  1. Approved I-129fs expire after 4 months. That starts when it is approved at USCIS. The consulate can, at their discretion, extend the case in 4 month increments up to a year. One of the drawbacks of a K-1 is that it cannot be delayed long. If the consulate declines to extend the case, it dies, and you'll have to start from scratch.

  3. Good luck. Stick around a little longer. Maybe others will provide answers you find helpful.
  4. True. But they must, then, tolerate all the inconveniences of being a Green Card holder. What is she going to do if the I-131 is denied? Seems to me that a trip back to the US would alleviate some of the stress you now face.
  5. I can name one case, here on VJ, where an old (expunged, I think) case was not reported by the petitioner. The consulate denied the K-1 visa after the interview.
  6. Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 3-6 months) Spouse can not work until she/he receives EAD (approx 3-6 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years. Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises. CR-1/IR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US. The clock for citizenship filing starts immediately upon entry to the US. A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.

  8. In cases like this, I think they usually ask for the I-751 to be sent to the local office right away. I would also think there won't be an additional interview. Hopefully, your local office will wrap the whole thing up soon.
  9. I wonder if this can affect his Green Card? Especially if they did a look back.
  10. This is some progress. It simply means the petition is being processed. Regardless of when the I-130 is approved, it will be several more years before a visa number is available and visa issued. F4 Petitions submitted in Jul 2007 are just now receiving visa numbers.
  11. Get ready to see a South Park or SNL skit soon!!! Turns out the driver is even dumber than he first appeared. I have no sympathy for the driver.
  12. Generally, a Green Card holder cannot receive SS benefits after 6 continual months outside the US. **Moving this to the Off Topic forum as this is not an immigration matter***
  13. The State Department runs background checks. In a normal (non-DCF) process, both USCIS and the State Department always run background checks. This is normal. Hopefully, "issued" will be the status soon.
  14. It's $235 now. You click "Next", then "continue". It will lead you through the payment process.
  15. You do not need an FBI check. USCIS and the State Department do their own background checks. Visa Journey is the best source for immigration info....not group chats. Challenge them to provide an official written requirement. This is the pre-interview checklist for the Philippines consulate: U.S. Embassy Manila, Philippines - MNL (state.gov)
  16. The new fee schedule as of April 1 discontinued the free I-765 and free I-131 when filing with an I-485. There are fees for both now. G-1055, Fee Schedule (uscis.gov) Looks like your household size is 5.

  18. 1. No. He must take the oath of citizenship before he can petition a parent. 2. No, They are separate cases. His brother would take 20+ years.
  19. I have watched these guys for a year or so. They have some great techniques to get the best price on cars.
