    Perhaps those "correcting" the five month quote should read a bit closer...poster said "...it should take no more than..." and that "Probably it will get through quicker". Both statements are, to my understanding, correct and both are consistent with cited wait times of 2-3 months (which are individual experiences and may or may not be reflective of the mean).

    I personally don't believe you will be successful claiming move expenses - particularly because of the timing and the intent of the move. Educational expenses...maybe. That said you need to balance cost and benefit. You claim approx $1,000 in potentially deductible education expenses. Even at the margin that's worth $350 if you are in the highest tax bracket.
    My advice (and I'm a CPA but not a tax preparer or expert) is to follow the intent of the reg and not try to structure things to fit inside the lines. The intent is to encourage job retraining to promote employment (and more tax revenue). I don't like to pay more than I owe but...I also don't want the distraction of an audit. Unless it was worth a lot of dough. Then...maybe.

    Reading the stories about shipping things to the US confirms my decision to do the same thing, take empty bags with me when I travel for my wife's interview. US Customs opens, inspects and destroys anything of value shipped from Vietnam. She will need almost all new clothes because of the weather difference in LA, and her sister gets anything else of value.

    OP...you wrote an essay on how your wife wrongly accused you of abuse, is preparing to move and take your son, and is preparing to live a life of leisure by depending upon you and the government for funds, and yet you sleep with her?
    With all due respect you have a serious set of legal and financial issues - and being alone with her is the last thing you want at this point. Given what's transpired she is a legal foe. I know you love her and all, but suggest you see things as they are, or at least what you wrote they are. And that is not good.

    It's disappointing people have such a hostile and suspicious attitude, especially when so many people are petitioning the government to speed things up. In my experience life isn't fair. As a husband who misses his wife dearly, and whose case has been going on now for just about a year (and that's average) I wish the OP and spouse the best of luck.

    OP stated the following: "I thought maybe just let her stay for another year and then just don't file the ROC and let the USCIS take her back to Vietnam.". Let the USG "take her back to Vietnam". What? If he doesn't think the marriage will work out divorce her and be done with it (except for the pesky issue of the 864 and all that).
    You are correct...none of us know what really has happened, we only know what the OP stated. My problem is the idea that he would "let" her stay here. He doesn't "let" her stay here...that is up to the USG. Who knows what will happen...if she can get thru ROC he's on the hook for her financially. Presumably it was a bona fide marriage at the time she entered the country, proving fraud is difficult at best. From the perspective of the USG I would prefer they not waste resources trying to figure that out.

    I suspect you are an immigrant yourself so you should know better...but you didn't grant your wife the ability to move to this country. If you want to divorce her fine, your choice. If you want to import another wife fine, your choice. Seems to me to be an abuse of the system but the law is the law, perhaps you can't find a suitable bride in the US.
    But don't expect USCIS or this government to deport at your whim. You may not have to help her stay, in fact if your marriage is done then that would be fraud. But this idea my tax dollars should be wasted investigating and deporting your castoff is upsetting, to say the least.

    No but you need to be sure he or she understands the tax laws of the state in which income was earned so as to properly complete any state tax forms.
    I am a little surprised at the number of people who run into problems with the AOS because they didn't file tax returns. The bigger issue for them are problems with the IRS. A visa should be the secondary consideration, after buttoning up their tax situation.

    Curious on the timing...you entered the US in October of 2006 and your divorce was final in January of 2007, and you remarried the next month? I was under the impression divorces take a minimum of six months to be final (depends upon the state). Also, the fact that you remarried a month after divorce and four months after entering the US would, to my thinking, raise questions.

    I agree on the impact within DOS...even if NVC is staffed by contractors how will they be paid?
    My best guess is a shut-down (and it's becoming more likely by the day) will be relatively short, maybe a week. That said agencies are already preparing for the shutdown, meaning it's already likely to start impacting things. And, it will take time to get things restarted.
    Surely it can't be a good thing. We still have to pay taxes though, even if they can't figure out how to play nice long enough to keep government running.

    Suggest you follow @Stevie b's advice and expect everything to take a while. From experience setting expectations this is easy and quick are more than not likely to lead to disappointment. The good news is cases that are sound are almost always approved. The reality is that some move fast and some move slow - often for seemingly no reason. Fortunately you have a community of knowledgeable people here who have been through everything and can help with both procedures as well as the emotions.

    I'm old enough to have worn a suit and tie to work for the first five or so years of my career so take this with a grain of salt - but I recommend suit and tie. I don't see you offending anyone with a suit and tie, or a sport coat and nice pants/shirt. Again just my opinion but in these situations you want the focus to be on what you say, and not what you wear. So the worn out jeans and Metallica t-shirt should stay in the closet...
    And that is not a trivial question - the whole visa and citizenship process is very important - big stakes. Your attention to detail shows you take it seriously!
