vscampbell got a reaction from Lemonslice in Getting US Visa for teenage daughters
Thanks! I've self published 6 novels and have many more in development. Some interest from the movie side but I'm holding off. I am only recently published, but the beta readers are very enthusiastic, my editor tells me she can't get enough, and a great publisher is nosing around, a good sign. I write adventure romance novels about a team of mercenaries that fight human trafficking. Subject matter is largely based on real characters and events; fictionalized, of course. I have had a good career in farming, construction, and business consulting and we have been operating a farming operation on leased land in the Philippines. Now we are in the process of buying farm land there. This is a complicated and I have only shared some basics to get my questions answered. I think this is a unique situation where these girls are family, known to us, have lived in the family for years already. They only have lived with their mom for a couple of years, before that she was overseas and now she's headed back to Hong Kong. Due to these circumstances they need someone to step forward and adopt them so they can stop being passed from home to home there. They are great kids, very smart and good students.

Hopefully all parties involved realize that the bio mom will not have any path to a green card via the daughters.

For I-130 F4 purposes, is the link to an unadopted bio-sibling broken after the other siblings are adopted?

No two cases are identical but the general situation is very common. You probably gathered that none of those participating in this thread was that surprised.

Assuming she is eligible she may want to naturalise, keep her options open.

We will go back and forth. Not sure of all details, which is why we are asking around. The number of people leaving the USA to live abroad more than doubled from 2019 to 2020. That trend is continuing. She came here to be with me and we always planned on moving to Phil as we have growing business interests there. I am an author so I can work from anywhere and if we stay in USA, which we might continue to keep a residence here, it will be down south somewhere. It depends on the details as they unfold.

My question started out as immigration but that time frame appears to be too long. I was hoping that it would be a more simple matter, at least to get a temporary pass, which I think is called a K4? We are just getting started on the US side of this. The Philippines side is expidited now that they have a priority to get all of these abandoned kids adopted. Yes, we know about the college visa and once we get there we will be exploring options. I need to return to the USA on occasion for various meetings and conventions (I am an author), but we planned on eventually being in the Philippines or another nation as residents anyway.

That was my thought also. We have the means to do that, so I think it's for the best and we have a lot of family there that has rallied around the girls to protect them while we make arrangements.

Seen this before. As soon as those kids get US papers, parent crawls back.
Additionally, it's a pattern that's keeps going on from the Philippines....handing over custody of your children to their Filipina aunt/ not writing dad on BC in preparation for adoption by US aunt in 5 years.
The other OP never came to update us if the link was reconnected.
Update us later.

My wife is from Philippines we never had a interview for AOS.
You could apply for AP as soon as she gets to the USA and maybe get it approved, maybe not.

When you apply for adjustment of status you also apply for advanced parole. Once she gets advanced parole, travel is allowed. It is currently taking 5 to 6 months for advanced parole to be approved

Advanced parole comes before the green card. You don't understand the process

She enters, you marry within 90 days, then file for AOS + EAD + AP as soon as you can after that. She can leave (and return) once she has AP. ETA: ~4-7 months on average.

This is why hundreds and hundreds of people are just moving their businesses to Asia, SMH. If my construction company was not location specific I would just leave. Never thought I would see the day when the Philippine government is LESS corrupt and broken than ours. I know an attorney that specializes in helping businesses move to Asia, he handles more than 100 every year.....

We have homes and businesses in both nations. we will travel back and forth to manage our businesses and spend time with each family. we chose the K1 visa because all of the research we did said it is faster and easier. Im just trying to find out what is the fastest process to allow us to return to Asia and still return. WE don't really care about her green card. Just the ability for both of us to travel back and forth. As I said, we have two homes in the Philippines and one here.

Well, let me ask this question.... what if we get the K1 Visa, have a ceremony in the Philippines then fly here and have a second one to satisfy the US Government. If we do that, it is not so important that we return to The Philippines until she gets her change of status???? We can manage our businesses from here for 6 months or so, and if needed I can make a quick trip there without her to deal with anything?? I'm thinking that this might be another option... but there are some weird marriage laws in Phil that come into play but I think we could work around that. Does anyone know of a couple that gets married there first after the K1 is issued?
