    Yes, Absolutely. Filing under the 5 year rule requires much less paperwork and evidence. My wife filed under 5 year rule...and we are still married.

    That is odd. A BC can be obtained in a matter of 2 or 3 days. Google birth certificate services.

    The key is what you WILL earn over the next 12 months....not what you earned last year. Suppose I earned $200,000 last year, but I lost my job last week? If I am now unemployed, my current annual income is $0. My tax transcript from last year would be irrelevant to my ability to support a new immigrant in the future.

    I think they will let you in. However, I think they are going to ask you to sign an I-407. Why not sign since you are evidently living outside the US?

    Return tickets mean absolutely nothing. They are not strong ties to home country. Lying to US immigration officials is a serious matter. They already know about you. They might think you are just trying to bypass the K-1 process.
