    You said you bought an apartment in Boston. Visitor visas are not for the intent to stay and sorry to say but if you bought a place to live it looks like you had no intention of ever returning home. Just because family is here does not mean automatic approval for you to stay. I am sorry to hear of the struggle, but I am not surprised. You can try the things suggested so far, but also know there is a good probability you may need to wait a good while.

    Um...the large of users on this board had to wait for their fiance or spouse while doing US immigration. Why do you consider yourself to be more special snowflake than any other people who are also waiting for their loved ones? I suggest you go home, apply for a CR1 visa for her, and wait for it, like everyone else.
    As for prolonging a visa to France, I have no idea. This would be better addressed on a French immigration forum. I will tell you that it's highly inadvisable to overstay your visa. In the US, this bans you from visiting the country in the future. I don't imagine that it's all that different in other countries and if you want to visit France in the future with your wife to see the grandparents and friends, don't overstay.

    I have been separated from my hubby for 10 months now. I had to come back to the US without him because of my job and he is unable to come to US because of the country's strict visa rules . Everything will be fine.
    Like the other poster said...be sure to read EVERYTHING well MANY MANY TIMES before submitting. My own process is now probably delayed about a month because i forgot to read one section of the NVC visa processing where each country's consulate has SPECIFIC ADDITIONAL requirements in addition to the general requirements or the NVC stage of the process.

    Anajnic, unfortunately OP got bad advice before interview - and she is striving to climb out of the hole with uscis. are YOU helping her out, or are you sure that the same friends who let her down once before, understand the USCIS procedure, or did you get her an attorney? Why attack me all of a sudden, did you see the preceding 5 pages where I was the only one who kept her topic alive?

    Well first of all, entering on vwp with intent to adjust status is fraud, it doesn't matter that people have done it successfully it is still fraud and no one here on vj will tell you to go ahead with it. Yes cr1 will take time but at the end it is worth the wait and you can still see each other while waiting.

    Although you will hear reports of people that do that successfully and hide their intent, IT IS VISA FRAUD to stay in the USA after getting married on VWP, if you entered with the intent of staying. No one on this board will or can advise you to do that, as it is against the law. It's also, apart from being illegal, very likely to cause serious problems for you: if USCIS determines that you entered on VWP with the intent of staying, you will earn a LIFETIME ban from the USA and will never be able to visit your fiance again. You take your chances, but I would never ever in a million years risk that. Don't do it.

    If she is your step-sister and your mum is your mum, that makes your step-sister NOT her daughter, and not your sister, biologically.
    Therefore there is no path for you to bring your step-sister, but you could bring your mother.
    Your mother could not petition a child that is not hers. If she is not married to the father anymore then no petitionable relationship exists between her and your step-sister... unless she adopted her.
    So, are you sure you're using the right term? How is your "step-sister" related to you?

    Nothing to worry about. Ever since they started this new redirection of our cases to local USCIS some petitioners have been asked in for interview.
    So just take ur evidence and go. Good news is that many get approved on the spot or shortly after.

    Same answer as the OP was given. None of us can know what your RFE is about. You have to wait until you receive the letter from them in the mail and see what they are asking for. You can go over all your forms and documents against the checklist and see if you forgot anything, like a document that is needed, to check a box that needing checking, or a signature somewhere. You might be able to see what you think the RFE will be about before it arrives, but still never really know until you read that RFE letter.

    Cruel? Maybe it is hard to hear the truth, but that is what I see people offering here... honest answers. Are they all put delicately? No, but I do not think any of them are "cruel" either.
    The way the OP came in with the attitude of " my parents are so well invested in the USA and my brother is a citizen-it's no way to treat me" for something he did wrong, especially saying he bought an apartment when he does not have a valid visa to live here, much less a valid visa at all kind of begs for the answers of you need to understand the way the system works, and get help because the way you handled it is not in your favor.

    Absolutely family comes first, and that is your choice to make. Keep in mind that a greencard holder is supposed to spend more time inside the USA than outside. If you spend longer than a year outside the USA, your greencard will be taken away unless you have a re-entry permit, which allows you to be out for up to two years with good reason; you do need to apply for it before you leave, and of course without your business, you may not have the financial means to sponsor your wife and child into the USA.
    In short: Once they work on your case, an expedite can make them work faster.
    They are not working on your case, they are waiting for your number to come up.
    A greencard holder's waiting time CANNOT be expedited.

    You missunderstand what can be expedited. Even if you had the best reason in the world for expedite, the waiting for a priority date (currently about 2.5 years for spouse of a greencard holder) CANNOT be expedited. What can be expedited is the actual processing- ie for a US citizen it usually takes 9-12 months to get a spouse here- that is the actual processing of the case. That part can be expedited with good reason, such as terminal illness or impending deployment with the US military.
    Again, I understand wanting to be with your wife and child, but remember it';s not only your business on the line- by leaving the USA for an extended period of time, you also risk loosing your greencard.
