I got a DUI and reckless driving charge. It's been more than a week but I was just so lost and depressed to even ask anybody for help. Like a lot of us here, I have been depressed and got into a car accident and was taken to a hospital. Thankfully no one else was involved, and also there was no damage to any property except for a poll that I crashed into. Only person involved in the accident was me. I feel like I wanted to take my life that night. I have gotten signals from God in the past few days, and I have just been thankful to be alive right now because if something had happened to me that wouldn't be fair to my family, people who love me are waiting to see me when i visit them in a couple of months, and to myself. I have learned a lesson to not commit an act as stupid as I have an I am ashamed of what i wanted to do that night.

 

I request senior members and members who have been through similar experience in the group what could be the repercussion of a 1st dui on vawa. I was taken to the hospital s there was no arrest, or tests involved but obviously my hospital blood reports contain alcohol. I went to the station to pick up my things and that's when they gave me the tickets and the dui for which i need to appear in court soon. Since it's my first DUI, they're saying they don't wanna go after me that's why they are charging me under the city laws and not the state. Also if I can agree to participate for a deferral dui program which will have my charges dismissed in the court (7-8 months) and eventually expunged with finger card destroyed in about 18 months. I will need to make a conditional guilty plea to the court without the court signing and entering the as a conviction.

 

I am also thinking of speaking with an attorney to see what are other options but if I go with the above, what do you think will be the impact on my VAWA petition?

And is there any other damage control I can do or anything to improve the situation? Your advise would literally mean life to me right now. 

 

I have been doing volunteer work for some time now, and will be doing more volunteer work in the coming months to build a better case for GMC in the time being.

I had several clients with DUI ,and they got their GC, one of them had 3 DUIs.

You need to proof for example that you have a job and you will lose it because your EAD expired, or that you will become homeless because you don't have any savings and a job etc.You have to prove severe financial loss.

I-130/I-485 - filed March 2017

AOS interview - Jan 2018

I-360 and I-485 - August 2018(Filed concurrently)

I-130 - Approved (March 2020)

I-360 - Jan 2021 Rfe received 

I-360 - Feb 2022 New card in production(c31)

No movement till date.

 

I am a 2018 filer. I filed using my lawyer’s office address in NYC, but i live in NJ. At the time, I had a pending I-130, I-485, but she still went ahead and filed a new I-485 along with the I-360. I have since lost confidence in my lawyer as she charged me to renew my EAD(c9) category when it is free, and her lackadaisical attitude towards my case. Now i

am planning on continuing this journey myself. I received my C31 EAD card in February 2022, and haven’t gotten an approval letter ever since. I haven’t heard anything from USCIS regarding my I-485. Couple of questions I need answered :

 

1. is it normal to receive the C31 EAD card without an approval letter?

2. If no, what is the timeline to receive an approval letter?

3. Can someone assist me with the steps to renew my C31 card?

4. Do I have to pay for renewal of the C31 EAD card?

5. I live in NJ and my letters go to my lawyer in NYC, which Senator/Congressman should I contact for assistance, NYC or NJ?

6. What steps can I take to disengage my lawyer.

7.  Will changing my address to NJ from NYC delay my case?


I have a lot of questions, but will be glad if someone/people with knowledge can help with answers.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You always first receive C31 EAD then USCIS usually takes around 1 week to 3 months for an approval notice. What does your online status say? I would say reach out to your representative. 

You can renew C31 however, it would cost you money. Best option is to renew as c09 which would be free if you have paid for i-485. 

I think you need to reach out your senator/congress person in the state you live.

Thanks @balo101I never received an approval notice. The online status shows that card has been delivered. There has been no updates since then. I have a valid C09 card that expires in September 2023, but was think of renewing the C31, and having that as well.

mine c31 is expiring on feb 2023. I posted the same question few days ago. 

mine c09 is expiring on 2024 so i am not gonna apply for c31. why waste money.

Won't be a factor. This is what would normally be considered a simple DUI and it trips none of the criminal bars. Own up to it when asked by immigration and you'll be fine.

Contradictions without citations only make you look dumb.

1. Yes, card generally gets printed first.

2. Few weeks, mine took like 3 months between the C31 getting issued and the approval letter getting sent out.

3. Honestly, don't bother renewing it if you have a C09. But if you really want to you fill out I-765 and include a copy of the I-360 approval notice.

4. Yes, hence why you shouldn't bother with it and just keep renewing the C09.

5. NJ. Who your congressman is depends on your actual physical address, not the address of your lawyer.

6. You can send a letter to the service center or field office that currently has your case telling them that you wish to fire your lawyer and any correspondence from USCIS should go to your physical address at [address] and you designate this as your safe mailing address under VAWA.

7. No. Interviews and jurisdiction gets assigned depending on where you physically live, it's not uncommon to have a lawyer in a different state handling your case and it'd make no sense for USCIS to schedule you for an interview in NYC if you live in California but the lawyer's in NYC.

Hi dear petitioners 

Just few hours back, I wrongly clicked case app and i saw there is a new update about my case that “new card is being produced “  I will attach it on here. i was loosing my hope because I submitted my Vawa 2019 September .i was also removal proceeding which is few months ago got administratively closed by judge. I have only I-360 , I didn’t apply I-485 nor work permit. Now new card is being produced . Is it good for me?
