Daily Update on Biden Tanking America (Part 2)
Dashinka replied to TBoneTX's topic in Current Events and Hot Social Topics
Why is there never any accountability when Democrats are in power? Blinken should have resigned the day after the Afghanistan airport attack. Can anyone point to a foreign policy success from the Biden Admin? Antony "Bloody" Blinken's Awful, No Good, Very Bad Day Mast also used his time to counter Secretary Blinken's testimony that regrettably, there was nothing that could be done to prevent the death of the 13 servicemembers at Karzai Airport. The receipts Mast cited to rebut Blinken's claim? 26 State Department staffers who previously warned Blinken what would occur if the same course of action continued. https://hotair.com/generalissimo/2024/12/12/antony-bloody-blinkens-awful-no-good-very-bad-day-n3797817 -
CR1 - Job Offer USA
Dashinka replied to users1998's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
I agree, a job offer for the intending immigrant is highly unlikely to be the basis for an I130/NVC/Consulate expedite unless you can show a definitive and severe financial loss to the company. Good Luck! -
To be fair, the GOP had complete control of Congress during 2017-2019 while Trump was in office. The Dems did not regain control until after the 2018 mid-terms (2019), so we cannot say Trump did not get these changes in place just because of Democrat obstruction. Travel bans from the countries listed were looked into by the Obama administration and it was due more to the inability to get any information from those countries related to the intending immigrant than anything else regardless of how the MSM spun it as a Muslim ban. Yes, many of those countries are overwhelmingly Muslim, but some are not, and other even more Muslim demographically were not included. So tell me how the Democrats propose getting countries like the DPRK, Venezuela, Iran, etc. to cooperate with US immigration background checks? I am not sure what is wrong with enforcing existing laws, is it better to gain office and ignore duly passed laws? If the laws are wrong (many often are), why not pursue changing them? As to merit based immigration, or increased RFEs, again, what is wrong with that? On the mandatory interviews for K1s, AOS, or ROC, again, what is wrong with that? Back when my wife and I went through AOS under Obama, couples that were required to interview were getting the GCs 2-3x faster than those that received a waiver notice. It was so bad that members here on VJ were actively asking how to switch an interview waiver to an interview. My wife went through 3.5 interviews (I only count the ROC interview as 0.5 as it was an N400 combo and lasted less than 5 minutes). There are always debates as to how difficult it should be to become a USC via the N400. Honestly I am not so worried about that as most folks filing an N400 have a better grasp of US civics than those born and educated here particularly those that go through public schools. I do hold a different opinion relative to the incoming administration with family based immigration. In my opinion family based immigration is one of the best ways to get the best, brightest and hardest working legal immigrants here. Now in this case, Congress needs to act to open up the numerical limitations, and cut out the country specific limits. It should not take 15+ years to get a GC or nat. certificate just because someone is from India or Mexico. Overall, I don't expect much to change as Congress likes to use immigration as an election time issue much like they used abortion for 50 or so years. Things may speed up at USCIS as there will be less focus on the non-paying customers crossing the border illegally (assuming Trump and Homan can regain control of the border), but time will tell.

CR1 - Job Offer USA

Just to clarify, once you get your spousal visa you will enter the US as a green card holder, there is no adjustment of status. Good Luck! -
CR1 - Job Offer USA
Dashinka replied to users1998's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Certainly, but is the company willing to wait for 12-24 months for you to get your spousal visa before you start working, or will this be a remote job you can start while awaiting the process. Job offers for the immigrant spouse can help when someone comes over on a K1 and is awaiting employment authorization, but a job offer may not mean much in pushing your I130 along. All you can do is request one. The reason I ask if the company is willing to sponsor you is sometimes that is a faster route. Good Luck! -

You can always try. Is the company willing to sponsor you for a work visa? -
Adam Walsh Act Waiver for a juvenile crime?
Dashinka replied to jems921's topic in IMBRA Special Topics
Try searching AWA Waiver here on VJ as there are some stories (I attached a successful case). This is generally lawyer territory as it is my understanding that even expunged records show up on FBI checks. Good Luck! -
Been reading a bit about this new tactic by the worshippers of the church of climate change. It will be interesting to see how all this bureaucracy is ignored. I do love the headline writers from the Guardian and their progressive bias. Obviously it wasn't just the US arguing against this. Fury as US argues against climate obligations at top UN court Australia, China and Saudi Arabia – major fossil fuel economies and among the world’s worst greenhouse gas emitters – also argued against legal accountability that developing nations are pushing for. After years of campaigning by vulnerable nations and the global climate justice movement, the UN asked the ICJ to provide an advisory opinion on what obligations states have to tackle climate change and what the legal consequences could be if they fail to do so. More than 100 countries and organisations are testifying over the course of two weeks, and many hope the hearings will elevate science to the forefront, ensuring international law reflects the realities of climate breakdown and the urgent need for transformative action. https://www.theguardian.com/environment/2024/dec/04/us-climate-crisis-legal-court

That is always a tough question as the statistics are always so fluid. Most denials can often be overcome eventually, so is that counted as a denial, or as an issued visa. Add to this is the fact that the process bridges multiple government agencies, and each one could be the source of the denial i.e. was the I130 rejected by USCIS, was the case rejected at the NVC stage, or was the visa application denied by the DoS? I cannot find specific numbers, but I expect completes case with plenty of evidence would be a fairly low rejection rate. Good Luck!

Can you imagine if Old Corrupt Joe stayed in the race and potentially won? Scary. -
Adjustment of status

When did you file the package? The EAD/I765 can take some time to process, anywhere from 5-8 months. Good Luck! -
K1 visa application
Dashinka replied to Mahned's topic in K-1 Fiance(e) Visa Case Filing and Progress Reports
Each petition is separate and are processed at their own pace. There are a lot of factors involved at the petition stage such as which service center gets the petition, need for a background check of the petitioner, and mundane items like a USCIS clerk being out or something like that. One thing with immigration is that patience is a virtue. Hopefully your petition will process soon. Good Luck! -
Coming the US with my spouse
Dashinka replied to saied's topic in Bringing Family Members of US Citizens to America
First or at the same time based on my readings. The only issue arises when the intending immigrant arrives first, I remember a story of a couple where they were both arriving on the same day, but on different flights and the immigrant spouse arrived first, it was a headache. I do believe there are exceptions for spouse of active duty military members or contractors on official orders. -
DCF in Cairo, Egypt
Dashinka replied to ArwaE's topic in Direct Consular Filing (DCF) General Discussion
Yes, take a completed I864 for you and also one if you are using a co-sponsor along with all the supporting evidence. Also, bring a copy of your BC and your parents marriage certificate. Basically bring all the information you submitted for your mother's petition. Good Luck!
