Sure. The 864-type forms do not ask about bankruptcies. So long as they qualify based on income/assets, and their payment obligations on the bankruptcy agreement don't put them below the necessary amount based on household size and/or the assets they would use to qualify are not part of the bankruptcy, you should be fine.

Sometimes the lack of response is simply because it is a question that might not easily be answered. Some are simple to answer because it is really common. Some are so much harder. Don't take it personally if you don't get a big response to something. I would just think it's something not as well-known by those who would be available to answer. That's just my opinion.

Bankruptcy is irrelevant, consulate looks at income.

Agreed! I know members who continue to post, advice and assist on regular basis and would take offense if they read a comment which indicates that they are not being appreciated. I am thankful for all the help I have received over the years from VJ members. Also, have made some darn good friends along the way. Let us thank all the members past, present and future who are dedicated to helping others through their own VJ experience to make someone else's journey less painful, confusing and frustrating.

No, a bankruptcy filing, under either Chapter 7 or Chapter 13, does not prevent you from sponsoring family for immigration benefits.

When you sponsor a family member, you need to file an I-864 Affidavit of Support. With the I-864 the Government wants to make sure that you earn a decent income (125% of the Federal Poverty Guidelines), and it determines this by looking at your Adjusted Gross Income (“AGI”) from your recent tax returns.

So the I-864 cares about your gross income, not about how much you spend and your debts. Filing bankruptcy does not affect your gross income, so filing bankruptcy does not change what you report on the I-864. Filing bankruptcy helps to *reduce* your debts and therefore actually increases your net income, which is a positive thing!
