience is necessary.
