Morocco has no jurisdiction.

 

If you both live in the same state, then you get divorced in that state.

Normal practice in most states is the person seeking the divorce has to serve the other in the county   (or parish) the other lives in

Texas if u are still there has a 60 day waiting period and no fault divorce if u both agree

and one of u must live 90 days in the county that the divorce is filed in

 

but if no assets or children,  going to Morocco is faster than a US divorce as it only takes a week to divorce

 

divorce does not dissolve the I 864 agreement

I don’t recommend doing this if both parties live in the US.  Moroccan courts have no jurisdiction over residents of the US, and we’ve seen issues with the legality of such divorces here on VJ.

Divorce in your own state. I'm assuming his plan is to stay in the US. I'm sorry this didn't work out for you, but there are a lot of "stereotypical" ME men out there. I divorced mine in my state, since I'm a resident here. It isn't fast, but it is final.

Got married : 6-3-06

I-130 delivered : 6-12-06 - Appt in Cairo

I-130 Approved : 4-18-08 - USCIS approval!!

Visa Interview Date : 6-22-08

Case sent to WADC: 8-6-08 - FBI check

Email From Embassy 1-09 - Still in AP (7 months)

19 DHL scans - 2-19-09

1-26-09 - Out of AP, now final review

2-26-09 - Visa in hand!

3-11-09 - POE JFK - Got stuck there due to immigration taking too long. They didn't change his visa from CR1 to IR1, have to go to immigration here to fix it.

3-12-09 - Arrived in Portland!!

5-29-2010 - Zane was born ** Absolute best day of my life!

6-7-2010 - Ahmed went back to Egypt

8-23-11 - Filed for divorce

1-12-12 - Divorce final

Thanks so much.  I had plenty of warning.  Even on the U.S. consulate in Morocco's website.  It's more of a case of I started something and I wanted to finish it, i.e. get him here.  I hold no grudge against Moroccans or MENA men.  We just have different ideas and expectations.  Thanks for your help and sympathy!

Thank you!  And how does that work with the i-864.  Is there a standard amount I would need to provide him, or just be sure he is not homeless LOL.

Agreement is with USA government

If he signs up for public "charge " benefits,  you could be required to pay the money back to government /  haven't heard anyone that had to do it as seems the government doesn't follow thru but the rule is there so don't test it

 

Encourage him to go for naturalization when he is eligible as that takes u off the hook

 

I do know USC's who have divorced in Moroc/ Benefits?  just faster and cheaper and Moroccan man has to confirm the dowry is paid off

Divorces registered in Rabat are recognied in US same as Moroccan marriages

The I 864 has been enforced by the Divorce Courts to ensure the sponsor meets their obligations.
