On a positive note, it'll give you and your fiancee time to gather the documents and book the flight to Rio de Janeiro.

I'm hoping my case gets created next month.

Hopefully interview spots for February are still opened 😁

Trying to think positively 🙏🏽

Hello everyone,

NOA1: 9/17/2021

NOA2: 11/22/2022

I received the I-797C form a few days after NOA2 stating that our case has been approved by USCIS, that it is being sent to the NVC and that this I-797C form is not the true receipt notice.

On my NOA2 approval online, it says I should receive the true approval notice(I-797 form) by Dec 7 but I still have not gotten it yet. I have only received the I-797C.

Does anyone know how long it takes to get the true approval notice of NOA2 (I-797 form)?

Did you happen to file with an immigration attorney? We filed with a lawyer, and the lawyer got the official notice (I-797) and I received the copy (I-797C). They basically have the same information.

Hi @Optimist19 thanks for replying back. I do have an immigration attorney. I contacted him yesterday and he said he hasn't gotten it yet. How long did it take for your lawyer to get the official notice (I-797) after NOA2?

He got it around the same time that I got the I-797C (which was about a week after approval). It's possible they forgot to send it or maybe it got lost in the mail. Ask your lawyer if you need the official notice. I think he can request another one from USCIS since he didn't receive it!

@Optimist19 Wow. It has been 18 days since I got the approval and my lawyer hasn't gotten it yet. Kind of making me panic now. I know we need that form for AOS and if anything goes funky with the NVC process we need to show them the I-797 form right?

No don't worry! We never got an NOA1 receipt notice in the mail, so I think these things happen. I think you or your lawyer can submit an e-request to tell them you never received the I-797, and they'll send another one.

I didn't realize we need it for AOS, but the NVC is okay without showing them the I-797 form. Whenever I inquired with the NVC, I provided the beneficiary's and petitioner's names and dates of birth along with the petitioner's email without the I-797. I think the I-797C would even be okay for NVC.

Hey guys - we got an email from the NVC saying our case was sent to the Jakarta embassy almost a week ago, and this past Friday our case status was change to "ready", however I contacted the embassy yesterday and they said they have not received our case yet. Any idea what's going on?

It takes around a month or 3 weeks to the case get in the embassy physically. When your case is ready, it means the embassy got the electronic version of it. You can already schedule an interview and doctors appointment.
