Aren't you in removal proceedings?  Where is your attorney to help you with this?  You can't appeal the I-130 as you are not the petitioner.

Folks I know this thread is about VAWA,but  I need a healing  prayer for  a friend  with COVID. She had a baby 4 days ago, she doesn't even know that she had a C-section, and she has a  baby boy. She is in a coma and intubated, and unfortunately her kidneys stopped working and they started yesterday  dialysis. Her case needs a miracle, second the doctors. Her name Nadia, she is a pastor and very young (34 years old).I believe in the power of prayer. Thank you everyone .

It’s very clear that i824 only applies to petitions that can have derivatives, as that is what it is. Why on earth do you think people go through these hoops to bring children if it was was easy as a i824 workaround for petitions that can’t have derivatives?

To qualify, the principal applicant must get their LPR status through one of the following visas:
    (E) Employment-based category (F ) Family-preference category Green Card lottery (diversity visa lottery) K or V visa IR is NOT any of these categories. The F family categories mentioned are F1, F2A, F2B, F3, F4...all the ones that allow derivatives.

What? That post doesn’t even make sense.

Bottom LIne:  NVC or travel.state.gov will tell you what you need to do to bring your children to US after you immigrate.  I suggested emailing them and they will tell you the direct steps to take.  You still have to indicate that you plan on bringing your children on DS-260 at a later date.

Regardless of SuzieQ stated you still need to find out what you need to do.  Since you are a Consulate issued visa, who will be a LPR and not a US Citizen, it is suggested that you talk to NVC to get the correct information.

I did not say she was using the I-824, I said per the I-824 to contact NVC and they will tell you how to file for derivative since you have an Embassy Interview.  Read the statement as reading is fundamental.

The answer is still YES, you are filing for your children at a later date.

Per I-824 You were issued an immigrant visa at a U.S. Embassy or U.S. Consulate and were admitted to the United States as a lawful permanent resident. You may contact the NVC for information on how to request follow-to-join benefits for your dependents. You may direct your inquiry to our Public Inquiry Form (https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/ask-nvc. html?wcmmode=disabled) or by writing to the National Visa Center, at: National Visa Center ATTN: WC 32 Rochester Avenue Portsmouth, NH 03801-2909

Filing VAWA has anything to do with his RFE, he needs to decide what he wants to do in his life, to continue with his wife or to file VAWA.

You need to look at your contract you signed with the law firm.  Even if you terminate their services, you may still be required to pay the balance.

My friend that is a lawyer says that it is more common when you marry within 1 year of meeting in person, met online and  immediately start sending money and buying gifts, does not introduce you to family and friends, among others.
