Hi all, I need some advice I am in the process of k1 finance Visa and got my Interview last March 2, 2023. My situation is I'm previously an OFW and I have obtain divorce from Singapore last 2 years ago. Both parties are filipino and I'm not annulled in Philippines. Now after my Interview the console give me 221G stating my lacking Marriage documentation: Certificate of NO Marriage on Record and Advisory on Marriage. My interview was being conducted in embassy manila.  Question is I cannot get Cenomar as I'm still married, can I just get CEMAR instead and attached my divorce in SG? It will show from the record that I'm married but the divorce degree will support it.

I am not sure you can get around the CENOMAR requirement.  This question might get better responses in the Philippines forum.

So did you show your original CENOMAR or CEMAR at the interview, if not why? Since you were married in the Philippines you will need the CEMAR AND the divorce decree from Singapore. It needs to be the certified document from the Singaporean government.

No only my divorce copy, I don't bring Cenomar as I was under the impression that its only for single people  who needs this document.  Now I already requested online for a cenomar from PSA but as a result they found 1 marriage for me and they will send me CEMAR instead I'm still waiting for delivery. Now for my next move I will send the CEMAR together with my divorce copy from singapore as a supporting document. Hope they will accept it what do you think?

CENOMAR (certificate of no marriage) = No Marriage on file

CEMAR (certificate of marriage) = Marriage on file

You show the CEMAR along with certified divorce decree which shows that you are no longer married, leaving you free to remarry. In the Philippines you would need to file a recognition of divorce not an annulment to have it recognized. But for immigration purposes the recognition of divorce is not needed. Just the CEMAR and divorce decree are needed. Remember you are filing for a US visa not a Philippines visa. US does not care if Philippines recognizes your divorce or not.

The CEMAR will list the marriage that you already told them about.  You have shown them it was legally ended in Singapore.  The CEMAR will not show any marriage that you have not already told them about.  That is why they still want to see it.  The two documents together show your marital history and current eligibility to remarry.  Give them what they ask for you should be fine.

hi just an update I already received my CEMAR the one that I requested online, but I need to bring it back to PSA as my last name in brides name is misspelled instead of CELDRAN it became CELORAN, I don't know maybe it's just a typo error as my original marriage contract are all correct. I hesitate to send it to embassy  with that wrong spelling of my last name.
