    I'm very sorry. Sadly by the timeline it looks like this was her intentions all along. Sadly for her she screwed up and will not have a legal path to stay. This has happened many times if she hasn't figured it out yet you are her only path to stay. When she realizes it she may start begging you to take her back and work on things. Do not fall for this. The minute she gets the GC she will be gone, that is if she stays long enough and doesn't set you up for a false claim of domestic violence.

    Sounds like you really know the answer and are looking for confirmation, a not practical plan and you will be the one picking up the problems when it falls apart.

    I don't think you are understanding anything we are saying. No one said she had to go to Florida to divorce. Her divorce in her country works.
    What we were speaking to was the lie that your friend got married and filed a K1 which is for not married folks, because it was faster.
     
    If she filed for divorce and it was granted that's all she need to. She is divorced.

    Since your friend is next to you please clearly explain the order of events. I'm pretty sure we are all reading this right but best be clear form  the start. 
     
    1- Friend married, did not apply for CR1 but instead applied for a K1 while already married? 
     
    2- Or was the friend not married when she got the K1? 
     
    Then the part of married twice are you saying she got married in her home country and the US after the K1? 
     
    3-If she has been a USC for 20 yrs who then came in on the K1 15 yrs ago? The spouse that she never AOS and he left? (I think this is how it went but please clarify) If so than the ex is back in his home country right. So no green card
    for him and no mess for her. I would double check that there are no other issues with a lawyer since the ex left and did not gain any other benefits. 
     
    If #3  is the way it went down then the divorce in her home country is valid as the first marriage was the only valid one. No need to go to Florida and do another.

    She can marry a permanent resident, but she won’t be able to adjust. Permanent resident will be able to petition, but not to help her adjust. She will have to go home, face the overstaying penalty by several years’ bar to begin with.
       Only by marrying a usc the overstay is forgiven and AOS is possible without leaving the country.

    Had a Colombian girlfriend. Along the way I learned that she was illegal. During a casual discussion about immigration, she revealed that she was 100% familiar with the ole battered spouse trick. A few weeks later she started pressuring me for marriage. I dropped her off that night and never spoke to her again.

    Hi All,
     
    Just heard back from my immigration attorney regarding this matter. She basically half confirmed this. She said there has been a change on USCIS policy that they are going to interview all I751s, which is why the cases are transferred. But as we see earlier, they didnt interview Tcarrol. So I think that yes, cases are transferred but not necessarily we are all going to be interviewed.

    The marriage failed...just divorce and move on. Whether or not he wants to stay in the US or not is his choice and his choice alone...what you want has no say in the matter. There's no cause to suspect fraud here. He should be able to ROC by himself fine.

    We had a stokes at our AOS interview, were separated and asked about 50 or more questions each.
    We were asked everything from general questions to very specific questions.

    How much money has he send home
    Names of siblings
    Interaction of me with his family
    His and my previous relationships
    Why I ended my previous relationship from about 9 years ago
    Intimate sexual questions I am not going into here 
    Do we attend church
    Were he has friends
    Trips taken
    What was the wedding night like, what did we do 
    Who pays when we eat out
    What do we have in common
    Who handles the finances
    Who is more dominant
    Why did we engage on the 1. trip
    Does he have kids  

    We met 2009 online.
    We met face to face 2010, engaged.
    Filed K1 = 16 months in AP, visa refused, petition returned.
    5 trips to visit him.
    Second K1 filed,front loaded, #25 pounds of evidence, approved 2014, married.
    Filed AOS May 2015, lots of mingled evidence.
    Interview Sept 2016, stokes, went well.
    Home visit July, 2017, went well  (thread title = Surprise home visit, AOS). Investigators came from TX, our field office backlogged.
    Numerous service requests, senator inquiry, Ombudsman throughout the entire journey.
    Case sitting on IO's desk waiting for review from home visit according to service request, out of security checks.
    Waiting, not risking WOM.
    Happy for 8 years, 3rd wedding anniversary soon.

    Red flags perhaps  = USC naturalized  / USC had previous K1 and broke off that relationship 9 years ago / trips to Turkey both of us /
                      
    In a nut shell, they will ask questions on whatever your red flags are, whatever they do not like, to see if you come up with the same
    answers. We had slightly different answers on stuff that didn't matter, on about 2 questions. IO said she will wrap up the case in 2-4
    weeks, it turned into a home visit almost a year later still waiting. There was a boat load full of quality evidence from 2009-current
    with our K1 and AOS.

    I'm a July 2017 filer and the wording on the letter I received is crystal clear:
     
    "Your conditional resident status is extended for a period of one year from the expiration date on your conditional resident card."

    100% correct in everything that has been posted by mindthegap.
     
    When USCIS gets a notice that the couple is separated or pending divorce they send an RFE asking if you want to switch to a waiver petition. Thats probably what the notice is thats on its way or already sent from USCIS. If she is unable to get this piece of mail she needs to contact USCIS to get a copy sent to her updated address. They dont simply terminate your status when one party removes themselves from the joint ROC

    What is all this terminated and 90 days stuff? 
     
    Her status is not terminated , only the joint aspect of the existing petition is - she just has to add a waiver (divorce, abuse, hardship or whatever) to it

    The US citizen spouse cannot withdraw the petition.
    They can withdraw themselves from the joint aspect of it - meaning a waiver and an interview will be required but they cannot totally withdraw a joint petition. 
    The alien can then add a waiver to the existing petition converting it to a solo I-751, and no need to refile from scratch 
     
    Don't visit the embassy - get back to the US ASAP - and remember that LPRs have the absolute right to a minimum of a hearing with an immigration judge , should they encounter any issues at the POE.
     
    When they are back, go see a divorce lawyer, as divorce paperwork will need to be filed for a divorce waiver, although quite honestly, I reckon this would qualify for an abuse waiver with a competent lawyer behind it..

    If I do this, will the police report be held against her if she were to apply for immigration to the US later?
    Because so far the two actions below don't seem very incriminating:
    1) I withdraw I-864, no questions asked, no interview, no need to disclose what happened.
    2) No-fault divorce (It seems that all divorces in CA are no-fault), again, not in-criminating.
