    I read this on my Google news feed....severely appalling!! 

    It echoes the frustration that each applicant, who is told to wait, is experiencing.

    I have researched cases in which USCIS was sued by immigrants with applications of Naturalization that was pending for 2yrs+ after interview was completed but was told they could not make a decision at that point in time.....and the court STILL gave them 60 days to respond to the applicant. Immigrants suing and winning against USCIS exists but it only seemed to happen when the applications passed 18mths....I guess that happened by the applicants' choice to file the lawsuit after much time has passed.

    The applicants filed a 1447b that could then be followed up by a Writ of Mandamus.....the crappy thing about that is the legal fees for this filing and the possibility of it NOT getting palmed off for the USCIS to reimburse you if the judge does not see the applicant as the "prevailing party". One case I saw had the judge agree with the motion filed and that the legal fees had to be repaid to the plaintiff in the amount of $25,500 by the USCIS.

    Every agent at USCIS contact center keeps telling me that I have to just continue waiting but the "within normal processing times" is so not normal!

    Nobody is acknowledging that the clock kicked back 2 years and initially when the receipt file date showed July 2019, it updated to July 2017.

    No Congressman/Senator/Attorney is willing to help or try to hold USCIS accountable under the Mandamus Act or even the Administrative Procedures Act which is what needs to be done! 

  3. The 12-36 mths is a glitch because it shows that for all field offices. 

    Processing times really depend on how fast the field offices handle the cases along with scheduling persons while practicing safe social distancing. 

    You are in LA.... they are slow 😕

    I was just over in the Jan 2020 filers group....someone posted that they called USCIS yesterday and was told that they will start sending out new interview notices from July 13.

    I think that really depends on the field offices because people are getting interviews and oaths scheduled.

    Some field offices are just dragging feet and no state rep can help because they tend to use the Processing Times calculator that USCIS website has and we all know that is grossly incorrect 🙄

    Hi,

    If you have a pending I-751 while you filed an N400, most likely it will be a combo interview. The rate for scheduling in NY is haphazard right now....some are getting oath ceremonies scheduled, some are getting initial interviews rescheduled and some are sitting  🦆  right now. It also depends on what part of NY your field office is located and how fast they are moving with these cases.

    First off, I'm very sorry that you've experienced this....it is not easy and I hope that you can find some solace in re-employment.

    Second, @Giovanna024 is right....your Naturalization application is not affected by your job loss because Covid is out of your control. Also, receiving unemployment benefits from the govt due to the pandemic DOES NOT affect your application either.

     

    Chin up....you are almost at the finish line!! 🏃‍♂️  :D 

  7. Just saw a post from a member of the N400 Facebook group who had his interview today at downtown LA. 

    He did his interview.......passed with flying colors.......got his same day Oath ceremony.....had an initial name change request on his application......got his name changed BEFORE they printed out his certificate....all WITHOUT a judicial ceremony! :o 

     

    So it just goes to show that USCIS can do all these things but they choose to go against the grain and make life difficult for most everyone trying to get out of the immigration process 😕 😕

    I would suggest requesting to speak to a Tier 2 officer. Unfortunately, most of the regular agents can only provide scripted responses because that's the info they are allowed to share.

    Apparently USCIS just wanted to play with my emotions. The letter just dropped into my husband's account. His interview has been rescheduled (third time) for the exact same date and time as the one they canceled last week. So in theory our interview is July 13th.

    It's things like these that make me wonder if you can sue the DHS and USCIS for emotional distress 🙄
