  1. It appears the I-130 contained some ambiguous information which led USCIS to question whether this was an Adjustment of Status case or a Consular Processing case. I suggest you submit the I-824 as directed by USCIS. Your attorney should know that, imo.

  5. By US law, everyone who applies for a tourist visa is already assumed to have the intent to stay in the US illegally. It seems, to me, that someone with your profile would have a difficult task to overcome that assumption. You can reapply (and hope a different CO evaluates your application), but I wouldn't expect a different outcome.

  13. No, it does not. https://iafdb.travel.state.gov/ is a search engine for places you can submit a passport application. CVS and Walgreens are just for photos.

  15. Yes. If they are tracking differently, delay filing any NVC paperwork or paying any fees at NVC until the other case is also at NVC. Then pay fees and submit paperwork for both. Also ask NVC and the consulate to schedule them together.

  18. If you have been DQ'd by NVC, that is the status of your case. You are in line at NVC until you reach the front of the queue there for your consulate. Contacting a Senator will not help. Here is the process: 1. Case is DQ'd by NVC. 2. Case then enters NVC queue for your consulate and waits at NVC. 3. Consulate informs NVC of available interview date for upcoming month. 4. NVC schedules interview when case reaches the front of the queue for that consulate. 5. NVC notifies person of interview date via email. 6. NVC then sends case to consulate. After the interview is scheduled, it can take several days to several weeks for the consulate to receive the case.
  19. If you file with USCIS, but live outside the US you can show evidence of intent to re-establish residence domicile in the US.
  20. DCF requires exceptional circumstances. Merely residing outside the US no longer qualifies. If you qualify, you can ask the local consulate to process your DCF case. Otherwise, you must file with USCIS.
