    We were dealing with a similar situation. .While being a member or former member of a communist party excludes a person from immigration here,There are a ton of exemptions.Google " immigration communist party affiliation exemptions" read which ones apply to you, and include it in a letter with you AOS packet.

    So after 5 phone calls and countless hours talking to USCIS I took Harpa's advice and made an info pass appointment because my dad had received his green card but my mothers was stuck in a "background check" because of "bad fingerprints" In all of the phone calls I made with uscis, every IO I talked to said there was nothing we could do except wait for an indeterminate amount of time.
    So today at The infopass I walked up to the counter with my mom, gave the IO her passport, he looked through it and said" oh did she travel recently without AP?"I said "no, look at the dates." So he looked at the dates of travel and that we did indeed have the AP.Then he said your case went pretty fast but is stuck in a background check because there is a back log" .I asked what type of background check my mom was stuck in. he said "I am sorry I cant tell you that" I thought that was kind of weird.He said "I'm sorry but we cant do anything until the background check is complete, Have a nice day"
    At this point I could feel something was off, asking about the travel without even looking at the computer was sort of weird so I was persistent and asked him why my dad got through the background so fast since they did the interview together? He said he couldn't see my dads file, so I gave him my dads A # and the IO looked perplexed after he typed it in the computer. Then he said" wait here" when he came back he asked us to wait for an hour while he got the physical file.About 30 minutes later he called us back up and said" ok you should receive your green card in about 2 weeks". I couldn't believe it. I was floored.
    20 minutes later our status changed to "card being produced" online
    A few thoughts
    I have absolutely no idea what happened. I dont know how someone stuck in a background check can magically be cleared.I'm super happy its fixed though.
    If any one makes an appointment for an info pass, be super persistent, dont be scared it will hurt your immigration chances. Obviously there was some sort of mistake where either the files weren't linked, or a background came back clear and got stuck somewhere.Its also very obvious to me that unless they have access to the actual physical immigration file, not much will get done.

    While your correct that citizens inside this country are entitled to the protections of our constitution, people adjusting status are not. Harpa is correct that people who immigrated here after WW2 and lied about their Nazi part affiliation were stripped of their citizenship, and if they committed crimes were tried at the Hague, rightfully so. In fact their are Nazi hunters who still look for old Nazi war criminals for persecution for the atrocities they committed against the unarmed Jews.
    1 other point, while R and D are polling highest, The libertarian candidate is polling around 10%, so the "other" party's are starting to warm up, which is great!

    Haha, Loving prostitute I literally laughed out loud.
    It looks like it was approved, Online it says "case was approved" for dad although it does say " under review" for mom, but they said during the interview she may need to do the fingerprinting again because it didn't get done properly at bio metrics. as they had no issues with her application I suspect we will need to re do that part for hers to be approved.

    Wow...I mean just wow. You really shouldn't fear monger about things you know nothing about.
    OP you remain in the authorized period of stay until your I-485 is adjudicated. It is not a status, but you are authorized to stay in the United States by the Attorney General to await a decision on your case. Just have the NOA and your passport with you.

    OP you remain in the authorized period of stay until your I-485 is adjudicated. It is not a status, but you are authorized to stay in the United States by the Attorney General to await a decision on your case. Just have the NOA and your passport with you.

    I would submit the Canadian permanent resident stuff. It shows you intended to stay in Canada, recently. You ill be fine. this really wont be that complicated, it seems overwhelming at first but your intentions are all golden, dont worry about the optics. your good to go.

    Hi every one thought I would share what the AP entry was like while my parents AOS is pending.
    They arrived at SFO around 7pm, they went to the visitors line in customs. When it was their turn they were asked for their passports and AP card, then fingerprinted and escorted by an immigration officer to a separate room. they sat there for about 45 minutes. The immigration officer came back with the documents and said have a nice day. No questions were asked at any time. One note for future SFO travelers, They were escorted to the domestic side of the airport and never came out of the international terminal gate they were supposed to.

    So we ran in to this recently. I would suggest changing the address a week before you move. some USCIS mail went to the old address, luckily the new residents contacted us. If your moving from a house, leave a letter with your phone number asking to contact you if they get mail.Also go to the post office and forward your mail to your new address. It takes EAD about 5-7 days to get after it has been ordered for production.

    Ok cool, well my wife is from Russia, and we went through the k-1 process also. It took a lonnnnng time for them to finish the back ground check. My wife also has a very unusual name. The problem wasn't that some one had a similar name, but that the government is so slow and she was from a small town.( I'm sure you know all about this, I have been to Russia many times and if some one isn't getting money its hard to get anything done) and they hate sharing information with the U.S. in my experience.
    I would bet money that the background got hung up in some local bureau office.maybe having a relative visit the local office can get things going, or maybe even call the city where you are from to see if the background request got stuck.
    Just my 2 cents. I could be wrong but why not give it a try?

    Hi everyone I know there has been some confusion as to whether the I-693 has to be sent with your AOS application.I finally have the answer. I received a letter from USCIS yesterday(not an RFE) that says in summary:
    " While processing your initial evidence for AOS we noticed you either did not send the I-693 or it is incomplete. If an interview is required for your application bring the I-693 to your interview, if an interview is not required you will receive an RFE at a later date to send the I-693 paperwork. DO NOT SEND in anything at this time it will slow down your case processing."
    My wife's parents are required to have an interview as they came on b/2 visas. So we will bring the I-693 to the interview. So the answer to whether the i-693 is required at time of filing is, it depends. if your required to have interview, then no, if you wont need an interview yes it is required.

    Are you seriously implying that AOS petitions for people on b/2 visas is more scrutinized than for any other visa? Have you read any of the immigration laws that state that intent for immediate family relatives cannot be considered after they have arrive ? AND your implying that it makes it more difficult for others to get visas because some one decides after they arrive on a b/2 to immigrate ? where is your evidence for such a claim?Please cite it because I can back up what I am saying. It is really unfair for people like you to comment as a "platinum" member on someones application when your obviously just trying to discourage them, because what your saying has no basis in fact or law.I didn't realize there was a hierarchy to AOS applications Unbelievable.

    Winter, your concerns are legitimate for your friend. I think this happens often, but let me play devils advocate. Is it possible she fell in love, and he fell in love? I went to a far away country, met my wife, and asked her to marry me in less than 72 hours....That was 9 years ago and we are literally happier than we ever have been. I cant imagine my life Without her.
    Generally when people say things like "I have never felt so special or so wanted" its because they have intense feelings for the person. In my experience, women are especially sensitive to men "faking" feelings.
    As for the secrecy, Its really generally "taboo" in his society to meet some one abroad and want to get married quickly, mostly because of the" green card" issue. Evey single person she talks to about this new wonderful time in her life is thinking " He just wants a green card" I am keenly aware of this because at first, I felt it to from people I told. My advice? Be happy for your friend. Your showing your a good friend by caring so much.Time reveals all motives. Its a long process to get a green card.
    I have been to many many countries, every one is interested in American culture, Its an interesting culture to be sure. Don't get me wrong The percentages dont favor your friend, however in the chance that it IS real, dont you want to be the friend that supported her?
