Thought this was appropriate here.  Btw, given the divisive rhetoric from the Democrats, why should the Republicans bend over to help them?  Boxer's comments are simply party serving, Feinstein can make her life easier by simply retiring, and the heck with the political fallout.  The people keeping her from retiring for political reasons are the bad people here, but what else do we expect from Democrats.  That being said, McConnell is in the same boat and more than likely he will not retire since the current governor of Kentucky is a Democrat.

To my knowledge, the appointee must be of the same political party as the vacating member was.  This was a rather recent rule-change in Kentucky.

This is how it is supposed to work in Kentucky now, but it has not been tested in court yet.

And the GOP Supermajority had to override the veto by Governor Beshear  to pass this legislation. Most commentators agree that Beshear, if given the opportunity, will ignore the state legislature, appoint a Democrat and dare the appointment to be challenged in court.

 

He loses nothing by doing so. Even if the court immediately stays his appointment, that will just leave the seat infilled, which is another option he has, so why not give it a go?

 

He has already shown his intent by vetoing the bill, so why would he not choose to challenge this law?

I fully expect he will challenge the law given the opportunity.  What is unclear is why is DiFi not retiring.
