Approval question

Hello everyone,

 

Our i130 got approved but I have a question. This is what it says. Does it just mean it’s going to go to the nvc now? And why did they said it was retained? Anything I should be concerned about?
 

“The above petition has been approved. However, you did not indicate on the petition whether the beneficiary intends to apply for an immigrant visa abroad at a U.S. Embassy or a U.S. Consulate or will apply for adjustment of status in the United States. Therefore, USCIS has retained the petition.
If the beneficiary intends to apply for adjustment of status in the United States, they should submit a copy of this notice, along with a Form I-485, Application to Register Permanent Residence or Adjust Status. They can obtain Form I-485 from the USCIS website at www.uscis.gov, by contacting the USCIS National Customer Service Center (NCSC) at 1-800-375-5283, or by visiting the local USCIS field office. Filing address information can be found on the USCIS website at www.uscis.gov.
If the beneficiary decides to apply for an immigrant visa outside the United States based on this petition, you should file Form I-824, Application for Action on an Approved Application or Petition, to request that we send the petition to the U.S. Department of State National Visa Center (NVC).
The NVC processes all approved immigrant visa petitions that require consular action. The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition to that consulate.”

 

does this just mean that everything will go to the nvc now and whenever we are ready to apply for adjustment of status to send this notice in with it because they will have the file? Nothing to worry about?

It means you missed filling in an area on the I-130.  You now have to submit an I-824 to move the case to NVC.  Otherwise, it will remain at USCIS.   This will cause a significant delay.

they wont do anything until u submit that i-824. do u have the soft copy or hard copy of the i-130 application and check if u made mistake by didnt choose it?

What did you fill out for these 2 sections? Online version has the same questions.

It’s a very costly mistake (if indeed the mistake was on the part of the petitioner who filled it out). Last I heard it takes at least a year to process, I wonder if it went up

In that case, OP:  spouse is not eligible for adjustment of status.  Like others have said,  the form was not filled out correctly, so you will need to take the advice given about fixing it.
