Either way, it's still not normal to "allow" your wife to have a child with someone else. It wouldn't be difficult at all for USCIS to find out about it. Medical records, healthcare records, child's birth certificate ect..USCIS and the State Dept has access to everything.
 

They do have all info on the USC without going to FBI

just google  your own name and see what pops up 

Site called Verify wlll bring up names ,  family  former marriages,  criminal records,,  social media sites , education  and job history

But it would not have shown a baby that wasn't yet born

 

But for the foreigner its   a little hard to just google all this so  wishing,  again,  he would name the embassy

I’d say fuhggedaboudit! I met a young man on this same VJ from my original country whose spouse had a child which wasn’t his after they got married. Nine years and two petitions later, he’s still stuck in my country. Both petitions were denied.

 

I wouldn’t approve your petition if I was a consular officer, and I’m a pretty lenient guy.

AZ is the most lenient towards Africans and mostly W.Africans. So, if he finally lowers his defense of you or won't defend you, then surely, your goose is cooked.

If @African Zealot no longer believes in love… what hope do the rest of us have?

  @Doc B this really is a job for the USC… I am a major proponent of the beneficiary taking control of their immigration journey but your journey is over before it begins If your wife isn’t researching how best to get you to the US

That's what i say

talk to her

see if she is willing to spend lots of time with u and pay the cost to overcome and wait the timeframe

many  a USC gives up 

its not cheap to go the distance to prove a NOID /NOIR

and may not be sensible  as there may be a long list of issues in this case

Not to mention, the problem here is that she had a child "the old fashioned way" which really puts your relationship in a weird light. If the only problem is that you can't have a child then why not use a sperm donor and do IUI or IVF?

It'd be really hard to convince USCIS that this is a bona fide marriage. USCIS (belonging to the Department of Homeland Security), however has nothing to do with issuing passports (Department of State does that).

You live in Home Country…so does the Consular Office who interviewed you..

 

 he knows a lot about your culture, religion, social groups, family values  and he flagged your case for fraud BEFORE you even told him   your wife was 9 months pregnant..

 

it..does your wife use Facebook or other social media? If she posted about pregnancy , it’s likely they knew already.

 

Can you defend this case..NO. ..for all the reasons others have pointed out. But you are stuck..because unless you overcome fraud findings you will never get any visa to the US
