We came to the states in 2012 and the initial marriage based gc fell through 2-3 years in because the other individual turned abusive and abandoned the case. We were undocumented for a while with no hopes till our lawyer informed us about vawa and in 2018 we applied. Thank you to everyone here that took the time to answer some of the questions/concerns ive had throughout the entire process. Wishing anyone still going through this the best of luck it'll be over soon.

 

I-360 timeline:

August 24, 2022 Card Was Picked Up By The United States Postal Service
August 26, 2022 The Post Office delivered your new card to the address you gave us.
August 25, 2022 The Post Office picked up mail containing your new card.
August 24, 2022 We mailed your new card your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, directly to the address you gave us.
August 23, 2022 We approved your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.
August 19, 2022 We ordered your new card.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

When did you submit your i-485? 

If you submit after the Vawa approval then give it few more months. If it before or with VAWA then make an info pass appointment to inquire about it.

I have an approved I-360 and pending 1-485 with USCIS. I’m still in removal proceedings and my lawyer has filed PD twice with OPLA! Once before my I-360 approval and once after but no news from that. I’m insisting He files a motion to terminate directly with the immigration judge but he wants to charge me more for that after paying $2,500 to file the PD. I’m confused right now, cos I feel some of these lawyers just want to keep milking clients. He’s talking about filing a new I-485 with the immigration court and then file a motion to terminate, which makes no sense to me! Any input would help. I’m confused as to what to do, my master hearing is for Feb 2025. Anyone here that has a guide to terminating removal proceedings?

Do not file new i-485. Find a new lawyer who can filled motion directly with judge. I can give you my attorneys number he is in NYC. He charged me 1K.

Can I start the application now (Just 3 months after my green card)

Where will I send the application to (NBC or Vermont)

What is the application fee per child (Children are aged 14 & 12)

What documents do I send with their application?

Complete a I-824 versus I-130. It will only be one fee for both children.  It is a follow to join petition. Still mail to Vermont

I went through the same process . My lawyer filed motion to terminate with the court and emailed ICE the copy of the approval letter so they won’t object .The cost of this motion wasn’t 2500$ though . They charged me 600$ .  Whether you apply I 485 with the court or not judge gets to decide if he wants to process your case or refer you to USCIS filing . Most judges don’t like to keep their dockets full with these type of cases which you will most likely go through USCIS with you 485 application
