    You are going to qualify based on your current income, not any tax return.  Current income is you gross pay for a pay period times the number of pay periods in a full year.  Your updated affidavit should carry the day just fine.  You can add your equity in your primary residence, but it will not actually be considered, as it does not fit their definition of "liquid" per the instructions.

    Civil documents such as the police report and birth certificate are for the foreign beneficiary. See https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html for the official requirements. As the USC petitioner, steps 4 & 5 apply to you. This includes the I-864, your proof of US citizenship and US domicile and marriage certificate. If you or spouse were previously married then a original divorce decree or certified copy must also be uploaded which shows the dissolution of the previous marriage.

    You are fine with the divorce decree issued in the state of Georgia as you submitted in the I130 and she can take a copy of it to the interview.

    You don't need a letter from a lawyer to explain.  You'll have a receipt notice.  If she didn't have sufficient ties to Indonesia, she wouldn't have gotten the visa to begin with.  A four month visit pretty much indicates she has no urgency to return to Indonesia.  That she's in the process of immigrating to the USA, negates the assertion it is important for her to return to be with her family in Indonesia.  I recommend a shorter planned visit with a return ticket date consistent with having a business to attend to.  She'll bet a six month stamp  anyway.  If she decides to extend her stay, that's really no problem, as long as she doesn't try to come back too soon.

    All true but not all is doom and gloom.  The fact she's already visited three times without abusing her visa counts a lot on the positive side.  We're just pointing out what are week and strong points in your explanation of her ties.

    Looks like you'll be facing some extended separation while she is not employed.  Where she lives and how she is supported during that separation is something you will have to work out.  How tough that will be depends on your circumstances.  I think it would be futile to apply for a B visa.  She can visit using ESTA, if she hasn't already abused that privilege by spending more time in the USA than out.  She may well be able to visit more than once, depending on timing.  You have some choices to make regarding her lodging and employment, but those choices are unlikely to be solved by her being in the USA for any extended time.

    Not sure why you think they are at NVC stage.  He asked about USCIS.  Relationship evidence is definitely advised when filing the petition.  It is mentioned in the instructions.  "Meeting requirements" apply for proxy marriages and K1 visas only.  If not a proxy marriage, the marriage certificate is all the evidence they need of legal and lawful marriage.  The other evidence is about the relationship.  Instructions list categories of evidence to add, and say the petitioner "should submit one or more....".

    I always answered according to what the status was, so this went from “visiting boyfriend” to “visiting fiancé” to “visiting husband”. 
     
    The letter will not really mean anything, and won’t guarantee that she’s not going to overstay or adjust status, so I see no benefit in that. 
     
    I would for sure do a shorter trip, being able to be away from your life for months at a time does not scream strong ties.

    His attempts to get a student and visitor visa, will tend to counter your evidence of bona fide relationship.  There is a very good chance that at least the fact he is seeking a fiancé visa, will become known by some of his associates, during the security check stage after the visa interview.  Very possible YOUR name will be mentioned during the security check stage also.

    It is permitted, but if she’ll be admitted by CBP is another matter and will depend greatly on how strong her ties to Indonesia are. Don’t have her visit for the max amount of time because that doesn’t show great ties. Does she have a stable job and life in Indonesia? 
     
    I was able to visit the US while my I-130 was processing but had short visits of up to 2/3 weeks every 3 to 4 months and that travel pattern never caused any issues. I had a stable job and life in the Netherlands.

    If you need to update your I-864 with your latest tax return information, surely do so, but yes, you can ignore that message.

    Yes, LBC for Philippines if available.  Otherwise DHL is fully reliable and less expensive than FedEx

    Yeah, no need to mess with the Consular Unit.  Deal with it at or after US Entry.  The ten year green card is not determined by what the visa says.  It's the entry date that matters.  Yes, it was a mistake, but NOW is not the time to correct it.

    What did the review note say exactly?  If you notice the words "may" and "Consular Officer will decided" just ignore it.

    I recommend carrying original I-134 to the interview, and for the beneficiary to have a hard copy of everything with them for the interview.

    As you carefully read instructions, pay special attention to words like "if", "and", "or" etc.  They are there for a reason.  Interpret literally and answer accurately.  You asked about things that do not apply, based on missing an "if".

    so,  what language are the documents in?
     
    flight itineraries do not prove a trip was made/  boarding passes do
    sending proof of western union monies is not a good idea  / may appear 1 is dependent on the other for money

    If you earned enough to meet the filing threshold, you must file back taxes for the 3 most recent tax years.  All US citizens and legal residents are required to report world-wide income regardless of residence and/or work location.  Your case will not proceed beyond NVC until you provide evidence of tax filing (if required to have filed).
     
    This is close to correct.  You, as primary sponsor, must file an I-864 with supporting documents, and you will need a qualified Joint Sponsor to also submit an I-864 with supporting documents unless your qualifying foreign income will continue after re-locating back to the US.  Remember, the minimum income level does not mean accepted income level.  The Consulate officer could require a higher level based on the totality of your situation.
     
    Unfortunately, that ship has sailed.  Since you have already filed the I-130 with USCIS, you no longer qualify for DCF. 
     
    You will have to either show proof of concrete steps taken to re-establish US domicile, or you must move back alone and establish domicile.
     
    In summary, you have 3 areas to work on:
    -Taxes
    -Qualifying income or well-qualified Joint Sponsor
    -Domicile
    Each of those is a show stopper at NVC and the Consulate, and it appears you are rapidly approaching the NVC stage.

    If you are in a US city that has a LBC office then that is by far the best option.  It costs us like $12 and gets delivered in like 4 or 5 days with full tracking.  If you are not in a US city that has a LBC office, I would probably go with DHL.  I previously had a poor experience with UPS in the Philippines and probably won't try them again.  I haven't personally tried FedEx there so no real opinion good or bad.
