    I just got my Informed Delivery scans and NOA 1 is coming in the mail today!!!!
    I pray that they will actually deliver it!

    So, now even the mailman knows that my status has been extended 18 months...but do I care? No!  😅 alexpop and all others, especially in LIN, hope you get it this week as well, and at least before Santa comes.

    Did you ask them when was your biometrics scheduled for? I believe this is the most urgent thing, If they schedule your biometrics and you don't go, it may delay your case. Also, did you ask them why it is not tracking? Which website did you use? I recommend this one: https://egov.uscis.gov/casestatus/landing.do

    The RFE is either asking for evidence that you met in person and/or that you did not meet through an  IMB. I've seen the "circumstances of meeting" header for both cases.
     
    Just saying you met through facebook may have been insufficient for the IO...you normally don't just message a random person on fb and start a relationship. I think they may want more details to ensure it wasn't through an IMB.
     
    Also, they could be requesting evidence of meeting at least once within the 2 years prior to filing the petition, as required by IMBRA. What evidence of meeting in person within that timeframe did you provide?

    Plane tickets only show you bought a flight, not that you actually boarded it. Passport stamps would be better to show.
    Putting a date to a photo is very difficult. They want some hard evidence of meeting in person.

    @Hughlyn Again please read the form and instructions carefully and interpret literally.
     
    met in person during the 2yrs immediately before filing this petition. During means anytime from the date filed- 2yrs prior. Doesnt matter if it was 1yr and 11 months or 1 week. They are both DURING the 2yrs immediately before the petition was filed.
     
    describe the circumstances of your inperson meeting....Attach evidence to demonstrate you were in each others physical presence during the required 2yr period. 
     
    You are also combining 2 different issues. One is establishing you met in person during the 2 yr period. The other is establishing a bonafide relationship. Showing you were separated but not officially divorced is the latter.  (and yes- you can submit the 129f and state you met in person and began a relationship while still legally married. You CAN NOT however submit the 129f unless you are free to marry hence the attny statement that they can not deny you because you didnt file the 129f while married therefore ineligible is true but not your issue. USCIS did not state anything about you not being eligible to file because you were still married.

    OMG I cant believe you spoke to an attny and that was the response they gave you...actually I do believe it. Was this a 'paid consultation'? Probably not- so you got a cut and paste answer. If you send that as a response you will be DENIED and end up going back to the attny who will gladly charge you to take your 'complicated case'...  
     
    First- what your attny told you is correct but it is not the whole picture. Yes, they can not deny you because you did not file the petition while married. But uhh so what? What does that have to do with your issue? 
     
    You need to read the forms and follow literally. The questions on the 129f (#53 #54) says have you and fiance met IN PERSON during 2yrs prior and to describe the circumstances of your IN PERSON meeting.
     
    Meeting on FB is not in person. So you did not answer the question- hence the RFE and your proposed answer still does not address the IN PERSON meeting so you will be denied for not proving/describing in person meeting. Read the post above where debbiedoo said what she wrote. Notice the part about when they met in person and how your statement lacks such.
     
    USCIS will not make assumptions and will only acknowledge what you state (even if its obvious- they just wont connect the dots) you need to lay it out in simple terms. So you told them you 'met' (and to them met refers to met in person) so you met according to your petition June 17 while you were still married since you divorced Feb 18. 
     
    Change your response and include evidence of the in person meeting. Be cautious using that attny again.

    Congratulations on getting your green card. You don't need to do anything with the EAD and AP. It's automatically invalid as you already have your green card.

    Police certificate is needed during the interview. You will need to hand over the police certificate to the consulate officer during the interview. The consulate officer will include it together with other documents in your sealed package. The package that will be pass to the officer at POE.

    You need to submit either an IRS Return Transcript or the 1040 form that you filed in 2017 with the w2s and or 1095 (if any). Unfortunately, the W2 itself is not a tax return form.  You can get the IRS transcript here https://www.irs.gov/individuals/get-transcript

    The embassy would not issue a visa if it will expiry in less than 6 months. If passport is renewed you can take both passport to the interview.

    Instead of contacting the NVC you might want to reach out to the embassy and see what's the hold up. Maybe they put an AP but usually that is when they need something. What was the last thing they told your fiance?

    @Coke987 There is a tremendous amount of speculation going on here since you do not actually know what was submitted. Im also somewhat surprised that the phone rep actually gave you any information at all about HIS 485. I can understand them talking to you about a 130 that you filled out (which apparently you never did) but they should not have discussed the status of his 485 with you. 
    Anyway there are many ways for someone to be eligible for adjustment of status (485). Most require an underlying petition (like 130 family or 140 employment) however there are a few odd categories that do not need an underlying petition. You can review these 2 links to see if anything stands out as something he may have used to qualify to file the 485 besides your marriage (you filing a 130)

    Regardless of what you figure out- the ONLY way for you to stop the process IF it was based on marriage is to submit a letter as described on page 1 I think basically saying I am withdrawing the 130 and 864 submitted. If USCIS has no record of you submitting those forms or his process is NOT dependent on you they will just ignore it- simple as that. So just mail the letter and focus your attention of figuring out what you need to do in your county to divorce a spouse when you do not know their whereabouts.

    Thank you. I just figured that the fact that we will show a renewed passtport because the other expired enough to prove how long he has been a citizen since that indicates he had the other one for 10 years

    Since both of his parents are US citizen when he was born then his birth certificate is an enough evidence of his citizenship. I don't see this as a conflict on the requirements neither is his renewed passport.

    I'm with you. OP should first call and inquire about the status of the AOS case to because it is most likely approved or denied at this point and in both cases there is nothing she can do.
