Concurrent file for my father

Timeline

Hi! My father came here to US on a tourist visa. We decided to have him stay here with us , so I applied concurrent file which include I-130 and I-485 with a bunch of other supporting documents about 5 weeks ago, still haven't heard anything back from them. Does anyone know how long am I supposed to wait for the receipt of response? , his visa is expiring in September , I want to make sure he has enough time . Thank you

He's here on a tourist visa , and I filed to adjust his status to permanent resident ,it's called concurrent file, which mean I had to submit both I-130 and I-485 at the same time . I mailed those to them with the supporting documents about 5 weeks ago but I still haven't heard anything back yet, I was wondering if they received my mail or it's in process. The section you posted in originally was for people chasing a visa. You've decided to bypass that, making tourist visas harder for people from your country.

Call the USCIS and find out if they've gotten your case yet. Did you file a G-1145? Was the check cashed?

You might take it different way from what I understand, it's not like he's staying after his visa expired or anything , its a legal way to do it, and that's why I think they made that an option (I hope this doesn't sound rude).But yeah I called them but they kept transferring me to other department, I was waiting to talk to someone for like an hour and a half , I hung up, I'll try to call them again. I'm just curious if anyone have been through this . No unfortunately I forgot to file G-1145 along with it. Thanks for you response

I said nothing that implied it was illegal or that you couldn't do it.

Next time you call wait until they start babbling to you in spanish and say "english please" then when that person comes on ask to speak to an ISO, immigration services officer, (vs the CSR that answers the phone) aka tier 2.

Actually, it's overstaying by people on tourist visas that really matters in terms of making it harder for others. AOSing is no problem. (1) legal process (2) those who can AOS could have received immigrant visas (not taking into account possible overstay), so the end result is the same.

Oh it does. When people AOS from tourist visas the consulates in that country get more strict about who they give out tourist visas to. Why do you think there are so few countries with VWP or why it's so hard to get a tourist visa? Because the CO assumes everyone has immigrant intent. You have to prove you don't to get the tourist visa. So they believe you and the CBP believe you that you're not going to stay and AOS. Then you change your mind later because life happens. So, eventually the protocol gets tighter and tighter.

But that's off topic. I'm just explaining my previous comment.

It's legal to AOS because, as I said, life happens and minds are changed.

What NLR quoted in #8 is a known, public fact. Those who use B visa to enter, then have a change of mind and AOS, do set the bar higher for future B applicants.
