Second degree manslaughter can be a lot of things like a DWI causing a death, selling drugs causing a death etc. Again, no need to elaborate here, I just mentioned it as it will be a sign of his honesty.   9. I went with my wife to her interview primarily to support her, but also because we had an I751 pending as well. We never received any notice of a combo interview, but when the IO came out for my she asked if I was there. I was invited back for a very brief I751 interview (basically just reviewed the I751 form, and we added a copy of our most recent tax filing), then I was escorted back to the waiting area and the IO proceeded with the N400 interview. I echo the recommendation that you should both attend. Good Luck!

  11. You don't really need to do this, as just not showing up for an interview would be sufficient. That being said, you can send a letter to the current office, but you will need to get that information. You can also send a letter to Nebraska referencing your spouse's A Number and case number, and maybe it will be merged with the case file at some point. After that, it is all up to your estranged spouse to complete their process. Good Luck!

  15. So the co-sponsor is married and also has another I864 out there. That would make a household size of 5 (assuming no other dependents), so $60k should be enough. It is a good idea for your brother’s spouse to fill out an I864A, and he should probably get an I864A from his co-sponsor’s spouse even though he is retired. As it is best to have them and not need them, then to need them and not have them if the consulate requests them. Good Luck!

  17. Technically, your K1 visa expired when you entered the US, and you are referring to your I94 and your authorized stay. That being said, there is no deadline to file the AOS package, but you are doing it right to get it in as soon as possible while you still have a valid I94. You sent your package a little more than a week ago, I would give it at least another week before worrying there is something wrong. As to changing your name, if you have an interview, you can request the IO make those changes at that point. If you do not have an interview and eventually plan to naturalize, you can make the change then. Good Luck!

  19. OK, so the withdrawal route might be worth the risk. Have you talked to the consulate as @Redro suggested to see if they would entertain a DCF if you withdraw the I130? Here is the thread of the person that went through it recently (it was very complicated), and it appears they talked to the consulate ahead of time. Good Luck!
  20. No minimum amount of time, enter the US, get your visa endorsed and you are now a US LPR albeit with a temporary proof (endorsed visa). The only issues I saw with that recently was when a couple entered via land and somehow insinuated to the CBP officer that they really did not plan to reside in the US. This was a foreign spouse from Canada (sorry, I don't have the link), and it was an interesting story. That being said, quite a few folks need more time to wrap up their lives before moving to another country permanently. The only thing I will add is you USC husband needs to enter the US ahead of you or at the same time. I saw a story where the spouses were heading to the US, but from different parts of the world and the foreign spouse with their IR1 arrived first, so keep it simple. Good Luck!
