  1. If your income is low enough, you (not them) qualify for EITC. Of course EITC increases if you have them as dependents on your tax return.

  9. Yes, i130 by the USC. Their age and their parents' i130s are not relevant. The USC can file i130 for any siblings whether 1 yr old or 70 yr old at any time. No need to wait but it makes sense the parents, once become LPR, file petition for their children for relatively faster immigration.

  14. Technical glitch has created problems for several N400 filers by showing they filed one day earlier than the 90th early filing day. So until resolves that it's better to file several days later to be on the safe side.
  15. If your wife wants the GC under married name, just fill out the forms using the married name. The marriage certificate is enough for the new name proof. Regarding filing, if you file i130 online, include i130 receipt notice in the i485 package when mailing. OR mail i130/i485 all in one package. Don't forget to file for EAD/AP as well.

  17. Even if N400 interview occurs first, nothing to lose but only gain even if there's no combo interview. One saves the entire N400 processing time by filing for it once eligible rather than waiting for i751 approval first. Even if one files for N400 under 3 yr rule only after i751 approval but gets separated or divorced while it is pending, it will be denied and has to refile under 5 yr rule anyway. I don't see a point of not filing once eligible if one is planning to become the USC.
  18. So you are sure your USC spouse has never lived even for a year or two in the US at any time in her life before the birth of the older child. If she has, the kids are USCs already and uscis or the embassy might deny the petition/visa for them suspecting they are USCs. Otherwise, like others said i130 for each person is the way to go.
  19. So you already filed for the tax return. Just bring that and the previous one during the interview. The interview scheduling is not related to the tax return filing status.
  20. Even after getting preference treatment by the embassy in scheduling the interview, i truly hope you don't lose your immigration chance by yourself, you have no one to blame but you this time. Note that they cannot issue the visa until your medical is complete or you have approval for vaccination waivers. The visa must be issued by Sep 30.

  23. Yes, you can file it from Nov onward. Just don't file it online on the very first eligibility day. May be a few days or a week later to be on the safe side.
  24. No need to wait till NVC. You don't need to do anything. I already said your petitioner (not you) can send a mail to uscis to update your new address. I already mentioned why it's best to do it with the uscis rather than NVC for K1 cases.
