You can tell them if they ask that you had a traffic infraction . If they ask !

My case got transferred in May 2023 to NBC . They sent me an RFE on June 2023 received a response 3 weeks later . In January I placed a Service Request through my lawyer that it was taking longer than their processing times . February 2n case got approved . If that helps

No point doing an info pass appointment . I have made one All I heard from the person was your case is Wava related we have no access to that . I would suggest to reach out to your congressman again so they could inquire on your behalf . Your lawyer also can place a Service request as well with the USCIS

I am at the point where I wouldn’t believe it until I see it . PS I was secretly hoping it would come in one of those days when you post jokes tbh .

It’s confusing . When they transferred the case to Nebraska . They sent a letter saying they have a jurisdiction over the case now . If you write to a Vermont . Wouldn’t you receive a letter saying they don’t have a jurisdiction over a case ?

It’s for I 485 . My 360 was approved almost 3 years ago

Writ of Mandamus I guess is your last option .

Hello VJ Family ! Has anyone dealt with this kind of situation before . Lawyer says they haven’t received a response and it’s just customer service closing out the service request . SR was responded by assigning to an officer . But it clearly says on the case update that they have sent a response . I would appreciate any info on this matter . Thank you !

I Would say the next steps would definitely need a lawyers input . If I were you I would 1)inquire through your local congressman 2) Inquire through Ombudsman 3) Depending on the outcome of the first 2 the next one is finding a good lawyer that specializes in writ of mandamus ( suing the agency to make a decision on your case )

Hello VJ family . How long does it take for them to process your case after you get I 485 transfer notice ? NBC transferred to local field office (Baltimore FO)

I went through the same process . My lawyer filed motion to terminate with the court and emailed ICE the copy of the approval letter so they won’t object .The cost of this motion wasn’t 2500$ though . They charged me 600$ . Whether you apply I 485 with the court or not judge gets to decide if he wants to process your case or refer you to USCIS filing . Most judges don’t like to keep their dockets full with these type of cases which you will most likely go through USCIS with you 485 application

As far as I know your attorney needs to attach the copy of your I360 approval notice to motion to terminate removal proceedings before your I 485 gets accepted by USCIS . At least that’s what I had to . Procedures might be updated . Technically immigration court has a jurisdiction over your case . Applying 485 to court is right . But rarely you see judges processing those cases . They usually like to approve the motion to terminate and send you over to USCIS .

Your lawyer have to file a motion to terminate the proceedings with the immigration court before you can file I 485 with USCIS . Removal proceedings cases get temporarily closed to free up the docket while your case is being considered. Once your case is approved you have to file a motion before you can apply

Dilemma is whether I should travel or not . I understand the logic behind your answer . But why would they issue an advance parole if they won’t let you back in .

Hi guys ! I have been stuck on the dilemma and in need of your opinion on couple of issues . My I-360 was approved November 2021 . I couldn’t apply to 485 because I was in removal proceedings and it took about 6 month for them close the removal case . I applied for 485 in May this year along with Work permit and Advance parole . 1) Will they count I485 from the date I applied it meaning I have to wait another 2.5 years or they count from the date the vawa was applied ? 2) My advance parole was approved a month ago but my lawyer advised against traveling abroad with it since I was previously in removal proceedings and they might not let me back in because of it . So I am kind of confused as to why they would issue advance parole but deny you an entry back to the country when you use it . Any input would be appreciated. Thank you 🙏🏻

Just in case if you have a SAVE case number check it on SAVE website and take a screen shot of it . In there it shows if you don’t receive an update within 21 days please contact your benefit issuing agency . So that way they can’t deny issuing you a DL.

It happened to me before . Usually if the SAVE results doesn’t come back after 30 days they have no choice but to issue you a Driver License for 2-8 month depending on Manager’s discretion (in my case they renewed my DL for 8 month ). You have to press them on that otherwise they will tell you to wait .
