  1. You have 2 options: 1. File a normal I-130 and proceed. 2. Contact the consulate and request another DCF if you qualify. Don't waste your money on an attorney. The consulate has sole discretion in this matter. It doesn't sound, to me, as if you qualify for DCF as you have not stated that you actually have a job offer with a quick relocation requirement.
  2. Issued Visas cannot be extended. However, the consulate can, at their discretion, re-issue the visa if traveler was not able to leave for reasons beyond their control. If the visa expires, it will require a new medical, additional fees, and ,possibly, another interview. Contact the consulate and explain the situation.

  11. Odds are that consulate will not accept the case. They will likely tell you to file with USCIS or the consulate in residence country.

  22. If a person is out of status for more than 180 days, that person would face a 3 year ban after exiting the US. A year or more out of status would accrue a 10 year ban after exiting. Yes, the normal route would be consular processing and a spousal visa if he leaves. Now that he has overstayed ESTA, it is revoked. The best courses of action would be to find a qualified joint sponsor and file proper I-485, I-131, I-130, and I-765 packages asap.
