AOS family based and communist party

Hello all,

looking for some advice on what to put in my application for spouse-sponsored aos from h1b to green card. I am from Spain and I am a member of the spanish communist party. Obviously, this party is not really looking to replace spain's current political regime with a stalin-type dictatorship but one of the questions on the I-485 is directly related to memberships like mine.

My question is basically to know if there could be a negative impact on my application and how best to mitigate it. Once again, i don't intend to overthrow the US government and go against the us constitution but i don't want to lie on these application papers.

Expect it to come up at your interview. Have good explanations ready for why you are a member of such an organisation, although brief googling around seems to reveal it as more of a mainstream political party in Spain these days, and not aligned with overthrowing governments by force any longer.

Day 341 (12/10/18) Interview was scheduled for 1/14/19

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We were dealing with a similar situation. .While being a member or former member of a communist party excludes a person from immigration here,There are a ton of exemptions.Google " immigration communist party affiliation exemptions" read which ones apply to you, and include it in a letter with you AOS packet.

I hope that works for you. Folks going through the US consulate in Guangzhou that have or had affiliation with the (Chinese) Communist Party generally have a tough road to go. They are often placed in AP for extended periods of time, while further investigation are conducted. The US government still considers CP membership a serious matter when it comes to immigration.
