Marriage and N400

Hello Everyone. 
I’m planning on applying for citizenship by filing the N-400.

I initially obtained a 2yearsGreen Card from a first marriage but got divorce and filed a i-751 as divorcee ( provided the divorce decree in the i751 and currently still pending…since 2019 🥵)

 

I’m now eligible for citizenship.
However, since I got married last year, I’m not sure if there is a different form  « to update my marital status » or should I simply include that new marriage certificate in the n-400 with the old one + divorce papers, or shouldn’t I provide any of that…? 
I’m a bit/big confused!

You need to try to get I-751 approved before you focus on I-400. It has been pending for 5 years.

You will need to provide evidence of your current marital status as well as evidence of your marital history.  You still use the N400 form, but keep in mind the I751 will have to be finalized prior to the N400 being approved.  Do you know why your I751 is outside of the normal processing time?

Thank you for your response! And your help!! I didn’t know the i751 needed to be finalized in order to start the n400. Grrr

 

I’m not sure why it’s taking so long…

I moved from MA to CO which took forever for them to transfer my case ( from what I could see via the online tracking ) then they asked for more evidence which I submitted… but moved back to MA few years later . 

 

I believe my case and evidences weren’t strong / enough… I was younger and did everything by myself…. 
Stayed married for like 2 years with a very bad ending… maybe the whole story wasn’t enough lol I’m not sure…

 

Right now the last online update is from Octobre 2022 - « Case was updated to show fingerprints were taken ». Whatever that means.

not sure what’s next then.. im hopeless… 

This is my 3rd year getting those 1 year visa … such a hassle 

And I’ve been living in the states for almost 10years!!!!

It does not, the processes can happen simultaneously. But you won't be approved for the N-400 until you have your I-751 approved as well. It's been 5 years, so way way past normal processing times. Edit: I see your renewing your ADIT stamp yearly, that's good.

 

You can start your N-400 process, including all your marital changes but please go after your I-751 while you're at it. Start with USCIS for an inquiry about being out of processing times, escalate to your local representative, etc.

 

Sometimes even the filing of the N-400 helps move the I-751 along but you need to figure out why it's been 5 years and your still stuck at biometrics taken with no other movement in that process.

Just to emphasize as @jackiegringa already stated, the N400 can be filed now even with the I751 pending, but the I751 needs to be finalized before the N400 can be finalized.

 

By filing the N400 you might get your I751 moving, but I would do a little more research first on what is holding up the I751.  You mentioned moving, there are many stories of folks not receiving an RFE because USCIS cannot seem to deal with AR-11s very efficiently.  You might try calling USCIS and try to get a tier 2 IO to respond.

I would apply for the citizenship. Even USCIS notified you that you are eligible. Of course your N400 won’t be approved before your I-751 but it will definitely speed up your process with I-751. Good luck
