koolgurl reacted to JFH in How do you prove ties to your home country when the CO doesn't ask questions?
He might have ties to Haiti but his ties to the USA are stronger. Love is the strongest tie. Cars can be sold. Houses can be sold or returned to landlords. Jobs can be quit. A new car can be bought. A new apartment can be rented. A new job can be found. But he only has (and wants) one girlfriend.
And what if the baby shows problems caused by zika virus? Are you going to stay in the USA? The treatment and care there is surely better than Haiti. So the CO is thinking "who would leave their girlfriend and sick child to go home?".
Unfortunately too many boyfriends/girlfriends/spouses have presented themselves as tourists at the border and then had an epiphany moment and decided their "very strong ties to home" that they took great trouble in demonstrating to the CO suddenly aren't so strong after all and can be broken.

Put on a CO hat and reread the answers he gave. Remember that all applicants are presumed to have immigrant intent. In the CO's eyes your boyfriend basically revealed that he is about to go to the US and witness a special event of his life that could cause him to change his mind on returning.
Now let us look at your case. Even you realize that it is better to have a birth in the US. How far along are you? You don't necessarily have to answer that but let's say you are 3 months. Your boyfriend "visits" with you for 6 months and right before you give birth he will just return?
Ok, now let's say you are 6 months. He will stay with you after the birth but would have to leave you behind until you and the child are ok to travel.
And what would you do if when your boyfriend enters the US and the POE officers only gives your bf a 2 week entry pass?
And let's say (God forbids) that there IS a birth defect. And treatment and help is readily available for you in the US. You would still return to Haiti? Or your bf would up and leave you because his entry limit is near.
And even though you are living in Haiti with him you obviously are able to live in the US for an extended period of time since you intend to have a birth here. Where will you be staying during your pregnancy and after birth? (Again, this is an example question to give you an idea of how it looks.)
With all of the examples I just gave you, the CO is looking at it as for a number of reasons be it a better life for the child or (once again God forbids) complications during your pregnancy, at anytime your bf can just remain in the US and marry you to get a GC later.

I believe you'll be wasting your time and money if you reapply in May. I also think you have burned the bridge with a B2 visa period. Reapplying this soon will show that you're desperate to come to the US which is not a positive thing. You also failed to answer the CO's questions truthfully and the fact that you have a "friend" in the US doesn't help you. It screams immigration intent. They have everything on record. You won't be starting over, clean slate next time you apply. Like I said, you'll be wasting time and money.

I'm willing to bet the friend in the US is a boyfriend and OP didn't mention the previous K1 so she didn't look like a risk. It's a shame; the CO seemed to have given her a couple chances to be honest.

If he applied for you, you simply speak the truth.
Just tell the consul it was a long time ago and the relationship did not work. No need to explain in details, as they do not need to know your life story.

Another fairy tale about a CO asking either zero or one question, then denying an application...utter nonsense...no interview would be conducted as described....total baloney. This 'client' was certainly asked several questions, and likely gave inconsistent answers to one or more of those questions, thus he never established his credibility....then, to make it look like it was the CO's fault that his application was denied, the client tells this tale of woe, trying to make it sound that whatever happened was not the fault of the applicant....who makes this stuff up?
When an applicant claims to be wanting/needing to go to some conference, the next several questions posed will be testing the applicant to see if the trip itself makes any sense or if the applicant has just responded online to the conference registration form (trying to make it look like the applicant is important or necessary for the conference to succeed) - my guess this is where the client fell flat on his face, unable to provide a coherent and believable explanation as to why his presence at said conference was so vital...

you cannot....not unless you first pay back the many thousands of dollars that US taxpayers spent on your delivery....your son's status as a US citizen will play no role in you obtaining a new tourist visa....you already ignored what was told to you (stay for 2 weeks), the taxpayers shelled out a lot of money, and now you want to be rewarded...it won't happen. Trust is hard to get, but easy to lose and even harder to regain. And B2 visas are all about trust. When a person violates that trust, merely saying 'sorry' or coming up with some excuse as to why the visa holder refused to comply with our laws and regulations or instructions won't restore that trust.

I am so sorry that happened to you.
Anything she can do, she will find out on her own and with the help and support of that family.
What you need to do is go to the police, file a report and go to a lawyer and divorce.
Seek support of family and friends to help you move on. I wish you luck.

Read the USCIS site by googling "fraud marriage to get a visa " or anything similiar to that phrase
and sorry, wish you could have been happy like the rest of us but i took 5 years to get to know my spouse and that is what it takes even if the person is local

    Sorry about your bad situation.
Nothing you can do about her immigration, she already has her green card (presumably a 2 year conditional one).
You can divorce her and she will be on her own for ROC (I-751).
Find a better girl next time but remember to get to know her well first.
    Or date locally

A very good and very often asked question. Your family will have to prove to the satisfaction of the US consular official at the interviewing US embassy/consulate, that they have significant ties to India such that they would return to India after their US visit is completed. Such ties could include, property, house ownership, current stable employment, etc. Each visitor visa applicant is presumed to have immigration intent, and must prove that they are not trying to immigrate to the US. A letter from a doctor, any documents from you, or any other invitation-type letter would likely have no positive effect on the visitor visa approval.

    Good luck.

She is telling you the truth about the employee health insurance. Adding just one person does increase the premium by a significant amount. Don't ask me why that's the case, it just is. If she doesn't want joint vehicle insurance, that's her choice, like the employee health insurance, the vehicle insurance premium will also increase if you add another driver. If there is an interview, she spouts off to the interviewer at the peril of the outcome of your case. Not every couple has a joint bank account. It's not necessary if you have other items to show how a couple is living as a married couple.

no CO with more than 10 minutes of experience will give you a B2 visa while your immigrant visa case is in AP....which means that the most likely outcome of a B2 interview will be a denial under 214b...which will not affect your future immigrant visa case (unless you foolishly commit some sort of fraud during your B2 interview)...
At best, your B2 application will wind up in the same place as your immigrant visa case....in AP...but no matter what, no CO is going to hand you a free pass to the US while the AP is ongoing.

Okay, then after you both get married in the US, you can file Form I539 to change your nonimmigrant visa status from J-1 to E-2 without leaving the US.
    https://www.uscis.gov/sites/default/files/USCIS/Resources/C2en.pdf
    https://www.uscis.gov/i-539
    https://www.uscis.gov/sites/default/files/files/form/i-539instr.pdf
If you read the instructions of the I539 and go to #5, it gives you specific instructions for dependents of E visa holders.

tell the truth, because if you don't, you will ruin your credibility....and that will mean that B2 visa will be a pipedream for the foreseeable future.
By telling the truth, you may or may not get the B2, but even if you do not, at least you will have told the truth, which could be helpful in many ways in the future.
Yes, some people try to avoid answering the question (if asked by the CO) and I suppose a few get away with it....but if you fail (by lying), you will forever be branded as a liar and no one will ever believe a word you say, even during a K1 interview.....just something to think about.

How do you define "know"? I don't think I will ever completely "know" my wife. I find out new and interesting things about her all the time, and we have been married close to five years. Do you mean "know", as in the Biblical sense, as I don't think you even begin to understand someone until you are intimate. I knew there was someone on the internet that found me interesting, and sent me a few pictures. We had many conversations over the seven or eight months until we finally met. She called a few times, but the calls were hard to understand and confusing to me. However, when I got off the airplane in her country, I had no problem recognizing her, and everything about her seemed familiar.

"Short" is completely relative, and some people might consider 4 years to be "a very short amount of time." Also, lengths of time are not directly comparable between one relationship and another, given the impact of age, geographical distance, honesty, maturity, quality/amount of communication, and many other factors. So, I'm not sure it makes a lot of sense to compare VJers in this way, especially since it's not clear what you hope to accomplish with this thread. (It kinda seems like you're hinting that 4 years is somehow superior to "a very short amount of time"?)

there is nothing, and I mean absolutely nothing that you can do to change any decision nor improve their chances of obtaining a B2 visa, should they reapply. Having a job does not guarantee visa issuance, nor does owning a house, as jobs can be abandoned and property sold....they failed to convince the CO that they would return to China....and you cannot change that opinion by writing letters, sending invitations, etc. No one has a right to a US visa.
No experienced CO would make a statement like the one given, that the applicants should not have revealed that they had relatives in the US...that is patently absurd. Besides, a cousin is not a close relative.

The evaluation process is partially based in the actions of others and PHL has a hi rate of family members who do not return and decide to stay n the USA. This is factored in to the decision. Sorry

Alas, you broke one of the cardinal rules of the visa process: Do not make any non-refundable, non-changeable engagements, reservations, plans until the visa is in your passport, and your passport is in your hands.
It seems that you have painted yourself in the corner, so to speak. Never fear, it isn't the first time it has happened and very likely not the last.
Personally, we opted for a courthouse ceremony. That being said, I am certain that you will be getting lots of possible viable solutions.

The Visa you got for 6 month isn't for a 6 month stay. You have 6 months of entry. How long you get to stay will be decided at POE(Port of Entry).
At interview did you tell them you wanted to stay 7 to 8 weeks?
If asked which I am sure you will "who will you be visiting?" Or "where will you be staying?", do tell the truth so it doesn't cause issue later.
Just be sure you leave before your stay time expires.
